HomeMy WebLinkAboutRes No 359PLANNING COMMISSION RESOLUTION NO. 359 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, ANNOUNCING FIND-) INGS AND APPROVING THE DESIGN REVIEW BOARD ACTIONS OF MAY 16, 1978. WHEREAS, the Planning Commission of the City of Palm Desert, California, did review the Design Review Board actions of May 16, 1978, approving: Case No. 28C - Request for approval of preliminary site, floor, and elevation plans for a restaurant for HENRY TAGLE; Case No. 127MF - Request for approval of preliminary site, floor, and elevation plans for a 10-unit apartment for DOUGLAS STONE; Case No. 81C - Request for approval of preliminary site, floor, and elevation plans for a commercial structure for DR. JACQUES; Case No. 71C - Request for approval of modified preliminary site, floor and elevation plans for a com- mercial structure for LAUREL DEVELOPMENT CO. WHEREAS, at this time, upon considering and receiving all testimony and arguments, if any, of all interested persons desiring to be heard, said Commission did find sufficient facts and reasons to exist to approve the Design Review Board actions of May 16, 1978. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and consti- tute the findings of the Commission in this case. 2. That it does hereby approve the Design Review Board action of May 16, 1978. PASSED, APPROVED, and ADOPTED at a regular meeting of the Palm Desert Planning Commission, held this 17th day of May, 1978, by the following vote, to wit: AYES: BERKEY, KELLY, KRYDER, SNYDER NOES: NONE ABSENT: NONE ABSTAIN: NONE GEORGE RKEY, Chairm ATTEST: PAA. WILLIAMS, Secretary /ks CONDITIONS OF APPROVAL CASE NO. 28C 1. The development of this project shall conform substantially to all develop- ment plans submitted in behalf of this case (Exhibits A & B), and as revised according to the Design Review Board process. Any minor changes require ap- proval by the Director of Environmental Services. Any substantial change requires approval by the Planning Commission. 2. All requirements of any law, ordinance, or regulation of the State, City, and any other applicable government entity shall be complied with as part of the development process. 3. This approval is applicable, subject to the development of this project com- mencing within one year from approval date and being promptly completed. 4. Any roof mounted, exhaust, or air conditioning equipment shall be fully con- cealed from view from any public rights -of -way and adjoining properties by architecturally integrated means. 5. All utility lines shall be placed underground. 6. Curb, gutter, sidewalk or approved pathways, curb cuts, and tie-in paving shall be provided in conformance with City of Palm Desert Standards. 7. Landscaping (with irrigation system) shall be provided and submitted to the Design Review Board for final approval. 8. Lighting of parking areas and premises shall be provided for with plans sub- mitted to the Design Review Board for final approval. 9. Signage shall be provided in accordance with signage plan to be submitted to the Design Review Board for final approval. 10. Traffic control provisions shall be provided as required by the Director of Environmental Services. 11. Elevations are approved as shown. 12. All signs on the existing restaurant shall be removed. 13. The existing billboard on the new restaurant site shall be removed. 14. The applicant shall grant easement rights over the parking lot area to the City of Palm Desert in a form acceptable to the City Attorney. 15. Colors are approved as shown. 16. This approval is contingent upon Planning Commission approval of Case No. CUP 07-76, and City Council approving the abandonment of a portion of the right-of-way along De Anza Way. 17. Landscaping plan be revised as follows: 1) A minimum 24" box size trees be used in parking lot. Tree type should be Carob. 2) Eliminate land- scaping in front of trash enclosure. 3) Add street trees along project perimeter. Tree type should be Rhus lancea. 18. Revise plan to maintain 25' line of site radius clear at intersection of DeAnza Way and Palm Desert Drive. AGREEMENT I accept and agree, prior to use of this permit or approval, to comply with all the conditions set forth, and understand that the Department of Building and Safety will not issue a building permit or allow occupancy on the use permitted until this signed confirmation has been received by the Department of Environmental Services. (Date) (Applicant's Signature) SPECIAL CONDITIONS FOR CASE NO. 127 MF 1. Final construction drawings including a final landscaping, grading and irrigation plan shall be submitted to the Design Review Board. No final inspection or occupancy permit shall be given by the Department of Environmental Services to this project until the aforementioned approved plans and construction shall have been completed. 2. Construction plans shall be submitted for approval to the City Fire Marshal prior to issuance of building permits. All conditions shall be made a part of construction and no certificate of occupancy shall be issued until completed. 3. Applicant shall fully improve and dedicate to the City of Palm Desert the alley on the east side of the subject property. 4. A masonry wall, 3' high, shall be provided along Las Palmas and San Gregornio Way. 5. Any and all utility service and distribution lines on or abutting the subject property, shall be placed underground prior to occupancy clearance pursuant to Section 25.56.110 of the Municipal Code. 6. Header boards shown in the landscaping plan shall be eliminated and a permanent delineation constructed. 7. Provide trees along wall at south and east property lines. 8. Provide trees around buildings and in open space areas. 9. Provide access from apartments, where appropriate, for use of open space. 10. Use Mexican Ash trees in parking lot area and bottle trees in open space areas. AGREEMENT I accept and agree, prior to use of this permit or approval, to comply with all the conditions set forth , and understand the Department of Building and Safety will not issue a build- ing permit or allow occupancy on the use permitted until this signed confirmation has been received by the Department of Environmental Services. All service lines for utilities shall be placed underground. 5. Construction plans shall be submitted for approval to the City Fire Marshal prior to issuance of building permits. All conditions shall be made a part of construc- tion and no certificate of occupancy shall be issued until completed. 6. Final landscaping (with irrigation system) plans indicating plant sizes and heights shall be provided to the Design Review Board for approval prior to is- suance of a building permit. 7. Lighting of parking areas and premises shall be provided as approved by the Director of Environmental Services. 8. Signage shall be provided in accordance with a signage plan to be submitted to the Design Review Board and Planning Commission for final approval. 9. Traffic control provisions shall be provided as required by the City Engineer. 10. The applicant shall agree to join any assessment district formed that includes the subject property within its boundaries. AGREEMENT I accept and agree, prior to use of this permit or approval, to comply with all the conditions set forth, and understand that the Department of Building and Safety will not issue a building permit or allow occupancy on the use permitted until this signed confirmation has been received by the Department of Environmental Services.
