HomeMy WebLinkAboutRes No 343PLANNING COMMISSION RESOLUTION NO. 343 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, ANNOUNCING FINDINGS AND APPROVING THE DESIGN REVIEW BOARD ACTIONS OF MARCH 8, 1978. WHEREAS, the Planning Commission of the City of Palm Desert, California, did review the Design Review Board actions of March 8, 1978, approving: Case No. 99MF - Request for approval of preliminary site, floor and elevations for the units, golf & tennis clubhouses, gate- house and sales office, and preliminary landscaping for a condominium project for SUNRISE CORPORATION; Case No. 95MF - Request for approval of preliminary site, floor and elevation plans for a 5 unit apartment complex for WILLIAM LOADVINE; Case No. 76MF - Request for approval of entrance signs for the Mountainback and Sommerset condominium projects for BIDDLE DEVELOP- MENT CO.; Case No. 51C - Request for approval of a sign program for a commercial complex for HMS GENERAL CORP. WHEREAS, at this time, upon considering and receiving all testimony and arguments, if any, of all interested persons desiring to be heard, said Commission did find sufficient facts and reasons to exist to approve the Design Review Board actions of March 8, 1978. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert as follows: 1. That the above recitations are true and correct and con- stitute the findings of the Commission in this case; 2. That it does hereby approve the actions of the Design Review Board at their meeting of March 8, 1978. PASSED, APPROVED, and ADOPTED at a regular meeting of the Palm Desert Planning Commission held on this 15th day of March, 1978, by the following vote, to wit: AYES:BERKEY, KELLY, KRYDER, SNYDER NOES: NONE ABSENT: READING ABSTAIN: NONE T: PAUL A. WILLIAMS, Secretary /ks SPECIAL CONDITIONS FOR CASE NO. 99MF 1. Final construction drawings including a final landscaping, grading, lighting, trash storage, walkway layout, and irrigation plan in addition to a proposed sign program and tennis court lighting proposal or any other ammenities proposed shall be submitted to the Design Review Board. The final landscaping plan shall include information with regard to the relocation of existing trees and blowsand control measures proposed. No final inspection or occu- pancy permit shall be given by the Dept. of Environmental Services to this project until the aforementioned approved' plans and construction shall have been completed. 2. Site plan shall reflect a variation in setbacks. 3. Proposed elevation shall be submitted with color material and sample boards prior to submittal of final construction drawings to the Design Review Board. 4. A preliminary landscaping plan shall be submitted prior to submittal of final construction drawings to the Design Review Board. 5. Tennis clubhouse elevation on the east side of the turret shall be modified by changing the square windows to arch windows. AGREEMENT I accept and agree, prior to use of this permit or approval, to comply with all the conditions set forth, and understand that the Department of Building and Safety will not issue a building permit or allow oc- cupancy on the use permitted until this signed confirmation has been received by the Department of Environmental Services. (Date) (Applicant's Signature) SPECIAL CONDITIONS CASE NO. 95 MF 1. Final construction drawings including a final landscaping, grading, and irrigation plan shall be submitted to the Design Review Board. No final inspection or occupancy permit shall be given by the Department of Environmental Services to this project until the aforementioned approved plans and construction shall have been approved. 2. Construction plans shall be submitted for approval to the City Fire Marshal prior to issuance of building permits. All conditions shall be made a part of construction and no certificate of occupancy shall be issued until completed. 3. Parking layout shall be revised in order to improve maneuverability in and out of southerly two parking spaces. 4. Landscaping shall be provided along the west perimeter of the project. 5. Applicant shall provide a minimum of 10 feet between carports and structures. 6. Applicant shall install fencing along the west property line to be approved by the Design Review Board. 7. Floor plan of building on Santa Rosa shall be reversed. 8. Access shall be provided from living rooms to patio area in all build- ings. 9. Roof material shall be crushed rock, shake, or tile in earth tones. 10. A 6 foot high wood fence shall be constructed at the rear and on the sides of the complex. 11. A garden wall shall be provided to enclose the patio area off of the front building. 12. The landscaping plan shall be revised as follows: Ficus shall be used in front of walls; azaleas shall be removed and replaced with raphiolepis; gazanias shall be submitted for creeping fig as ground cover; landscaping between the driveway and the fencing shall include the use of pyracanthia or tecoma capensia. AGREEMENT I accept and agree, prior to use of this permit or approval, to comply with all the conditions set forth, and understand that the Department of Building and Safety will not issue a building permit or allow oc- cupancy on the use permitted until this signed confirmation has been received by the Department of Environmental Services. (Date) (Applicant's Signature) CONDITIONS OF APPROVAL CASE NO. 76MF 1. The development of this project shall conform substantially to all requirements of TT 9377 and DP 03-77 and to all development plans submitted in behalf of this case (Exhibits A-G), and as revised according to the Design Review Board process. Any minor changes require approval by the Director of Environmental Services. Any substantial change requires approval by the Planning Commission. 2. All requirements of any law, ordinance, or regulation of the State, City, and any other applicable government entity shall be complied with as part of the development process. 3. This approval is applicable, subject to the development of this project, commencing within one year from approval date and being promptly completed. 4. All service and distribution lines for utilities shall be placed underground. 5. No roof top air conditioning equipment shall be permitted. 6. Elevations are approved as shown. 7. The applicant shall explore the feasibility of using solar energy to heat all swimming pools. 8. Exterior lighting plans and sign program shall be submitted for Design Review Board process approval prior to the submittal of plans for build- ing permits. All requirements of the final approval shall be made as a part of construction. 9. Construction plans shall be submitted for approval to the City Fire Marshall prior to issuance of building permits. All conditions shall be made a part of construction and no certificate of occupancy shall be issued until completed. 10. All units located within 150 feet of the property line along Highway 74 shall be limited to single story in height. 11. Final landscape drawings are not approved at this time. Said plans shall be subject to approval of the Design Review Board prior to occupancy. AGREEMENT I accept and agree, prior to use of this permit or approval, to comply with all the conditions set forth, and understand that the Department of Building and Safety will not issue a building permit or allow occupancy on the use permitted until this signed confirmation has been received by the Department of Environmental Services. (Date) (Applicant's Signature) CONDITIONS OF APPROVAL CASE N(L 51C 1. The development of this project shall conform substantially to all develop- ment plans submitted in behalf of this case (Exhibits C & D), and as revised according to the Design Review Board process. Any minor changes require ap- proval by the Director of Environmental Services. Any substantial change re- quires approval by the Planning Commission. 2. All requirements of any law, ordinance, or regulation of the State, City, and any other applicable government entity shall be complied with as part of the development process. 3. This approval is applicable, subject to the development of this project, com- mencing within one year from approval date and being promptly completed. 4. Any roof mounted, exhaust, or air conditioning equipment shall be fully con- cealed from view from any public rights -of -way and adjoining properties by architecturally integrated means as shown. 5. All utility service and distribution lines shall be placed underground. 6. Curb, gutter, sidewalk or approved pathways, curb cuts, and tie-in paving shall be provided in conformance with City Standards for the following: a) The applicant shall install curb, gutter, and sidewalk along the full frontage of El Paseo, Lantana, and Larrea. b) An opening in the median strip on El Paseo opposite the northwest driveway. 7. Final landscaping (with irrigation system) plans indicating plant sizes and heights shall be provided to the Design Review Board for approval prior to is- suance of a building permit. 8. Lighting of parking areas and premises shall be provided as approved by the Director of Environmental Services. 9. Signage shall be provided in accordance with signage plan to be submitted to the Design Review Board and the Planning Commission for final approval. 10. Traffic control provisions shall be provided as required by the Traffic Engineer. 11. Overhangs shall be provided for all windows on the west elevation. 12. Construction plans shall be submitted for approval to the City Fire Marshall prior to issuance of building permits. All conditions shall be made a part of construction and no certificate of occupancy shall be issued until completed. 13. A detailed grading plan shall be submitted to the City Engineer for approval. 14. The applicant shall agree to join any assessment district formed that includes the subject property within its boundaries. 15. The applicant shall grant to the City of Palm Desert, easement rights over the parking lot area of the project site. 16. The landscape plan shall provide for a minimum of 20" box trees throughout the entire project. 17. All parking spaces shall conform to minimum City requirements. No parking space shall be within six (6) feet of any street property line. 18. A sidewalk six (6) feet in width in addition to a landscaped berm a minimum of 3 feet in height shall be installed along Larrea Street.
