HomeMy WebLinkAboutRes No 320PLANNING COMMISSION RESOLUTION NO. 320 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, ANNOUNCING FIND- INGS AND GRANTING A CONDITIONAL USE PERMIT AND PRELIMINARY DESIGN REVIEW TO ALLOW CONSTRUCTION OF 12 CONDOMINIUM UNITS ON A PARCEL APPROXIMATELY ONE AND ONE-HALF ACRES IN SIZE ON PROPERTY GENERALLY LOCATED ON THE EAST SIDE OF OCOTILLO, SOUTH OF TUMBLEWEED WITHIN THE R-3 (20,000(3), S.P. ZONE. CASE NO. CUP 16-77 and 104MF WHEREAS, pursuant to the provisions of the Palm Desert Zoning Ordinance, the Planning Commission did on January 3, 1978, hold a duly noticed public hearing to consider the application of RONALD STE- WART for approval of a Conditional Use Permit to allow construction of 12 condominium units on a parcel generally located on the east side of Ocotillo, south of Tumbleweed within the R-3 (20,000(3), S.P. (Multi- family residential, 20,000 sq. ft. minimum lot size, minimum 3,000 sq. ft. of lot area/unit, scenic preservation overlay) zone, more partic- ularly described as: Lots 10, 11, 12, Block F-3, Palm Desert Unit 3 WHEREAS, said applicant has complied with the requirements of the "City of Palm Desert Environmental Quality Procedure Resolution No. 77-7", in that the Director of Environmental Services has determined that the rpoject will not have a significant adverse impact on the environment on December 12, 1977 and the appeal period has expired, and; WHEREAS, at said public hearing, upon hearing and considering all testimony and argument, the Planning Commission did find the follow- ing facts and reasons to exist to justify the granting of approval of said Conditional Use Permit: 1. The location of the project is in accord with the objectives of the Zoning Ordinance and the purpose of the district in which the site is located. 2. The location of the proposed use and the conditions under which it would be operated or maintained will not be detri- mental to the public health, safety, or welfare, or be materially injurious to properties or improvements in the vicinity. 3. The proposed use will comply with each of the applicable provisions of the Zoning Ordinance. 4. The proposed use complies with the goals, objectives, and policies of the City's General Plan. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, as follows: 1. That the above recitations are true and correct and constitute the findings of the Commission in this case. 2. Approval of the Conditional Use Permit and Preliminary Design Review is granted to RONALD STEWART subject to the attached conditions. PASSED, APPROVED, and ADOPTED at a regular meeting of the City of Palm Desert Planning Commission held on the 3rd day of January, 1978, by the following vote, to wit: AYES: BERKEY, KELLY, KRYDER, SNYDER, READING NOES: NONE ABSENT: NONE ABSTAIN: NONE 4 GEORGE BERKEY, Chairman ATTEST PAUL A. WILLIAMS, Secretary PLANNING COMMISSION RESOLUTION NO. 320 Page Two CONDITIONS OF APPROVAL CASE NOS. CUP 16-77 & 104MF Standard Conditions: 1. The development of this project shall conform substantially to all plans submitted in behalf of this case (Exhibits A-D), and as revised according to the Design Review Board process and/or Planning Commission Action. Any minor changes require approval by the Director of Environmental Services. Any substantial change requires approval by the Planning Commission. 2. All requirements of any law, ordinance, or regulation of the State, City, and any other applicable government entity shall be complied with as part of the development process. 3. This approval is applicable, subject to the development of this project, commencing within one year from approval date and being promptly completed. 4. Prior to the issuance of a building permit for construction of any use contemplated by this approval, the applicant shall first obtain permits and/or clearance from the following agencies: County Department of Public Health Palm Desert Design Review Board Process Coachella Valley County Water District Regional Water Quality Control Board #7 5. Plans and specifications shall conform to the City of Palm Desert standard specifications, development procedures and design criteria. Any modifications, thereof, shall require approval of the City Engineer. Special And'Deign Review Conditions: 1. Curbs, gutters, and tie-in paving shall be installed on Ocotillo. 2. Any/all utility service and distribution lines on or abutting the subject property, shall be placed underground prior to occupancy clearance. 3. Final construction drawings including a final landscaping, grading, lighting, amenitites, trash storage, walkway layout, and irrigation plan shall be submitted to the Design Review Board. No final in- spection or occupancy permit shall be given by the Department of Environmental Services to this project until the aforementioned approved plans and construction shall have been completed. 4. Applicant shall furnish evidence of property owners's associations's approval of subject plans prior to submittal of final construction drawings to the Design Review Board. 5. A six foot masonry wall shall be installed on the rear property line. 6. Provide pedestrian connections from the units to the garages. PLANNING COMMISSION RESOLUTION NO. 320 CASE NOS. AGREEMENT I accept and agree, prior to use of this permit or approval, to com- ply with all the conditions set forth, and understand that the De- partment of Building and Safety will not issue a building permit or allow occupancy on the use permitted until this signed confirmation has been received by the Department of Environmental Services.
