HomeMy WebLinkAboutRes No 354PLANNING COMMISSION RESOLUTION NO. 354 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, SETTING FORTH ITS FINDINGS AND RECOMMENDING TO THE CITY COUNCIL, APPROVAL OF A TENTATIVE MAP TO CONSOLIDATE 15 EXISTING LOTS TO CREATE 4 LOTS TO PROVIDE FOR 21 CONDOMINIUM UNITS AND COMMON OPEN SPACE ON PRO- PERTY GENERALLY LOCATED EAST OF DEEP CANYON, BE- TWEEN SAGE BRUSH DRIVE AND DRIFTWOOD DRIVE. CASE NO. TT 12450 WHEREAS, the Planning Commission of the City of Palm Desert, California, did receive a verified application from DANIEL RUSSIE re- questing approval of a Tentative Map to consolidate 15 existing lots to create 4 lots to provide for 21 condominium units and open space on approximately 3.48 acres within the R-3(Multi-family Residential) and R-3(3) (Multi -family Residential, min. 3,000 sq. ft. of lot area/ du) zones generally located east of Deep Canyon, between Sage Brush Drive and Driftwood Drive, more particularly described as: Lots 15-29 Shadow Hills Estates WHEREAS, said application has complied with the requirements of the "City of Palm Desert Environmental Quality Procedure Resolution No. 77-7", in that the Director of Environmental Services has deter- mined that the project is exempt from further documentation as a Nega- tive Declaration was issued for a related project, Case No. CUP 19-77; and, WHEREAS, the Planning Commission did take into consideration the Tentative Map as submitted, and the reports of the various reviewing agencies; and, WHEREAS, the Planning Commission did find that the subject Tenta- tive Map does substantially comply with Chapter 26 of the City of Palm Desert Municipal Code, and the State of California Subdivision Map Act, as amended; and, WHEREAS, the Planning Commission did find that the subject Tenta- tive Map does comply with the adopted General Plan and the Palm Desert Zoning Ordinance; and, WHEREAS, the Planning Commission did find that the site is physically suitable for the type of development proposed; and, WHEREAS, the Planning Commission did find that the site is physically suited for the proposed density of the development; and, WHEREAS, the Planning Commission did find that the design of the subdivision and the proposed improvements are not likely to cause sub- stantial environmental damage or serious health problems. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, as follows: 1. That the doove recitations are true and correct and consti- tute the findings of the Commission in this case; 2. That it does hereby require that the applicant pay a fee in an amount determined under the Ordinance provisions in order to com- ply with Article 26.15 of the City's Subdivision Ordinance regarding the public facilities requirement; 3. That it does hereby recommend approval to the City Council of the City of Palm Desert of the above described Tentative Map No. 12450, subject to fulfillment of the attached conditions: PLANNING COMMISSION RESOLUTION NO. 354 Page Two PASSED, APPROVED, and ADOPTED at a regular meeting of the Palm Desert Planning Commission, held on this 2nd day of May, 1978, by the following vote, to wit: AYES: BERKEY, KELLY, KRYDER, SNYDER NOES: NONE ABSENT: NONE ABSTAIN: NONE GEORGE BERKEY, Chair an ATTEST: PAUL A. WILLIAMS, Secretary /ks PLANNING COMMISSION RESOLUTION NO. 354 Page Three CONDITIONS OF APPROVAL CASE NO. TT 12450 Standard Conditions: 1. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all municipal ordinances and State and Federal statutes now in force, or which hereafter may be in force. 2. Full public improvements including traffic safety lighting as re- quired by Ordinance and the Director of Public Works, shall be installed in accordance with City standards. 3. Access rights on Sagebrush Dr., Shadow Hills Dr., 'A' Street, Drift- wood Dr., and Deep Canyon Dr. shall be offered to the City as a dedication on the Final Map. 4. The C.C.&R's for this development shall be submitted to the Director of Public Works for review and approval prior to the issuance of any building permits. Prior to recordation of the final subdivision map, the applicant shall submit to the Director of Public Works: a. The document to convey title. b. Covenants and restrictions to be recorded. c. Management and maintenance agreement to be entered into with the owners of the units of the project. 5. Improvement plans for water and sewer system shall meet the re- quirements of the respective service districts. 6. Area shall be annexed to appropriate Improvement Districts having jurisdiction over the subject area. 7. All dedicated land and/or easements required by this approval shall be granted to the City of Palm Desert, without cost to the City and free of all liens and encumbrances. 8. All on -site utilities, including cable TV, shall be placed under- ground and shall be completely concealed from view except certain appurtenances as may be approved by the Director of Environmental Services. 9. Complete plans and specifications shall be submitted as required by Ordinance to the Director of Public Works for checking and ap- proval before construction of any improvements is commenced. The subdivider shall submit "as -built" plans prior to acceptance of the subdivision improvements by the City. 10. In order to maintain reasonable fire protection during the construc- tion period, the subdivider shall maintain passable vehicular ac- cess to all buildings. An adequate number of fire hydrants with required fire flows shall be installed as recommended by the Fire Marshal. 11. All requirements of the City Fire Marshal shall be met as a part of the development of this tract per attached memorandum. 12. Drainage shall be subject to approval of the Director of Public Works. Applciant shall provide engineered data as requested. 13. All requirements of the Planning Commission action on related case No. CUP 19-77 shall be met as a part of the development of this tract. 14. The applicant shall have twelve (12) months from the date of the approval or conditional approval of the tentative map for filing of the final map unless an extension of time of up to eighteen (18) months is granted by a Resolution of the City Council. 16. Applicant shall pay fees into the Palm Desert Planned Local Drainage Facilities Fund in an amount to be determined by the provisions of Ordinance No. 175. 17. Applicant shall pay a fee in an amount determined under the Ordi- nance provisions in order to comply with Article 26.15 of the City's Subdivision Ordinance regarding the public facilities re- quirement. Special Conditions: 1. Concrete curbs, gutters, tie-in paving and sidewalks shall be in- stalled for this development. 2. Sidewalks shall be installed 5 feet wide, adjacent to the curb in this entire area. PLANNING COMMISSION RESOLUTION NO. 354 Page Five Paul A. Williams Director of Environmental Services City of Palm Desert 45-275 Prickly Pear Lane Palm Desert, Ca. 92260 April 14, 1978 Reference: Tentative Tract No. 12450 Provide the following fire protection: 1. Install a water system capable of delivering 2500 GPM fire flow from any fire hydrant for a two hour duration in addition to domestic supply. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of measurement. 2. Install Riverside County super fire hydrants located at each street intersection (a) but not greater than 400 feet apart in any direction. A. Exterior surface of hydrant barrels and heads shall be painted chrome yellow, and the tops and nozzle caps shall be painted green. B. Curbs shall be painted red 15 feet in either direction from each hydrant. 3. Prior to recordation of the final map, the developer shall furnish the original and three (3) copies of the water system plan to the Fire Marshal for review. 4. The water system plan shall be signed by a registered civil engineer and approved by the water company, with the following certification: "I certify that the design of the water system in Tract No. 12450 is in accordance with the requirements prescribed by the Fire Marshal."
