HomeMy WebLinkAboutRes No 355PLANNING COMMISSION RESOLUTION NO. 355 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, ANNOUNCING FINDINGS AND APPROVING THE DESIGN REVIEW BOARD ACTIONS OF APRIL 25, 1978. WHEREAS, the Planning Commission of the City of Palm Desert, California, did review the Design Review Board actions of April 25, 1978, approving: Case No. 79C - Request for approval of preliminary site, floor and elevations for a commercial pro- ject for C. G. DUNHAM; Case No. 115MF - Request for approval of preliminary site, floor and elevations and final construction drawings for a duplex for CHARLES KRUG; Case No. 119MF - Request for approval of preliminary site, floor and elevations and final construction drawings for a duplex for JAMES W. CLAUSE; Case No. 61MF - Request for approval of a one-year time extension on the approval of a duplex for 0. M. HOMME: WHEREAS, at this time, upon considering and receiving all testimony and arguments, if any, of all interested persons desiring to be heard, said Commission did find sufficient facts and reasons to exist to approve the Design Review Board actions of April 25, 1978. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert as follows: 1. That the above recitations are true and correct and consti- tute the findings of the Commission in these cases; 2. That it does hereby approve the actions of the Design Re- view Board at their meeting of April 25, 1978,except for Case No. 119MF. 3. Case No. 119MF, Condition No. 4 shall include: subject to review by the Design Review Board prior to issuance of Building Permits. PASSED, APPROVED, and ADOPTED at a regular meeting of the Palm Desert Planning Commission held on this 2nd day of May, 1978, by the following vote, to wit: AYES: NOES: ABSENT: ABSTAIN: BERKEY, KELLY, KRYDER, SNYDER NONE NONE NONE GEORGE BERKEY, Chairmen TEST: PAUL A. WILLIAMS, Secretary /ks SPECIAL CONDITIONS CASE NO. 79C 1. Construction plans shall be submitted for approval to the City Fire Marshal prior to issuance of building permits. All con- ditions shall be made a part of construction and no certificate of occupancy shall be issued until completed. 2. Any/all utility service and districtuion lines on or abutting the subject property, shall be placed underground prior to oc- cupancy clearance pursuant to Section 25.56.110 of the Municipal Code. 3. Final construction drawings including a final landscaping, grading, lighting, amenitites, trash storage, walkway layout, irrigation plans & sign program shall be submitted to the Design Review Board. No final inspection or occupancy permit shall be given by the De- partment of Environmental Services to this project until the afore- mentioned approved plans and construction shall have been completed. 4. The applicant shall agree to join any assessment district, specifi- cally an undergrounding untility district, formed that includes the subject property within its boundaries. 5. The applicant shall grant to the City of Palm Desert easement rights over the parking lot area of the project site. 6. Applicant shall provide handicap spaces in the final construction drawings. 7. Tree wells shall be provided throughout the parking lot. 8. Ingress & egress on both Sun Lodge Lane and Lupine Lane shall be limited to one entrance on each street. 9. A six (6) foot masonry wall or equivalent shall be constructed along the south border of the project. 10. Where the parking area is situated across the street from property in a residential district along Lupine Lane and Sun Lodge Lane, a masonry wall or berm (3) feet in height shall be erected within the required landscape area to adequately screen the residential pro- perties. AGREEMENT I accept and agree, prior to use of this permit or approval, to comply with all the conditions set forth, and understand that the Department of Building and Safety will not issue a building permit or allow oc- cupancy on the use permitted until this signed confirmation has been received by the Department of Environmental Services. (Date) (Applicant's Signature) SPECIAL CONDITIONS CASE NO. 119MF 1. Garden wall shall be same color as accent material. 2. Applicant shall allow a 4" to 1' pitch on roof for drainage as a minimum. 3. Mounding shall be provided along Grapevine. 4. Landscaping plan shall include: less gravel area, more plantings, and larger trees, as approved by the Design Review Board prior to issuance of building permits. AGREEMENT I accept and agree, prior to use of this permit or approval, to comply with all the conditions set forth, and understand that the Department of Building and Safety will not issue a building permit or allow oc- cupancy on the use permitted until this signed confirmation has been received by the Department of Environmental Services. (Date) (Applicant's Signature) SPECIAL CONDITIONS CASE NO. 115MF 1. Front yard setback shall be 35 feet in order to modify the driveway so as to enable motorists to leave the site in a forward direction. 2. A more detailed and upgraded landscaping plan shall be sub- mitted at time of submittal of final construction drawings. 3. Roofing material shall be red mission tile, exclusively. 4. Parking space back up areas shall be reduced by 3 feet and landscaping provided. 5. A six foot high masonry shall be provided around the perimeter of the rear yard. 6. The angle of the mansard roof shall exceed 30 . 7. Evergreen or pear trees shall be utilitzed in place of those indicated on the exhibit. 8. Island area shall be landscaped with a group of palm trees, 6 ft., 8 ft., and 10 ft. in height 9. Trees indicated shall be increased in size. (Date) (Applicant's Signature) Febi -lry 22, 1977 CONDITIONS OF APPROVAL CASE NO. 61MF 1. The development of this project shall conform substantially to all development plans submitted in behalf of this case (Exhibits A-D), and as revised according to Planning Commission action. Any minor changes require approval by the Director of Environmental Services. 2. All requirements of any law, ordinance, or regulation of the State, City, and any other applicable government entity shall be complied with as a part of the development process. 3. This approval is applicable, subject to the development of this project, commencing within one year from approval date and being promptly completed. 4. There shall be no roof mounted air conditioning equipment. All air con- ditioning compressors shall be fully concealed from view from any public rights -of -way and adjoining properties. 5. All service utility lines shall be placed underground. 6. Curb, gutter, curb cuts, and tie-in paving shall be provided with City Standards and the requirements of the City Engineerin conformance 7. Traffic control provisions shall be provided as required by the Director of Environmental Services. 8. Elevations are approved as shown. 9. Prior to submittal for building permits, the applicant shall submit final construction drawings for Design Review Board Process approval including but not limited to detailed landscaping, irrigation, trash storage, fencing, exterior lighting, and amenities plans. 10. This approval shall be invalid unless a modified Development Plan is adopted. 11. An additional specimen -size tree shall be added near the driveway in front of each dwelling unit.
