A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF PALM DESERT, CALIFORNIA, ANNOUNCING FIND-
INGS AND APPROVING THE DESIGN REVIEW BOARD ACTION
OF NOVEMBER 8, 1977 REGARDING CASE NO. 62C.
WHEREAS, the Planning Commission of the City of Palm Desert,
California, did review the Design Review Board action of November 8,
1977 regarding Case No. 62C, approving:
Case No. 62C - Request for approval of preliminary site,
floor and elevations for a commercial
structure for MR. & MRS. ROGER FULLER;
WHEREAS, at this time, upon considering and receiving all testi-
mony and arguments, if any, of all interested persons desiring to be
heard, said Commission did find sufficient facts and reasons to exist
to approve the Design Review Board action of November 8, 1977 with
regard to Case No. 62C.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the
City of Palm Desert, California, as follows:
1. That the above recitations are true and correct and con-
stitute the findings of the Commission in this case.
2. That it does hereby approve the Design Review Board action
of November 8, 1977 with regard to Case No. 62C, except that
Condition Nos. 13 and 14 are deleted.
PASSED, APPROVED, and ADOPTED at a regular meeting of the Palm
Desert Planning Commission, held on this 29th day of November, 1977 by
the following vote, to wit:

SPECIAL CONDITIONS
CASE NO. 62C
1. Construction plans shall be submitted for approval to the City
Fire Marshal prior to issuance of building permits. All con-
ditions shall be made a part of construction and no certificate
of occupancy shall be issued until completed.
2. Final construction drawings including a final landscaping, grading,
lighting, amenities, trash storage, walkway layout, and irrigation
plan shall be submitted to the Design Review Board. No final
inspection or occupancy permit shall be given by the Department of
Environmental Services to this project until the aforementioned
approved plans and construction shall have been completed.
3. Applicant shall furnish evidence of property owners' association's
approval of subject plans prior to submittal of final construction
drawings to the DRB.
4. Applicant shall modify that portion of the project located within
the area subject to CUP 11-77 in order to conform with all of the
Conditions of Approval of CUP 11-77.
5. The applicant shall agree to join any assessment district formed
that includes the subject property within its boundaries.
6. The applicant shall grant to the City of Palm Desert, easement
rights over the parking lot area of the project site.
7. Install or show exists a water system capable of delivering 2750
GPM fire flow for a two (2) hour duration in addition to domestic
or other supply. The computation shall be based upon a minimum of
20 psi residual operating pressure in the supply main from which the
flow is measured along approved vehicular travel ways.
8. Install Riverside County super fire hydrants so that no point of
any building is more than 250 feet from a fire hydrant measured
along approved vehicular travel ways.
a. Hydrants shall not be located closer than 25 feet to any
building.
b. Exterior surfaces of hydrant barrels and heads shall be painted
chrome yellow and the tops and nozzle caps shall be painted green.
c. Curbs (if installed) shall be painted red 15 feet in either di-
rection from each hydrant.
9, Prior to issuance of a building permit, the developer shall furnish
the original and three (3) copies of the water system plan to the
Fire Marshal for review. Upon approval, one copy will be sent to
the Building Department, and the original will be returned to the
developer.
10. The water system plan shall be signed by a registered civil engineer
and approved by the water company, with the following certification:
"I certify that the design of the water system in Case No. 62C is
in accordance with the requirements prescribed by the Fire Marshal."
11. No ingress or egress shall be provided from the parking lot onto
Tumbleweed Lane.

12. Ficus rehetusa shall be used as street trees.
13. Redesign the central portion of the parking lot in order to
provide for pedestrian access between the satellite parking
lot and the structures.
14. Proposed raised planters shall be relocated closer to El Paseo.
AGREEMENT
I accept and agree, prior to use of this permit or approval, to comply
with all the conditions set forth, and understand the Department of
Building and Safety will not issue a building permit or allow occupancy
on the use permitted until this signed confirmation has been received
by the Department of Environmental Services.
