A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF PALM DESERT, CALIFORNIA, ANNOUNCING FINDINGS AND
GRANTING A CONDITIONAL USE PERMIT TO ALLOW A PARCEL
SPLIT OF ONE 5.06 ACRE PARCEL INTO TWO PARCELS WITHIN
THE R-E 43,560 H ZONE, THEREBY PERMITTING HILLSIDE
DEVELOPMENT ON A SITE GENERALLY LOCATED WEST OF HIGH-
WAY 74, SOUTH OF HAYSTACK EXTENDED IN THE FOOTHILLS
AREA OF SECTION 30.
CASE NO. CUP 14-77
WHEREAS, pursuant to the provisions of the Palm Desert Zoning
Ordinance, the Planning Commission did on November 29, 1977, hold a
duly noticed public hearing to consider the application of DAVID G.
PREST for approval of a Conditional Use Permit to allow a parcel split
of one 5.06 acre parcel into two parcels within the R-E 43,560 H
(Residential -Estate, 43,560 sq. ft. minimum lot size, Hillside Overlay)
Zoning District, generally located west of Highway 74, south of Haystack
extended in the foothills area of Section 30, more particularly des-
cribed as:
APN 628-130-001
WHEREAS, said applicant has complied with the requirements of
the "City of Palm Desert Environmental Quality Procedure Resolution
No. 77-7", in that the Director of Environmental Services has determined
that the project will not have a significant adverse impact on the envi-
ronment on November 15, 1977 and the appeal period has expired, and;
WHEREAS, at said public hearing, upon hearing and considering
all testimony and argument, the Planning Commission did find the follow-
ing facts and reasons to exist to justify the granting of approval of
said Conditional Use Permit:
1. The location of the project is in accord with the objectives
of the Zoning Ordinance and the purpose of the district
in which the site is located.
2. Approval of the proposed use will not be detrimental to
the public health, safety, or welfare, or be materially
injurious to properties or improvements in the vicinity.
3. The proposed use will comply with each of the applicable
provisions of the Zoning Ordinance.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the
City of Palm Desert as follows:
1. That the above recitations are true and correct and constitute
the findings of the Commission in this case.
2. Approval of a Conditional Use Permit is granted to DAVID G.
PREST subject to the attached conditions.
PASSED, APPROVED, and ADOPTED at a regular meeting of the City
of Palm Desert Planning Commission held on this 29th day of November,
1977, by the following vote, to wit:

STANDARD CONDITIONS OF APPROVAL
CASE NO. CUP 14-77
1. The development of this project shall conform substantially to all
plans submitted in behalf of this case (Exhibit A), and as revised
according to the Design Review Board process and/or Planning Com-
mission action. Any minor changes require approval by the Director
of Environmental Services. Any substantial change requires approval
by the Planning Commission.
2. All requirements of any law, ordinance, or regulation of the State,
City, and any other applicable government entity shall be complied
with as a part of the development process.
3. This approval is applicable, subject to the development of this pro-
ject, commencing within one year from approval date and being promptly
completed.
SPECIAL CONDITIONS OF APPROVAL
1. Applicant shall comply with all conditions of the City Engineer
as stated in related Case No. PM 11388.
2. No development shall occur under this approval until concerns re-
garding sewage disposal, trash pick-up, school transportation and
fire and police protection are adequately addressed to the satis-
faction of each respective agency having jurisdiction over each
concern and to the satisfaction of the Director of Environmental
Services.
AGREEMENT
I accept and agree, prior to use of this permit or approval, to comply
with all the conditions set forth, and understand the Department of
Building and Safety will not issue a building permit or allow occupancy
on the use permitted until this signed confirmation has been received
by the Department of Environmental Services.
