A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF PALM DESERT, CALIFORNIA, ANNOUNCING
FINDINGS AND GRANTING A CONDITIONAL USE PERMIT
AND PRELIMINARY DESIGN REVIEW TO ALLOW CONSTRUC-
TION OF 21 CONDOMINIUM UNITS ON APPROXIMATELY
3.48 ACRES EAST OF DEEP CANYON BETWEEN DRIFTWOOD
DRIVE AND SAGE BRUSH DRIVE WITHIN THE R-3 ZONE.
CASE NOS. CUP 19-77 AND 106MF
WHEREAS, pursuant to the provisions of the Palm Desert Zoning
Ordinance, the Planning Commission did on January 3, 1978, hold a
duly noticed Public Hearing to consider the application of CHARLES
ROOT for approval of a Conditional Use Permit to allow construction
of 21 condominium units on approximately 3.48 acres east of Deep Canyon
between Driftwood Drive and Sage Brush Drive within the R-3 (Multi-
family residential) zone, more particularly described as:
Shadow Hills Estates, Lots 15-28
WHEREAS, said applicant has complied with the requirements of
the "City of Palm Desert Environmental Quality Procedure Resolution No.
77-7", in that the Director of Environmental Services has determined
that the project will not have a significant adverse impact on the
environment on December 12, 1977 and the appeal period has expired, and;
WHEREAS, at said public hearing, upon hearing and considering
all testimony and argument, the Planning Commission did find the follow-
ing facts and reasons to exist to justify the granting of approval of
said Conditional Use Permit:
1. The location of the project is in accord with the objec-
tives of the Zoning Ordinance and the purpose of the dis-
trict in which the site is located.
2. The location of the proposed use and the conditions under
which it would be operated or maintained will not be detri-
mental to the public health, safety, or welfare, or be
materially injurious to properties or improvements in the
vicinity.
3. The proposed use will comply with each of the applicable
provisions of the Zoning Ordinance.
4. The proposed use complies with the goals, objectives, and
policies of the City's General Plan.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the
City of Palm Desert, as follows:
1. That the above recitations are true and correct and constitute
the findings of the Commission in this case.
2. Approval of the Conditional Use Permitand Preliminary Design
Review is granted to CHARLES ROOT subject to the attached conditions.
PASSED, APPROVED, and ADOPTED at a regular meeting of the City of
Palm Desert Planning Commission held on the 3rd day of January, 1978,
by the following vote, to wit:

CONDITIONS OF APPROVAL
CASE NOS. CUP 19-77 & 106MF
Standard Conditions:
1. The development of this project shall conform substantially to
all plans submitted in behalf of this case (Exhibits A-C), and
as revised according to the Design Review Board process and/or
Planning Commission Action. Any minor changes require approval
by the Director of Environmental Services. Any substantial change
requires approval by the Planning Commission.
2. All requirements of any law, ordinance, or regulation of the State,
City, and any other applicable government entity shall be complied
with as partof the development process.
3. This approval is applicable, subject to the development of this
project, commencing within one year from approval date and being
promptly completed.
4. Prior to the issuance of a building permit for construction of
any use contemplated by this approval, the applicant shall first
obtain permits and/or clearance from the following agencies:
County Department of Public Health
Palm Desert Design Review Board Process
Coachella Valley County Water District
Regional Water Quality Control Board #7
5. Plans and specifications shall conform to the City of Palm Desert
standard specifications, development procedures and design criteria.
Any modifications, thereof, shall require approval of the City
Engineer.
6. Any/all utility service and distribution lines on or abutting the
subject property, shall be placed underground prior to occupancy
clearance.
7. Final construction drawings including a final landscaping, grading
lighting, amenitites, trash storage, walkway layout, and irrigation
plan shall be submitted to the Design Review Board. No final in-
spection or occupancy permit shall be given by the Department of
Environmental Services to this project until the aforementioned
approved plans and construction shall have been completed.
Special and Design Review Conditions:
1. Driveway openings shall be 12 feet for parking areas containing
less than 4 spaces.
2. The developer shall dedicate an additional five feet of right-of-
way on Deep Canyon Road , Driftwood Drive, Shadow Hills Road
and shall dedicate enough right-of-way on the easterly street that
is in a north and south direction for twenty (20) feet of right-
of-way, contingent upon adjacent development.
3. All curbs and gutters shall be placed 10 feet off of property
line. (40 foot street right-of-way).
4. Sidewalks shall be installed five feet wide adjacent to the curb
in this entire area.
5. Increase setback between buildings to a minimum of 10 feet.
6. Eliminate driveway on loop street.

I accept and agree, prior to use of this permit or approval, to
comply with all the conditions set forth, and understand that the
Department of Building and Safety will not issue a building permit
or allow occupancy on the use permitted until this signed confirma-
tion has been received by the Department of Environmental Services.
