A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF PALM DESERT, CALIFORNIA, ANNOUNCING FINDINGS AND
RECOMMENDING TO THE CITY COUNCIL THAT THE VALIDILITY
OF COUNTY CUP-1450E BE ACKNOWLEDGED UPON ANNEXATION,
PURSUANT TO SECTION 25.06.080 OF THE MUNICIPAL CODE
ON PROPERTY GENERALLY LOCATED AT THE NORTHEAST CORNER
OF MONTEREY AVENUE AND THE WHITEWATER STORM CHANNEL.
WHEREAS, the City has received a request for annexation of an
approximate 246 acre parcel generally located at the northeast corner
of the intersection of Monterey Avenue and the Whitewater Storm Channel,
and more particularly described as:
Parcels 1, 2, & 3, Parcel Map 9378 and the south
one-half of the north one-half of the southeast
one -quarter of Section 8, T5S, R6E, SBM
WHEREAS, the propertyowner has submitted written evidence from
the County of Riverside that a valid conditional use permit (CUP-1450E)
exists on the property encompassed by Parcel Map 9378, and;
WHEREAS, Section 25.06.080 of the Palm Desert Municipal Code pro-
vides that no new or additional conditional use permit or license shall
be required for any land use authorized by the County provided there has
been substantial relience upon the governmental entitlement, conditions
are complied with and substantial construction has begun on a portion of
the project; and,
NOW, THEREFORE BE IT RESOLVED by the Planning Commission of the
City of Palm Desert as follows:
1. That it does hereby recommend to the City Council that upon
annexation, County CUP 1450E be determined as being valid
pursuant to Section 25.06.080 of the Palm Desert Municipal
Code.
2. That it does hereby recommend that the City Council require
any construction on the property encompassed by PM 9378
conform to County CUP 1450E reflected in the attached
Exhibit J or any valid amendment subsequently approved by
the City.
PASSED, APPROVED, and ADOPTED at a regular meeting of the Plan-
ning Commission of the City of Palm Desert, held on the 29th day of
November, 1977, by the following vote, to wit:
AYES: BERKEY, KELLY, KRYDER, READING, SNYDER
NOES: NONE
ABSENT: NONE
ABSTAIN: NONE
