HomeMy WebLinkAboutRes No 335PLANNING COMMISSION RESOLUTION NO. 335 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, ANNOUNCING FIND- INGS AND APPROVING A DEVELOPMENT PLAN AND PRELIMI- NARY DESIGN REVIEW TO ALLOW THE CONSTRUCTION OF 5 COMMERCIAL STRUCTURES HAVING A TOTAL OF 32,400 SQ. FT. ON APPROXIMATELY 3.5 ACRES AT THE SOUTHWEST CORNER OF HIGHWAY 111 AND HIGHWAY 74. CASE NO. DP 02-78 and 72C WHEREAS, the Planning Commission of the City of Palm Desert did receive a verified application from ROBERT H. RICCIARDI requesting approval of a Development Plan and preliminary Design Review on ap- proximately 3.5 acres located in the P.C.(3), S.P. zone, and situated at the southwest corner of Highway 111 and Highway 74 to allow for the development of 5 commercial structures having a total of 32,400 sq. ft.; the property being more particularly described as: APN 629-060-037 APN 629-060-038 WHEREAS, said applicant has complied with the requirements of the "City of Palm Desert Environmental Quality Procedure Resolution No. 77-7", in that the Director of Environmental Services has deter- mined that the project is exempt from the requirements of CEQA due to its location within the Redevelopment Area; and, WHEREAS, at said Public Hearing, upon hearing and considering all testimony and argument, the Planning Commission did find the fol- lowing facts and reasons to exist to justify the granting of approval of said Development Plan: 1. Proposed development as amended by the conditions of ap- proval will conform to the intent and purpose of the PC Zone District. 2. Proposed development as amended by the conditions of ap- proval will conform to the adopted General Plan. 3. Proposed development as amended by the conditions of ap- proval will conform to the Redevelopment Plan; and, NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert as follows: 1. That the above recitations are true and correct and consti- tute the findings of the Commission in this case. 2. Approval of the Development Plan and Preliminary Design Review is granted to ROBERT H. RICCIARDI for reasons subject to the attached conditions. PASSED, APPROVED, and ADOPTED at a regular meeting of the City of Palm Desert Planning Commission held on this 28th day of February, 1978, by the following vote, to wit: AYES: BERKEY, KELLY, READING, SNYDER NOES: NONE ABSENT: KRYDER ABSTAIN: NONE GEORGE BERKEY, Chairman ATTE.ST : PAUL A. WILLIAMS, Secretary /ks PLANNING COMMISSION RESOLUTION NO. 335 Page Two CONDITIONS OF APPROVAL CASE NOS. DP 02-78 & 72C Standard Conditions: 1. The development of the property shall conform substantially with that as shown on plot plan marked Exhibit 'A-l' on file with the Department of Environmental Services, Case No. DP 02-78, unless otherwise amended by the following conditions. 2. Prior to the issuance of a building permit for construction of any use contemplated by this approval, the applicant shall first obtain permits and/or clearance from the following public agencies: County Department of Public Health Dir. of Public Works - City of Palm Desert Palm Desert Design Review Board Process City Fire Marshal - City of Palm Desert Coachella Valley County Water District Regional Water Quality Control Board #7 Evidence of said permit or clearance from the above agencies shall be presented to the Department of Building and Safety at the time of issuance of a building permit for the use contemplated herewith. 3. A landscaping, grading, lighting, amenities, trash storage, walkway layout, and irrigation plan shall be submitted through the Design Review Process. The building permit when issued shall include the grading, lighting, amenities, trash storage, walkways, and irriga- tion systems. No final inspection shall be given by the Depart- ment of Environmental Services to this project until the afore- mentioned approved plans and construction shall have been completed. 4. Construction of the development permitted hereby shall be done as a single project. 5. The sewerage disposal system shall be submitted to and approved by the Coachella Valley County Water District prior to issuance of a building permit. 6. Construction shall commence within one (1) year after final approval, otherwise said approval shall become null and void and of no effect whatsoever. 7. Prior to the issuance of any permits, the applicant shall agree in writing to any conditions of approval. 8. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all the requirements, limitations, and restrictions of all municipal ordinances and State and Federal Statutes now in force, or which hereafter may be in force. 9. The fire protection requirements as specified in the Fire Marshal's memorandum, attached hereto, shall apply. 10. All new electrical distribution lines, telephone, cable antenna television, and similar service wires or cables, which are adja- cent to and provide service to the property being developed shall be installed underground as a part of development from the nearest existing pole not on the property being developed. 11. Any possible line -of -sight problems shall be resolved through the Design Review Board process during their preliminary and final review. PLANNING COMMISSION RESOLUTION NO. 335 Page Three Special Conditions: 1. Applicant shall develop and provide a preliminary sign program for total project. 2. Landscaping shall be upgraded. The number, type, size and loca- tion of trees are not approved. Such approval shall be granted through the Design Review Board process. 3. Submitted elevations .are not approved and shall be resubmitted through the Design Review process. 4. Landscaping shall be increased around all structures, particularly Buildings A and B. 5. Any and all existing overhead utility distribution lines shall be undergrounded pursuant to the provisions in the Municipal Code. 6. Applicant shall pay fees into the Palm Desert "Planned Local Drainage Facilities Fund" in an amount to be determined by the provisions of Ordinance No. 175. 7. Applicant shall make a cash contribution in the amount of $12,500 towards the future signalization of El Paseo and Highway 74. 8. Curbs, gutters and tie-in paving shall be installed on the perimeter of this development. 9. Sidewalks shall be installed on El Paseo and Highways 111 and 74. 10. No ingress or egress shall be given to this parcel from Highway 74 or Highway 111. 11. Traffic safety lighting shall be installed as required by the Director of Public Works. 12. Right-of-ways shall be dedicated as required by Caltrans. 13. The median modification on El Paseo shall be the responsibility of the applicant and shall be subject to the approval of the Director of Public Works. 14. The drainage of storm waters shall be handled in a manner acceptabl to CalTrans and the Director of Public Works. AGREEMENT I accept and agree, prior to use of this permit or approval, to comply with all the conditions set forth, and understand the Department of Building and Safety will not issue a building permit or allow occupancy on the use permitted until this signed confirmation has been received by the Department of Environmental Serviceds.
