HomeMy WebLinkAboutRes No 360PLANNING COMMISSION RESOLUTION NO. 360 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, ANNOUNCING FIND- INGS AND GRANTING A CONDITIONAL USE PERMIT TO ALLOW A CHURCH -SCHOOL COMPLEX AT THE NORTHEAST CORNER OF PORTOLA AVENUE AND FAIRWAY DRIVE. CASE NO. CUP 04-78 WHEREAS, pursuant to the provisions of the Palm Desert Zoning Ordinance, the Planning Commission did on May 30, 1978, hold a duly noticed Public Hearing to consider an application from HOPE LUTHERAN CHURCH for aConditional Use Permit to allow a church -school complex, partially developed, on approximately 3.14 acres within the R-1 (Single- family residential) zone at the northeast corner of Portola Avenue and Fairway Drive, more particularly described as: APN 625-182-001 APN 625-182-003 APN 625-182-004 APN 625-182-005 WHEREAS, said application has complied with the requirements of the "City of Palm Desert Environmental Quality Procedure Resolution No. 78-32," in that the Director of Environmental Services has determined that the project will not have a significant adverse effect on the environment and the appeal period has expired; and, WHEREAS, at said Public Hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said Commission did find the following facts and reasons to exist to justify the granting of said Conditional Use Permit: 1. The proposed location of the conditional use is in accordance with the objectives of the Zoning Ordinance and the purpose of the dis- trict in which the site is located. 2. The proposed location of the conditional use and the condi- tions under which it will be operated and maintained will not be detri- mental to the public health, safety, or general welfare, or be materially injurious to properties or improvements in the vicinity. 3. The proposed conditional use complies with the goals, objec- tives, and policies of the City's adopted General Plan. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert as follows: 1. That the above recitations are true and correct and constitute the findings of the Commission in this case; 2. That the Conditional Use Permit CUP 04-78 is hereby granted to HOPE LUTHERAN CHURCH for reasons subject to the attached conditions. PASSED, APPROVED, and ADOPTED at a regular meeting of the Palm Desert Planning Commission held on this 30th day of May, 1978, by the following vote, to wit: AYES: NOES: ABSENT: ABSTAIN: KELLY, KRYDER, SNYDER NONE BERKEY NONE Presiding Officer ATTEST: PAUL A. WILLIAMS, Secretary /ks PLANNING COMMISSION RESOLUTION NO. 360 CONDITIONS OF APPROVAL CASE NO. CUP 04-78 Standard Conditions: Page Two 1. The development of this project shall conform substantially to all plans submitted in behalf of this case and as revised according to the Design Review Board process and/or Planning. Commission action. Any minor changes require approval by the Director of Environmental Services. Any substantial change requires approval by the Planning Commission. 2. All requirements of any law, ordinance, or regulation of the State, City, and any other applicable government entity shall be complied with as part of the development process. 3. This approval is applicable, subject to the development of this pro- ject, commencing within one year from approval date and being promptly completed. 4. Construction plans shall be submitted for approval to the City Fire Marshal prior to issuance of building permits. All conditions shall be made a part of construction and no certificate of occupancy shall be issued until completed. 5. All overhead utility distribution shall be undergrounded as a part of construction of said lines. 6. Prior to the issuance of a building permit for construction of any uses contemplated by this approval, the applicant shall first obtain permits and/or clearance from the following agencies: County Department of Public Health Palm Desert Design Review Board Process Coachella Valley County Water District Regional Water Quality Control Board #7 Riverside County Fire Department 7. Plans and specifications shall conform to the City of Palm Desert standard specifications, development procedures and design criteria. Any modifications, thereof, shall require approval of the City Engineer. 8. Applicant shall pay fees into the Palm Desert Planned Local Drainage Facilities Fund in an amount to be determined by the provisions of Ordinance No. 175. Special Conditions: 1. Applicant shall provide a traffic safety light at the entrance off of Fairway Drive, Lantana Avenue and Portola Avenue, as a part of Phase II. 2. All streets abutting this development shall be fully improved with curbs, gutters, sidewalks and tie-in paving, as a part of Phase II. 3. Additional dedications shall be made along Portola Avenue and Fair- way Drive as required by the Director of Public Works, as a part of Phase II. PLANNING COMMISSION RESOLUTION N0. 360 Page Three 4. Proposed driveway along Fairhaven shall be moved westerly with the approval of the Director of Public Works, as a part of Phase II. AGREEMENT I accept and agree, prior to use of this permit or approval, to comply with all the conditions set forth, and understand the Depart- ment of Building and Safety will not issue a building permit or allow occupancy on the use permitted until this signed confirmation has been received by the Department of Environmental Services.
