HomeMy WebLinkAboutRes No 326PLANNING COMMISSION RESOLUTION NO. 326 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, ANNOUNCING FIND- INGS AND GRANTING A CONDITIONAL USE PERMIT AND PRELIMINARY DESIGN REVIEW TO ALLOW CONSTRUCTION OF 30 CONDOMINIUM UNITS ON A PARCEL APPROXIMATELY 3.5 ACRES IN SIZE ON PROPERTY GENERALLY LOCATED WEST OF SUN 'LODGE, NORTH OF SHADOW MOUNTAIN WITHIN THE R-3(4) ZONE. CASE NO. CUP 17-77 & 102MF WHEREAS, pursuant to the provisions of the Palm Desert Zoning Ordinance, the Planning Commission did on January18, 1978, hold a duly noticed public hearing to consider the application of C. G. DUNHAM for approval of a Conditional Use Permit to allow construction of 30 condo- minium units on a parcel approximately 3.5 acres in size on property located west of Sun Lodge, north of Shadow Mountain and east of Lupine within the R-3(4) (Multi -family, residential, minimum 4,000 sq. ft. of lot area/unit) zone, more particularly described as: APN 627-252-002-2 WHEREAS, said applicant has complied with the requirements of the "City of Palm Desert Environmental Quality Procedure Resolution No. 77-7" in that the Director of Environmental Services has determined on December 12, 1977, that the project is exempt from the requirements of CEQA as a Negative Declaration was issued for a related case, Case No. CZ 06-77, and; WHEREAS, at said Public Hearing, upon hearing and considering all testimony and argument, the Planning Commission did find the follow- ing facts and reasons to exist to justify the granting of approval of said Conditional Use Permit: 1. The location of the project is in accord with the objec- tives of the Zoning Ordinance and the purpose of the district in which the site is located. 2. The location of the proposed use and the conditions under which it would be operated or maintained will not be detri- mental to the public health, safety, or welfare, or be materially injurious to properties or improvements in the vicinity. 3. The proposed use will comply with each of the applicable provisions of the Zoning Ordinance. 4. The proposed use complies with the goals, objectives, and policies of the City's General Plan. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, as follows: 1. That the above recitations are true and correct and constitute the findings of the Commission in this case. 2. Approval of the Conditional Use Permit and Preliminary Design Review is granted to C. G. DUNHAM subject to the attached conditions. PASSED, APPROVED, and ADOPTED at a regular meeting of the City of Palm Desert Planning Commission held on the 18th day of January, 1978, by the following vote, to wit: AYES: BERKEY, KELLY, KRYDER, READING, SNYDER NOES: NONE ABSENT: NONE ABSTAIN: NONE ATT PAUL A. WILLIAMS, Secretary PLANNING COMMISSION RESOLUTION NO. 326 CONDITIONS OF APPROVAL CASE NO. CUP 17-77 AND 102MF Standard Conditions 1. The development of this project shall conform substantially to all plans submitted in behalf of this case (Exhibit A), and as revised according to the Design Review Board process and/or Planning Commission Action. Any minor changes require approval by the Director of Environmental Services. Any substantial change requires approval by the Planning Commission. 2. All requirements of any law, ordinance, or regulation of the State, City, and any other applicable government entity shall be complied with as part of the development process. 3. This approval is applicable, subject to the development of this project, commencing within one year from approval date and being promptly completed. 4. Prior to the issuance of a building permit for construction of any use contemplated by this approval, the applicant shall first obtain permits and/or clearance from the following agencies: County Department of Public Health Palm Desert Design Review Board Process Coachella Valley County Water District Regional Water Quality Control Board #7 5. Plans and specifications shall conform to the City of Palm Desert standard specifications, development procedures and design criteria. Any modifications, thereof, shall require approval of the City Engineer. Design Review and Special Conditions 1. The site plan shall be modified in order to eliminate driveway openings on Lupine Lane and Sun Lodge Lane as indicated on the Revised Exhibit 'A' on file with the Department.of Environmental Services. Driveways shall be designed so that no vehicle shall back out into the public rights -of -way. 2. All curbs, gutters, sidewalks and tie-in paving should be installed on the development. 3. Right-of-way dedications shall be eight feet on Shadow Mountain and four feet on Sun Lodge. 4. Construction plans shall be submitted for approval to the City Fire Marshal prior to issuance of building permits. All conditions shall be made a part of construction and no certificate of occupancy shall be issued until completed. 5. Any/all utility service, and distribution lines on or abutting the subject property, shall be placed underground prior to occupancy clearance. Case No. CUP 17-77 6. Final construction drawings including a final landscaping, grading, lighting, amenities, trash storage, walkway layout, and irrigation plan shall be submitted to the Design Review Board. No final inNMO - spection or occupancy permit shall be given by the Department of Environmental Services to this project until the aforementioned approved plans and construction shall have been completed. 7. Elevations shall be simplified in order to appear more compatible with adjacent development. AGREEMENT I accept and agree, prior to use of this permit or approval, to comply with all the conditions set forth, and understand that the Department of Building and Safety will not issue a building permit or allow occupancy on the use permitted until this signed confirma- tion has been received by the Department of Environmental Services.
