HomeMy WebLinkAboutRes No 338PLANNING COMMISSION RESOLUTION NO. 328 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, SETTING FORTH ITS FINDINGS AND APPROVING A TENTATIVE PARCEL MAP DIVIDING INTO 2 LOTS A 1.10 ACRE PARCEL LOCATED ON THE SOUTH SIDE OF HIGHWAY 111, WEST OF DEEP CANYON. CASE NO. PM 11311 WHEREAS, the Planning Commission of the City of Palm Desert, California, did receive a verified application from COMPTON, RUSSIE, and HARTLEY, requesting approval of a lot split of 1.10 acres of land, located in the C-1, S.P. Zone District and situated on the south side of Highway 111 and west of Deep Canyon, more particularly described as: APN 625-121-005 WHEREAS, said application has complied with the requirements of the "City of Palm Desert Environmental Quality Procedure Resolution No. 77-7", in that an Environmental Assessment form was submitted and a Negative Declaration was made by the Director of Environmental Services, and the appeal period has expired; and, WHEREAS, the Planning Commission did take into consideration the Tentative Parcel Map as submitted, and the reports of the various re- viewing agencies; and, WHEREAS, The Planning Commission did find that the subject Tenta- tive Parcel Map does substantially comply with the City of Palm Desert Municipal Code and the State of California Subdivision Map Act, as amended; and, WHEREAS, the Planning Commission did find that the subject Tenta- tive Parcel Map does comply with the adopted General Plan. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and consti- tute the findings of the Commission in this case; 2. That the Commission does hereby require compliance with Ordi- nance No. 175 (Drainage Fees) by paying a fee in an amount to be deter- mined by Sec. 26.49.050 of said Ordinance. 3. That it does hereby approve the above described Tentative Parcel Map No. PM 11311, subject to fulfillment of the attached conditions. PASSED, APPROVED, and ADOPTED by the Palm Desert Planning Commis- sion on this 28th day of February, 1978, by the following vote, to wit: AYES: BERKEY, KELLY, READING, SNYDER NOES: NONE ABSENT: KRYDER ABSTAIN: NONE ATTEST: PAUL A. WILLIAMS, Secretary /ks PLANNING COMMISSION RESOLUTION NO. 338 Page Two CONDITIONS OF APPROVAL CASE NO. PM 11311 1. The Tentative Parcel Map is granted for the land as described in the application and any attachments thereto, and as shown on the plot plan, labeled Exhibit 'A', and the requirements herein. 2. All requirements of any law, ordinance, or regulation of the State, City, and any other applicable government entity shall be complied with. 3. Applicant shall comply with Ordinance No. 175 pertaining to City- wide Drainage needs by paying a fee in the amount determined by Sec. 26.49.050. 4. Applicant shall install sidewalks along the full frontage of the property on the frontage road. 5. Applicant shall underground any and all existing overhead utility distribution lines pursuant to the provisions of the Palm Desert Municipal Code. AGREEMENT I accept and agree, prior to use of this permit or approval, to comply with all the conditions set forth, and understand the Department of Building and Safety will not issue a building permit or allow occupancy on the use permitted until this signed confirmation has been received by the Department of Environmental Services.
