HomeMy WebLinkAboutRes No 332PLANNING COMMISSION RESOLUTION NO. 332 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, ANNOUNCING FINDINGS AND APPROVING THE DESIGN REVIEW BOARD ACTIONS OF JANUARY 24, 1978. WHEREAS, the Planning Commission of the City of Palm Desert, California, did review the Design Review Board action of January 24, 1978, approving: Case No. 71C - Preliminary site, floor and elevations for a commercial project for LAUREL DEVELOPMENT; Case No. 66MF - Preliminary site, floor and elevations for a 6 unit apartment for AMERICAN WEST DEVELOPMENT: WHEREAS, at this time, upon considering and receiving all testi- mony and arguments, if any, of all interested persons desiring to be heard, said Commission did find sufficient facts and reasons to exist to approve the Design Review Board actions of January 24, 1978. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and consti- tute the findings of the Commission in this case. 2. That it does hereby approve the Design Review Board actions of January 24, 1978. PASSED, APPROVED, and ADOPTED at a regular meeting of the Palm Desert Planning Commission, held this 31st day of January, 1978, by the following vote, to wit: AYES: BERKEY, KELLY, KRYDER, READING, SNYDER NOES: NONE ABSENT: NONE ABSTAIN: NONE ATTEST: PAULA. WILLIAMS, /ks Secretary GE•' E BERKEY, Chairman PLANNING COMMISSION RESOLUTION NO. 332 SPECIAL CONDITIONS CASE NO. 71C 1. Construction plans shall be submitted for approval to the City Fire Marshal prior to issuance of building permits. All con- ditions shall be made a part of construction and no certificate of occupancy shall be issued until completed. 2. Any/all utility service and distribution lines on or abutting the subject property, shall be placed underground prior to oc- cupancy clearance pursuant to Section 25.56.110 of the Municipal Code. 3. Final construction drawings including a final landscaping, grading, lighting, amenities, trash storage, walkway layout, and irrigation plan shall be submitted to the Design Review Board. No final inspection or occupancy permit shall be given by the Department of Environmental Services to this project until the aforementioned approved plans and construction shall have been completed. 4. The applicant shall agree to join any assessment district formed that includes the subject property within its boundaries. 5. The applicant shall grant to the City of Palm Desert easement rights over the parking lot area of the project site. 6. The applicant shall consider a ground monument sign as an alter- native to the proposed fascia -mounted sign. 7. Applicant shall submit revised front elevations and revised side and rear elevations if changes in the front elevations necessitate such modifications. One suggested alternative is to relocate the mansard roof 25 ft. from its present location. These revised elevations shall be submitted to the Design Review Board for approval prior to submittal of final construction drawings for consideration by the Board. AGREEMENT I accept and agree, prior to use of this permit or approval, to comply with all the conditions set forth, and understand that the Department of Building and Safety will not issue a building permit or allow oc- cupancy on the use permitted until this signed confirmation has been received by the Department of Environmental Services. (Date) (Applicant's Signature) PLANNING COMMISSION RESOLUTION NO. 332 January 24, 1978 CONDITIONS OF APPROVAL CASE NO. 66MF 1. The development of this project shall conform substantially to all develop- ment plans submitted in behalf of this case (Exhibits A-F), and as revised according to Planning Commission action. Any minor changes require approval by the Director of Environmental Services. Any substantial changes requires approval by the Planning Commission. 2. All requirements of any law, ordinance, or regulation of the State, City, and any other applicable government entity shall be complied with as part of the development process. This approval is applicable, subject to the development of this project, commencing within one year from approval date and being promptly completed. 4. Curb, gutter, curb cuts, and tie-in paving shall be provided on Candlewood Street and Panorama Drive in conformance with City Standards and the re- quirements of the City Engineer. 5. A masonry trash enclosure shall be provided. Enclosure design shall conform to all requirements of Ordinance 88. 6. The floor of the carport shall be concrete. 7. Site plan shall be revised in order to provide for minimum setback require- ments. The setback on Panorama shall be twelve (12) feet and the setback on Candlewood shall be fifteen (15) feet. 8. Sewer hookup shall be made as part of construction. 9. A complete and detailed landscape plan, irrigation plan, and lighting-signage plan shall be submitted for Design Review Board process approval prior to sub- mittal for building plan check. 10. All service, utility service lines shall be placed underground. 11. The Design Review Board shall be presented with a copy of the rear easement in order to determine adequacy of parking to be provided with regard to per- manent access and egress. 12. A four (4) foot wall with self -latching gates shall be constructed around the pool. 13. The fence on Panorama shall be masonry or stucco and shall be constructed in a step down fashion toward the alley to preserve line of site.
