HomeMy WebLinkAboutRes No 330PLANNING COMMISSION RESOLUTION NO. 330 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, SETTING FORTH ITS FINDINGS AND RECOMMENDING TO THE CITY COUNCIL, APPROVAL OF A TENTATIVE TRACT MAP TO CREATE 65 LOTS TO PROVIDE FOR A CONDOMINIUM HOTEL, 7 SINGLE- FAMILY RESIDENCES AND 57 CONDOMINIUM UNITS ON APPROX- IMATELY 17.8 ACRES GENERALLY LOCATED BETWEEN HIGHWAY 111 AND CANDLEWOOD STREET, WEST OF THE PALM DESERT- INDIAN WELLS CITY LIMIT LINE. CASE NO. TT 11883 WHEREAS, the Planning Commission of the City of Palm Desert, did receive a verified application from U. S. LIFE SAVINGS AND LOAN ASSOCIA- TION, requesting approval of a 65 lot subdivision on approximately 17.8 acres of land, located in the P.C.(4), S.P. and PR-6 zones, and situated between Highway 111 and Candlewood Street, west of the Palm Desert -In- dian Wells City Limit Line more particularly described as: APN 625-150-004 APN 625-150-005 APN 625-224-010 WHEREAS, said application has complied with the requirements of the "City of Palm Desert Environmental Quality Procedure Resolution No. 77-7", in that the Director of Environmental Services has determined on Jnauary 10, 1978, that the project will not have a significant ad- verse effect on the environment and the appeal period has expired; and, WHEREAS, the Planning Commission did take into consideration the Tentative Map as submitted, and the reports of the various reviewing agencies; and, WHEREAS, the Planning Commission did find that the subject Tenta- tive Map does substantially comply with Chapter 26 of the City of Palm Desert Municipal Code, and the State of California Subdivision Map Act, as amended; WHEREAS, the Planning Commission did find that the subject Tenta- tive Map does comply with the adopted General Plan, the Redevelopment Plan, and the Palm Desert Zoning Ordinance; and, WHEREAS, the Planning Commission did find that the site is physically suitable for the type of development proposed; and, WHEREAS, the Planning Commission did find that the site is physically suited for the proposed density of the development; and, WHEREAS, the Planning Commission did find that the design of the subdivision and the proposed improvements are not likely to cause sub- stantial environmental damage or serious health problems. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, as follows: 1. That the above recitations are true and correct and consti- tute the findings of the Commission in this case; 2. That it does hereby recommend that the applicant pay a fee in an amount determined under the Ordinance provisions in order to com- ply with Article 26.15 of the City's Subdivision Ordinance regarding the public facilities requirement; PLANNING COMMISSION RESOLUTION NO. 330 Page Two 3. That it does hereby recommend approval to the City Council of the City of Palm Desert of the above described Tentative Map No. 11883, subject to fulfillment of the attached conditions: PASSED, APPROVED, and ADOPTED at a regular meeting of the Palm Desert Planning Commission, held on this 31st day of January, 1978, by the following vote, to wit: AYES: BERKEY, KELLY, KRYDER, READING, SNYDER NOES: NONE ABSENT: NONE ABSTAIN: NONE GEORGE BERKEY, Chairm ATTEST: PAUL A. WILLIAMS, Secretary /ks PLANNING COMMISSION RESOLUTION NO. 330 Page Three CONDITIONS OF APPROVAL CASE NO. TT 11883 Standard Conditions: 1. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all the requirements, limitations, and restrictions of all municipal ordinances and State and Federal statutes now in force, or which hereafter may be in force. 2. Full public improvements including traffic safety lighting as required by Ordinance and the Director of Public Works, shall be installed in accordance with City standards. 3. Prior to submittal of the Final Map, the applicant shall provide the Department of Environmental Services with a list of proposed street names with at least three alternatives. The approval of the final street names shall be made by the Director of Environ- mental Services. 4. Access rights on the Frontage Road and the proposed street connec- tion between Driftwood Drive and Shadow Hills Road shall be offered to the City as a dedication on the Final Map. 5. The C.C.&R's for this development shall be submitted to the City Engineer for review and approval prior to the issuance of any building permits. Prior to recordation of the final subdivision map, the applicant shall submit to the Director of Public Works: a. The document to convey title. b. Covenants and restrictions to be recorded. c. Management and maintenance agreement to be entered into with the owners of the units of the project. 6. Improvement plans for water and sewer system shall meet the re- quirements of the respective service districts. 7. Area shall be annexed to appropriate Improvement Districts having jurisdiction over the subject area. 8. All dedicated land and/or easements required by this approval shall be granted to the City of Palm Desert, without cost to the City and free of all liens and encumbrances. 9. All on -site utilities, including cable TV, shall be placed under- ground and shall be completely concealed from view except certain appurtenances as may be approved by the Director of Environmental Services. 10. Complete plans and specifications shall be submitted as required by Ordinance to the Director of Public Works for checking and ap- proval before construction of any improvements is commenced. The subdivider shall submit "as -built" plans prior to acceptance of the subdivision improvements by the City. 11. In order to maintain reasonable fire protection during the construc- tion period, the subdivider shall maintain passable vehicular access to all buildings. An adequate number of fire hydrants with required fire flows shall be installed as recommended by the Fire Marshal. 12. All requirements of the City Fire Marshal shall be met as a part of the development of this tract per attached memorandum. 13. Drainage shall be subject to approval of the Director of Public Works. Applicant shall provide engineered data as requested. PLANNING COMMISSION RESOLUTION NO. 330 Page Four 14. All requirements of the Planning Commission action on the De- velopment Plan DP 11-77 shall be met as a part of the develop- ment of this tract. 15. The total number of lots shall be limited to 65. 16. The applicant shall have twelve (12) months from the date of the approval or conditional approval of the tentative map for filing of the final map unless an extension of time of up to eighteen (18) months is granted by a Resolution of the City Council. Special Conditions: 1. All improvements, curbs, gutters, sidewalks and tie-in paving, shall be installed on Candlewood Street in front of Lots 2 through 8. Curbs, gutters and pavement shall be installed on the access easement (to be dedicated to the City per Special Condition No. 5) from Shadow Hills Road to Driftwood Drive, and on the access ease- ment in the interior of the development on one side only adjacent to development. 2. Traffic safety lighting shall be installed as requested by the Director of Public Works. 3. Applicant agrees to contribute $15,000 towards city-wide drainage. This money shall be deposited into the Palm Desert Drainage Fund. 4. The necessary right-of-way shall be dedicated to make Candlewood Street a 60 foot street. 5. The proposed access easement shown connecting Driftwood Drive and Shadow Hills Road shall be dedicated to the City of Palm Desert. 6. In compliance with Article 26.15 of the City's Subdivision Ordi- nance, the public facilities requirement shall be met by the pay- ing of a fee in an amount determined under the Ordinance provi- sions. 7. The frontage road shall be extended along the full frontage of the property and shall be improved according to City standards. Such improvements shall include curb, gutters, sidewalks, and landscap- ing. PLANNING COMMISSION RESOLUTION NO. 330 January 16, 1978 Paul A. Palm Desert, Ca. 92260 Reference: Tentative Tract No. 11883 Gentlemen: Page Five Provide the following fire protection: 1. Install a water system capable of delivering 290n GPM fire flow from any fire hydrant for a two hour duration in addition to domestic supply. The computation shall be based upon a minimum of 20 psi residual operating pressure in in the supply main from which the flow is measured at the time of measurement. 2. Install Riverside County super fire hydrants located at each street intersection (a) but not greater than 500 feet apart in any direction. A. Exterior surface of hydrant barrels and heads shall be painted chrome yellow, and the tops and nozzle caps shall be painted green. B. Curbs shall be painted red 15 feet in either direction from each hydrant. 3. Prior to recordation of the final map, the developer shall furnish the original and three (3) copies of the water system plan to the Fire Marshal for review. 4. The water system plan shall be signed by a registered civil engineer and approved by the water company, with the following certification: "I certify that the design of the water system in Tract No. 11883 is in accordance with the requirements prescribed by the Fire Marshal."
