HomeMy WebLinkAboutRes No 323PLANNING COMMISSION RESOLUTION NO. 323 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, RECOMMENDING APPROVAL TO THE CITY COUNCIL OF A PLANNING COM- MISSION INITIATED CHANGE OF ZONE FROM 'S' STUDY DISTRICT TO PR-6, S.P., PR-4, S.P., R-2(5), S.P., R-1 and P FOR A 225-ACRE PARCEL LOCATED NORTH AND EAST OF THE COLLEGE OF THE DESERT. CASE NO. C/Z 08-77 WHEREAS, the Planning Commission did on the 3rd day of January, 1978, hold a duly noticed Public Hearing to consider a Planning Commis- sion initiated Change of Zone from 'S' Study District to PR-6, S.P. (Planned Residential, maximum 6 du/gross acre, secneic preservation over- lay), PR-4, S.P. (Planned -residential, maximum 4 du/gross acre), R-2(5), S.P. (Single-family residential, 1 du/5,000 sq. ft. of lot area), R-1 (Single-family residential), P (Public/Institutional) or any other zone deemed appropriate for a 225-acre parcel located north and east of the College of the Desert, between the Whitewater River Storm Channel and 44th Avenue, and more particularly described as: APN 621-350-005 APN 621-350-006 APN 621-350-025 APN 621-360-001 APN 621-360-004 APN 621-360-005 WHEREAS, said application has complied with the requirements of the "City of Palm Desert Environmental Quality Procedure Resolution No. 77-7", in that the Director of Environmental Services has determined that this project is exempt from the requirements of CEQA as an on -going phase of the Palm Desert Zoning Map, approved in February, 1976, and, therefore, covered by the Environmental Impact Report prepared at that time; and, WHEREAS, at said Public Hearing, upon hearing and considering the testimony and arguments, if any, of all persons desiring to be heard, said Planning Commission did find the following facts and reasons to exist to recommend approval of the proposed Change of Zone from 'S' to PR-6, S.P., PR-4, S.P., R-2(5), S.P., R-1, and P: 1. The proposed Change of Zone does conform with the land use element of the College of the Desert Area Specific Plan adopted by the Planning Commission and being recom- mended to the City Council for adoption. NOW, THEREFORE, BE IT RESOLVED, by the Planning Commission of of Palm Desert, as follows: 1. That the above recitations are true and correct and consti- tute the findings of the Commission in this case. 2. That it does hereby recommend approval to the City Council of the proposed Change of Zone from 'S' Study District to PR-6, S.P., PR-4, S.P., R-2(5), S.P., R-1 and P as indicated on the attached Exhibit A.
