HomeMy WebLinkAboutRes No 309PLANNING COMMISSION RESOLUTION NO. 309 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, ANNOUNCING FINDINGS AND GRANTING A CONDITIONAL USE PERMIT TO ALLOW CONSTRUC- TION OF 4 CONDOMINIUM UNITS ON A PARCEL APPROXIMATELY ONE-HALF ACRE IN SIZE ON PROPERTY GENERALLY LOCATED EAST OF HIGHWAY 74, NORTH OF VERBA SANTA WITHIN THE R-3 18,000(3), S.P. (RESIDENTIAL -MULTI -FAMILY, 18,000 SQ. FOOT MINIMUM LOT SIZE, 3,000 SQ. FOOT MINIMUM SITE AREA PER UNIT, SCENIC PRESERVATION OVERLAY DISTRICT ZONE. CASE NO. CUP 15-77 WHEREAS, pursuant to the provisions of the Palm Desert Zoning Ordinance, the Planning Commission did on November 29, 1977, hold a duly noticed public hearing to consider the application of WILLARD T. JORDAN for approval of a Conditional Use Permit to allow construction of 4 condominium units on a parcel approximately one-half acre in size on property generally located east of Highway 74, north of Verba Santa within the R-3, 18,000(3), S.P. (Residential -Multi -family, 18,000 sq. foot minimum lot size, 3,000 sq. foot minimum site area per unit, Scenic Preservation Overlay District) zone, more particularly described as: APN 628-081-008 WHEREAS, said applicant has complied with the requirements of the "City of Palm Desert Environmental Quality Procedure Resolution No. 77-7", in that the Director of Environmental Services has determined that the project will not have a significant adverse impact on the environment on November 15, 1977 and the appeal period has expired, and; WHEREAS, at said public hearing, upon hearing and considering all testimony and argument, the Planning Commission did find the fol- lowing facts and reasons to exist to justify the granting of approval of said Conditional Use Permit: 1. The location of the project is in accord with the objec- tives of the Zoning Ordinance and the purpose of the district in which the site is located. 2. The location of the proposed use and the conditions under which it would be operated or maintained will not be detri- mental to the public health, safety, or welfare, or be materially injurious to properties or improvements in the vicinity. 3. The proposed use will comply with each of the applicable provisions of the Zoning Ordinance. 4. The proposed use complies with the goals, objectives, and policies of the City's General Plan. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, as follows: 1. That the above recitations are true and correct and constitute the findings of the Commission in this case. 2. Approval of the Conditional Use Permit is granted to WILLARD T. JORDAN subject to the attached conditions. PASSED, APPROVED, and ADOPTED at a regular meeting of the City of Palm Desert Planning Commission held on the 29th day of November, 1977, by the following vote,to wit: AYES: NOES: ABSENT: ABSTAIN: BERKEY, KELLY, KRYDER, SNYDER, READING NON E NONE NONE GEOR E B EY, Chairm 11 ATTEST: PAUL A. WILLIAMS, Secretary STANDARD CONDITIONS OF APPROVAL CASE NO. CUP 15-77 1. The development of this project shall conform substantially to all plans submitted in behalf of this case (Exhibits A-B), and as revised according to the Design Review Board process and/ or Planning Commission action. Any minor changes require approval by the Director of Environmental Services. Any substantial change requires approval by the Planning Commission. 2. All requirements of any law, ordinance, or regulation of the State, City, and any other applicable government entity shall be complied with as part of the development process. 3. This approval is applicable, subject to the development of this project, commencing within one year from approval date and being promptly completed. 4. Construction plans shall be submitted for approval to the City Fire Marshal prior to issuance of building permits. All con- ditions shall be made a part of construction and no certificate of occupancy shall be issued until completed. 5. All utility service and distribution lines on or abutting the sub- ject property, shall be placed underground prior to occupancy clearance. 6. Prior to the issuance of a building permit for construction of any use contemplated by this approval, the applicant shall first obtain permits and/or clearance from the following agencies: County Department of Public Health Palm Desert Design Review Board Process Coachella Valley County Water District Regional Water Quality Control Board #7 7. Plans and specifications shall conform to the City of Palm Desert standard specifications, development procedures and design criteria. Any modifications, thereof, shall require approval of the City Engineer. 8. A landscaping, grading, lighting, fencing, amenities, trash storage, walkway layout, and irrigation plan shall be submitted through the Design Review Board. No final inspection or occupancy permit shall be given by the Department of Environmental Services to this project until the aforementioned approved plans and construction shall have been completed. Case No. CUP 15-77 SPECIAL CONDITIONS OF APPROVAL I. Curb opening shall be limited to 32 feet. 2. Sidewalk shall be installed adjacent to development. 3. Curb, gutter and tie-in pavement shall be installed on both sides of the frontage road. 4. Install or show exists a water system capable of delivering 2000 GPM fire flow for a two (2) hour duration in addition to domestic or other supply. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured along approved vehicular travel ways. 5. Install or show exists Riverside County super fire hydrants so that no point of any building is more than 250 feet from a fire hydrant measured along approved vehicular travel ways. a. Hydrants shall not be located closer than 25 feet to any building. b. Exterior surfaces of hydrant barrels and heads shall be painted chrome yellow and the tops and nozzle caps shall be painted green. c. Curbs (if installed) shall be painted red 15 feet in either direction from each hydrant. 6. Prior to issuance of a building permit, the developer shall fur- nish the original and three (3) copies of the water system plan to the Fire Marshal for review. Upon approval, one copy will be sent to the Building Department, and the original will be returned to the developer. 7. The water system plan shall be signed by a registered civil engi- neer and approved by the water company, with the following certifi- cation: "I certify that the design of the water system in Case No. CUP 15-77 is in accordance with the requirements prescribed by the Fire Marshal." 8. Storage space shall be enlarged so as to provide for location of swimming pool equipment. 9. Applicant shall show location of A.C. condensors. AGREEMENT I accept and agree, prior to use of this permit or approval, to comply with all the conditions set forth, and understand the Department of Building and Safety will not issue a building permit or allow occupancy on the use permitted until this signed confirmation has been received by the Department of Environmental Services.
