HomeMy WebLinkAboutRes No 344PLANNING COMMISSION RESOLUTION NO. 344 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, SETTING FORTH ITS FINDINGS AND RECOMMENDING TO THE CITY COUNCIL APPROVAL OF A TENTATIVE MAP TO CREATE 71 SINGLE- FAMILY RESIDENTIAL LOTS AT IRONWOOD COUNTRY CLUB. CASE NO. TT 5553 WHEREAS, the Planning Commission of the City of Palm Desert, California, did receive a verified application from SILVER SPUR ASSOCIATES requesting approval of a Tentative Tract Map to create 71 single-family residential lots from a parcel approximately 27.5 acres in size located within the PR-7 (Planned Residential, max. 7 du/acre) zone at Ironwood Country Club, and more particularly described as: APN 631-190-012 APN 631-240-006 APN 631-250-011 APN 631-260-011 WHEREAS, said application has complied with the requirements of the "City of Palm Desert Environmental Quality Procedure Resolution No. 77-7", in that the Director of Environmental Services has deter- mined that this project is exempt from further environmental documenta- tion as an EIR for the entire project entitled "Silver Spur" was sub- mitted in June, 1972 and the appeal period has expired; and, WHEREAS, the Planning Commission did take into consideration the Tentative Map as submitted, and the reports of the various reviewing agencies; and, WHEREAS, the Planning Commission did find that the subject Tenta- tive Map does substantially comply with Chapter 26 of the City of Palm Desert Municipal Code, and the State of California Subdivision Map Act, as amended; and, WHEREAS, the Planning Commission did find that the subject Tenta- tive Map does comply with the adopted General Plan and the Palm Desert Zoning Ordinance; and, WHEREAS, the Planning Commission did find that the site is physically suitable for the type of development proposed; and, WHEREAS, the Planning Commission did find that the site is physically suited for the proposed density of the development; and, WHEREAS, the Planning Commission did find that the design of the subdivision and the proposed improvements are not likely to cause sub- stantial environmental damage or serious health problems. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, as follows: 1. That the above recitations are true and correct and consti- tute the findings of the Commission in this case; 2. That it does hereby recommend that the applicant dedicate land pursuant to the agreement between the applicant and the City Council in order to comply with Article 26.15 of the City's Subdivision Ordinance regarding the public facilities requirement; 3. That it does hereby recommend approval to the City Council of the City of Palm Desert of the above described Tentative Map No. TT 5553 subject to fulfillment of the attached conditions. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all the requirements, limitations, and restrictions of all municipal ordinances and State and Federal statutes now in force, or which hereafter may be in force. 2. Full public improvements including traffic safety lighting as re- quired by Ordinance and the Director of Public Works, shall be in- stalled in accordance with City standards. 3. The C.C.&R's for this development shall be submitted to the Director of Public Works for review and approval prior to the issuance of any building permits. Prior to recordation of the final subdivi- sion map, the applicant shall submit to the Director of Public Works: a. The document to convey title. b. Covenants and restrictions to be recorded. c. Management and maintenance agreement to be entered into with the property owners of the tract. 4. Improvement plans for water and sewer system shall meet the require- ments of the respective service districts. 5. Area shall be annexed to appropriate improvement districts having jurisdiction over the subject area. 6. All dedicated land and/or easements required by this approval shall be granted to the City of Palm Desert, without cost to the City and free of all liens and encumbrances. 7. All on -site utilities, including cable TV, shall be placed under- ground and shall be completely concealed from view except certain appurtenances as may be approved by the Director of Environmental Services. 8. Complete plans and specifications shall be submitted as required by Ordinance to the Director of Public Works for checking and approval before construction of any improvements is commenced. The subdivider shall submit "as -built" plans prior to acceptance of the subdivision improvements by the City. 9. In order to maintain reasonable fire protection during construction period, the subdivider shall maintain passable vehicular access to all buildings, and adequate fire hydrants with required fire flows shall be installed as recommended by the Fire Department. 10. All requirements of the City Fire Marshal shall be met as a part of the development of this tract per attached memorandum. 11. Drainage shall be subject to approval of the Director of Public Works. Applicant shall provide engineered data as requested. 12. The total number of lots shall be limited to 71. PLANNING COMMISSION RESOLUTION NO. 344 Page Four 13. The applicant shall have twelve (12) months from the date of the approval or conditional approval of the tentative map for filing of the final map unless an extension of time of up to eighteen (18) months is granted by a Resolution of the City Council. 14. The applicant shall dedicate land pursuant to the agreement between the applicant and the City Council in order to comply with Article 26.15 of the City's Subdivision Ordinance regard- ing the public facilities requirement. 15. Applicant shall pay fees into the Palm Desert Planned Local Drainage Facilities Fund in an amount to be determined by the provisions of Ordinance No. 175. 16. Access rights shall be dedicated to the City of Palm Desert on Portola and the east side of Riata Trail. Special Conditions: 1. a) The front yard setback on all lots shall be a minimum of 20'. Except in those cases where a side in garage is used, the front yard setback may be reduced to 16'. b) The rear yard setbacks shall be 25' on all lots except lots 61 through 70, 42 through 46 plus 49 and 50 through 52 where the rear yard setbacks shall be a minimum of 40'. c) The side yard setback shall be 12' except lots 61 through 70 and 50 through 52 where the side yard setbacks shall be 15'. d) The building height shall be limited to 14 ft except that 16' in height shall be allowed if approved by the Design Review Board taking into consideration the preservation of views from adjacent development. e) The minimum house size shall be 2,000 sq. ft. 2. Portola Avenue shall have a left turn pocket installed westerly of Mariposa Avenue to accomodate a minimum of 4 cars. 3. The drainage for the subject tract shall be engineered and approve by the Director of Public Works. 4. A left turn pocket whall be provided on Portola Avenue for traffic heading in a northerly direction to accomodate two cars. 5. 'A' Street shall be 40 feet curb to curb. The additional width shall be taken from the south of the proposed street. 6. Traffic safety lighting shall be installed in accordance with the Director of Public Works recommendations. 7. Curbs and gutters shall be in conformance with the City of Palm Desert Standard Plan R-1. 8. Sidewalks shall be required on Portola Avenue as approved by the Director of Public Works. 9. 8" curb and gutter shall be installed along Buckboard Trail. 10. The cul-de-sac at the end of Silver Spur Trail shall be moved westerly so that it abuts the tract boundary line. .PLANNING COMMISSION RESOLUTION NO. 344 Page Five 11. A decorative wall, the design to be approved by the Design Review Board, shall be constructed on the north side of Portola and shall extend to the northern boundary of the Ironwood holdings. 12. Any maintenance of landscaping placed in the public right-of-way shall be the responsibility of the Homeowners' Association in perpetuity and shall be subject to an encroachment permit. 13. The building permits for the improvement of any of these lots will not be issued until the proposed fire station is fully operative. The long response times from our existing Palm Desert Fire Station will cause fires that would normally be small to grow in size prior to fire depart- ment arrival, causing more damage and posing a greater risk to human life. It is my opinion that we cannot allow the area south of Haystack Road to continue it's rapid rate of growth wi-thout providing additional fire/rescue protection. How- ever, if the Palm Desert City Planning Commission decides to allow continued develop- ment in this area, the following conditions shall be met: 1. Install a water system capable of delivering 2000 GPM fire flow from any fire hydrant for a two hour duration in addition to domestic supply. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of measurement. 2. Install Riverside County super fire hydrants located at each street intersection (a) but not greater than 500 feet apart in any direction. A. Exterior surface of hydrant barrels and heads shall be painted chrome yellow, and the tops and nozzle caps shall be painted green. B. Curbs shall be painted red 15 feet in either direction from each hydrant. 3. Prior to recordation of the final map, the developer shall furnish the original and three (3) copies of the water system plan to the Fire Marshal for review. 4. The water system plan shall be signed by a registered civil engineer and approved by the water company, with the following certification: "I certify that the design of the water system in Tract No. TT 5553 is in accordance with the require- ments prescribed by the Fire Marshal."
