HomeMy WebLinkAboutRes No 304PLANNING COMMISSION RESOLUTION NO. 304 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, RECOMMENDING APPROVAL TO THE CITY COUNCIL OF A REQUEST FOR A CHANGE OF ZONE, UPON ANNEXATION, FROM 'S' TO PR-5 (CUP-1450E) AND PR-5 (DP 12-77) ON PROPERTY GENERALLY LOCATED AT THE NORTH- EAST CORNER OF THE INTERSECTION OF MONTEREY AVENUE AND THE WHITEWATER STORM CHANNEL. CASE NO. C/Z 11-77 WHEREAS, the Planning Commission did on the 29th day of November, 1977, hold a duly noticed Public Hearing to consider a Change of Zone application, filed by SUNRISE CORP., et al, from 'S' (Study) to PR-5 (CUP 1450E) and PR-5 (DP 12-77) upon annexation on property generally located at the northeast corner of the intersection of Monterey Avenue and the Whitewater Storm Channel, and more particularly described as: Parcels 1, 2 & 3, Parcel Map 9378 and the south one-half of the north one-half of the southeast one -quarter of Section 8, T5S, R6E, SBM WHEREAS, said application has complied with the requirements of the "City of Palm Desert Environmental Quality Procedure Resolution No. 77-7", in that the Director of Environmental Services has determined on November 14, 1977 that the project is exempt as an on -going project and a negative declaration was issued on that basis; and, WHEREAS, at said Public Hearing, upon hearing and considering the testimony and arguments, if any, of all persons desiring to be heard, said Planning Commission did find the following facts and reasons to exist to recommend approval of the Change of Zone request: 1. The proposed change of zone does conform to the Palm Desert General Plan. 2. The change of zone would meet the objectives of the Palm Desert Zoning Ordinance. 3. The proposed zone designation is compatible with existing and proposed zones in the area. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert as follows: 1. That the above recitations are true and correct and constitute the findings of the Commission in this case; 2. That it does hereby recommend approval to the City Council of the requested Change of Zone from 'S' to PR-5 (CUP-1450E) and PR-5 (DP 12-77), upon annexation as shown on the attached map, for the reasons set out in this resolution. 3. In addition, the Planning Commission recommends to the City Council that the zoning be subject to conformance to CUP-1450E or any valid amendments on the area encompassed by Parcel Map 9378, and DP 12-77 on the remaining 20 acre parcel.
