A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF PALM DESERT, CALIFORNIA, ANNOUNCING
FINDINGS AND APPROVING AN AMENDMENT TO AN AP-
PROVED DEVELOPMENT PLAN AND PRELIMINARY DESIGN
REVIEW TO PROVIDE FOR A PERIMETER WALL AND LAND-
SCAPED AREA WHICH WOULD SEPARATE THE EXISTING
PHASE OF THE KINGS POINT CONDOMINIUM PROJECT ON
LOT 1 AND A PORTION OF LOT 2 OF THE RECORDED
TRACT FROM FUTURE DEVELOPMENT OF THE PROJECT.
CASE NOS. DP 08-78 and 125MF
WHEREAS, the Planning Commission of the City of Palm Desert,
California, did receive a verified application from ROGER BOYER DEVELOP-
MENT requesting approval of a Development Plan Amendment and Preliminary
Design Review to provide for a perimeter wall and landscaped area which
would separate the existing phase of the Kings Point condominium project
on Lot 1 and a portion of Lot 2 of the recorded tract within the PR-7
(Planned Residential, maximum 7 du/acre) zone district, from future
development of the project on property more particularly described as:
Lots 3-9 inclusive and a portion of Lot 2 of
Tract 4380-1
WHEREAS, said application has complied with the requirements of
the "City of Palm Desert Environmental Quality Procedure Resolution No.
78-32," in that the Director of Environmental Services has determined
that the project will not have a significant adverse effect on the
environment; and,
all

WHEREAS, at said Public Hearing, upon hearing and considering
testimony and arguments, if any, the Planning Commission did find
following facts and reasons to exist to justify the approval of
subject Development Plan amendment:
1. The proposed amendment will not adversely effect the
original intent of the PR zone district in which the
project is located.
2. The proposed amendment will not adversely effect the
public health, safety or welfare.
3. The proposed amendment will serve to separate the exist-
ing development from that proposed which action will re-
flect the mutual agreement of all parties involved.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of
the City of Palm Desert, California, as follows:
1. That the above recitations are true and correct and consti-
tute the findings of the Commission in this case;
2. The Planning Commission does hereby approve a Development
Plan Amendment and Preliminary Design Review as indicated on the exhibits
submitted in behalf of Cases DP 08-78 and 125MF for reasons stated,
subject to conditions.
PASSED, APPROVED, and ADOPTED at a regular meeting of the Palm
Desert Planning Commission, held on this 30th day of May, 1978, by
the following vote, to wit:

CONDITIONS OF APPROVAL
CASE NOS. DP 08-78 and 125MF
Standard Conditions:
1. The development of this project shall conform substantially to
all plans submitted in behalf of this case and as revised accord-
ing to the Design Review Board process and/or Planning Commission
action. Any minor changes require approval by the Director of
Environmental Services. Any substantial change requires approval
by the Planning Commission.
2. All requirements of any law, ordinance, or regulation of the State,
City, and any other applicable government entity shall be complied
with as part of the development process.
3. This approval is applicable, subject to the development of this
project, commencing within one year from approval date and being
promptly completed.
4. Any roof mounted, exhaust, or air conditioning equipment shall be
fully concealed from view from any public rights -of -way and ad-
joining properties by architecturally integrated means.
5. Construction plans shall be submitted for approval to the City
Fire Marshal prior to issuance of building permits. All conditions
shall be made a part of construction and no certificate of occupancy
shall be issued until completed.
6. All utility service and distribution lines on or abutting the sub-
ject property, shall be placed underground prior to occupancy
clearance.
7. Traffic control provisions shall be provided as required by the
Director of Public Works.
8. Curb, gutter, sidewalk or approved pathways, and tie-in paving
shall be provided in conformance with City Standards and/or as
required by the Director of Public Works.
9. The Fire Protection Requirements as specified in the Fire Marshal's
memo dated May 10, 1978, attached hereto, shall apply.
10. Prior to issuance of*a building permit for construction of any use
contemplated by this approval, the applicant shall first obtain
permits and/or clearance from the following agencies:
Director of Public Works - City of Palm Desert
Riverside County Department of Health
Palm Desert Design Review Board Process
City Fire Marshal - City of Palm Desert
Coachella Valley County Water District
Regional Water Quality Control Board #7
Evidence of said permit or clearance from the above)\agencies shall
be presented to the Dept. of Building and Safety at the time of
issuance of a building permit for the use contemplated herewith.

Special Conditions:
1. The Palm Valley Storm Channel contiguous to the subject property
shall be improved as required by the Director of Public Works.
2. All overhead utility distribution lines on the subject property
bordering Highway 74 shall be undergrounded pursuant to the
provisions of the Municipal Code.
3. A six foot masonry wall shall be constructed along the perimeter
of the project where it borders those single-family lots on
Hedgehog Street.
4. Landscaping within the median strip along Highway 74 shall be
installed and maintained in perpetuity by the Homeowners' Associa-
tion. Subject landscaping shall be approved by the Design Review
Board.
Design Review Conditions:
1. Final construction drawings, including a final landscaping,
grading, lighting, trash storage, walkway layout, and irrigation
plan in addition to tennis court lighting proposal or any other
amenities proposed shall be submitted to the Design Review Board.
No final inspection or occupancy permit shall be given by the
Department of Environmental Services to this project until the
aforementioned approved plans and construction shall have been
completed.
2. The applicant shall explore the feasibility of using solar energy
to heat all swimming pools.
3. Exterior lighting plans and sign program shall be submitted for
Design Review Board process approval prior to the submittal of
plans for building permits. All requirements of the final ap-
proval shall be made as a part of construction.
4. Proposed adobe slumpstone wall separating the original project
from the subject project, shall be constructed prior to the con-
struction of any dwelling units.
AGREEMENT
I accept and agree, prior to use of this permit or approval, to
comply with all the conditions set forth, and understand that the
Department of Building and Safety will not issue a building permit
or allow occupancy on the use permitted until this signed confirma-
tion has been received by the Department of Environmental Services.

Reference: Case No. DP 08-78 & 125 MF
Prior to construction of any of the proposed buildings, the following conditions
must be met:
1. Install a water system capable of delivering 2500 GPM fire flow for a (2)
hour duration in addition to domestic or other supply. The computation shall be
based upon a minimum of 20 psi residual operating pressure in the supply main
from which the flow is measured at the time of measurement.
2. Install Riverside County super fire hydrants so that no point of any building is
more than 2Sn feet from a fire hydrant measured along approved vehicular
travel ways.
A. Hydrants shall not be located closer than 25 feet to any building.
B. Exterior surfaces of hydrant barrels and heads shall be painted chrome yellow,
and the tops and nozzle caps shall be painted green.
C. Curbs (if installed), shall be painted red 15 feet in either direction from
each hydrant.
3. Prior to issuance of a building permit, the developer shall furnish the original
and three (3) copies of the water system plan to the Fire Marshal for review.
Upon approval, one copy will be sent to the Building Department, and the original
will be returned to the developer.
4. The water system plan shall be signed by a registered civil engineer, and approved
by the water company, with the following certification: "I certify that the design
of the water system in Case Number Dp 08_78 is in accordance with the require-
ments prescribed by the Fire Marshal."
