HomeMy WebLinkAboutRes No 331PLANNING COMMISSION RESOLUTION NO. 331 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, SETTING FORTH ITS FIND- INGS AND RECOMMENDING TO THE CITY COUNCIL, APPROVAL OF A TENTATIVE TRACT MAP TO DIVIDE A 6.16 ACRE PARCEL INTO TWO LOTS, LOT 1 AND LOT 2, LOT 1 WILL BE FURTHER DIVIDED AS A STATUATORY CONDOMINIUM TO PROVIDE FOR 30 CONDOMINIUM UNITS AND COMMON OPEN SPACE AND COMMON RECREATION FACILITIES, THE ENTIRE SITE BEING LOCATED SOUTH OF ELPASEO, NORTH OF SHADOW MOUNTAIN, BETWEEN LUPINE LANE AND SUN LODGE LANE. CASE NO. TT 11881 WHEREAS, the Planning Commission of the City of Palm Desert, California, did receive a verified application from PHILIP ABRAMS CONSULTING ENGINEERS, requesting approval of a Tentative Tract Map to divide a 6.16 acre parcel into two parcels, Lot 1 which is located within the R-3(4) (Multi -family residential, minimum 4,000 sq. ft. lot area/d.u.) zone and Lot 2 which is located within the C-1, S.P. (General Commercial, Scenic Preservation Overlay) zone and the R-3(4) (Multi- family residential, minimum 4,000 sq. ft. lot area/d.u.) zone, and to further divide Lot 1 as a statuatory condominium to provide for 30 condominium units and common open space and common recreation facili- ties, the entire site being located south of El Paseo, north of Sha- dow Mountain, between Lupine Lane and Sun Lodge Lane, more particularly described as: APN 627-25-252 WHEREAS, said application has complied with the requirements of the "City of Palm Desert Environmental Quality Procedure Resolution No. 77-7", in that the Director of Environmental Services has determined on January 10, 1978 that the proposed project will not have a signifi- cant adverse effect on the environment and the appeal period has expired; and, WHEREAS, the Planning Commission did take into consideration the Tentative Map as submitted, and the reports of the various reviewing agencies; and, WHEREAS, the Planning Commission did find that the subject Tenta- tive Map does substantially comply with Chapter 26 of the City of Palm Desert Municipal Code, and the State of California Subdivision Map Act, as amended; WHEREAS, the Planning Commission did find that the subject Tenta- tive Map does comply with the adopted General Plan, the Redevelopment Plan, and the Palm Desert Zoning Ordinance; and, WHEREAS, the Planning Commission did find that the site is physically suitable for the type of development proposed; and, WHEREAS, the Planning Commission did find that the site is physically suited for the proposed density of the development; and, WHEREAS, the Planning Commission did find that the design of the subdivision and the proposed improvements are not likely to cause sub- stantial environmental damage or serious health problems. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert as follows: 1. That the above recitations are true and correct and constitute the findings of the Commission in this case; PLANNING COMMISSION RESOLUTION NO. 331 PAGE TWO 2. That it does hereby recommend that the applicant pay a fee in an amount determined under the Ordinance provisions in order to comply with Article 26.15 of the City's Subdivision Ordinance regarding the public facilities requirements; 3. That it does hereby recommend approval to the City Council of the City of Palm Desert of the above described Tentative Map No. 11881, subject to fulfillment of the attached conditions: PASSED, APPROVED, and ADOPTED at a regular meeting of the Palm Desert Planning Commission held on this 31st day of January, 1978, by the following vote, to wit: AYES: BERKEY, KELLY, KRYDER, READING, SNYDER NOES: NONE ABSENT: NONE ABSTAIN: NONE GEORGE BERKEY, Chair an ATTEST: PAUL A. WILLIAMS, Secretary /ks PLANNING COMMISSION RESOLUTION NO. 331 Page Three CONDITIONS OF APPROVAL CASE NO. TT 11881 Standard Conditions: 1. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all the requirements, limitations, and restrictions of all municipal ordinances and State and Federal statutes now in force, or which hereafter may be in force. 2. Full public improvements including traffic safety lighting as re- quired by Ordinance and the Director of Public Works, shall be in- stalled in accordance with City standards. 3. Access rights on El Paseo, Sun Lodge, Shadow Mountain and Lupine shall be offered to the City as a dedication on the Final Map. 4. The C.C.&R's for this development shall be submitted to the Director of Public Works for review and approval prior to the issuance of any building permits. Prior to recordation of the final subdivi- sion map, the applicant shall submit to the Director of Public Works: a. b. c. The document to convey title. Covenants and restrictions to be recorded. Management and maintenance agreement to be eneted into with the owners of the units of the project. 5. Improvement plans for water and sewer system shall meet the require- ments of the respective service districts. 6. Area shall be annexed to appropriate Improvement Districts having jurisdiction over the subject area. 7. All dedicated land and/or easements required by this approval shall be granted to the City of Palm Desert, without cost to the City and free of all liens and encumbrances. 8. All on -site utilities, including cable TV, shall be placed under- ground and shall be completely concealed from view except certain appurtenances as amy be approved by the Director of Environmental Services. 9. Complete plans and specifications shall be submitted as required by Ordinance to the Director of Public Works for checking and approval before construction of any improvements is commenced. The subdivider shall submit "as -built" plans prior to acceptance of the subdivision improvements by the City. 10. In order to maintain reasonable fire protection during the construc- tion period, the subdivider shall maintain passable vehicular access to all buildings. An adequate number of fire hydrants with required fire flows shall be installed as recommended by the Fire Marshal. 11. All requirements of the City Fire Marshal shall be met as a part of the development of this tract per attached memorandum. 12. Drainage shall be subject to approval of the Director Applicant shall provide engineered data as requested. 13. The applicant shall have twelve (12) months from the date of the approval or conditional approval of the tentative map for filing of the final map unless an extension of time of up to eighteen (18) months is granted by a Resolution of the City Council. Special Conditions: 1. The applicant shall construct curbs, gutters, sidewalks and tie-in paving per the City of Palm Desert standards. 2. Right-of-way shall be deeded to enable 60 foot streets to be con- structed. 3. Driveway accesses off of Sun Lodge, Shadow Mountain and Lupine Lane shall be at a minimum and as approved by the Director of Pub- lic Works. 4. Drainage fees shall be paid as required by the City of Palm Desert ordinances. 5. In complaince with Article 26.15 of the City's Subdivision Ordinance, the public facilities requirement shall be met by the paying of a fee in an amount determined under the Ordinance provisions. 6. Applicant shall contribute $5,000 to the Traffic Signal Fund towards future signalization of San Pablo and El Paseo. PLANNING COMMISSION RESOLUTION NO. 331 January 16, 1978 Paul A. Palm Desert, Ca. 92260 PAGE FIVE Reference: Tentative Tract No. 11881 Gentlemen: Provide the following fire protection: 1. Install a water system capable of delivering 2500 GPM fire flow from any fire hydrant for a two hour duration in addition to domestic supply. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of measureme�rt. 2. Install Riverside County super fire hydrants located at each street intersection (a) but not greater than 500 feet apart in any direction. A. Exterior surface of hydrant barrels and heads shall be painted chrome yellow, and the tops and nozzle caps shall be painted green. B. Curbs shall be painted red 15 feet in either direction from each hydrant. 3 g. Prior to recordation of the final map, the developer shall furnish the original and three (3) copies of the water system plan to the Fire Marshal for review. 4. The water system plan shall be signed by a registered civil engineer and approved by the water company, with the following certification: "I certify that the design of the water system in Tract No. 11881 is in accordance with the requirements prescribed by the Fire Marshal."
