HomeMy WebLinkAboutRes No 363PLANNING COMMISSION RESOLUTION NO. 363 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, SETTING FORTH ITS FINDINGS AND RECOMMENDING TO THE CITY COUNCIL, APPROVAL OF A TENTATIVE MAP TO CREATE AN 81-LOT SUBDIVISION TO PROIVDE FOR 80 CONDOMINIUM UNITS AND COMMON OPEN SPACE FROM A PARCEL APPROXIMATELY 13.5 ACRES IN SIZE AT THE NORTHWEST CORNER OF COOK STREET AND 44TH AVENUE. CASE NO. TT 12556 WHEREAS, the Planning Commission of the City of Palm Desert, California, did receive a verified application from TRANSCOPIC DEVELOP- MENT CORPORATION requesting approval of a Tentative Tract Map to create an 81-lot subdivision to provide for 80 condominium units and common open space from a parcel approximately 13.5 acres in size within the PR-6, S.P. (Planned residential, maximum 6 du/acre, scenic preservation overlay) zone at the northwest corner of Cook Street and 44th Avenue, more particularly described as: APN 621-500-009 WHEREAS, said application has complied with the requirements of the "City of Palm Desert Environmental Quality Procedure Resolution No. 78-32," in that the Director of Environmental Services has deter- mined on April 17, 1978, that the project will not have a significant adverse effect on the environment and the appeal period has expired; and, WHEREAS, the Planning Commission did take into consideration the Tentative Map as submitted, and the reports of the various reviewing agencies; and, WHEREAS, the Planning Commission did find that the subject Tenta- tive Map does substantially comply with Chapter 26 of the City of Palm Desert Municipal Code, and the State of California Subdivision Map Act, as amended; and, WHEREAS, the Planning Commission did find that the subject Tenta- tive Map does comply with the adopted General Plan and the Palm Desert Zoning Ordinance; and, WHEREAS, the Planning Commission did find that the site is physically suitable for the type of development proposed; and, WHEREAS, the Planning Commission did find that the site is physically suited for the proposed density of the development; and, WHEREAS, the Planning Commission did find that the design of the subdivision and the proposed improvements are not likely to cause sub- stantial environmental damage or serious health problems. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, as follows: 1. That the above recitations are true and correct and consti- tute the findings of the Commission in this case; 2. That it does hereby recommend that the applicant pay a fee in an amount determined under the Ordinance provisions in order to comply with Article 26.15 of the City's Subdivision Ordinance regard- ing the public facilities requirement; PLANNING COMMISSION RESOLUTION NO. 363 Page Two 3. That it does hereby recommend approval to the City Council of the City of Palm Desert of the above described Tentative Map No. 12556, subject to fulfillment of the attached conditions. TT 12556 Standard Conditions: 1. The development of the property described herein shall be sub- ject to the restrictions and limitations set forth herein which are in addition to all municipal ordinances and State and Federal statutes now in force, or which hereafter may be in force. 2. Full public improvements including traffic safety lighting as re- quired by Ordinance and the Director of Public Works, shall be installed in accordance with City standards. 3. Access rights on Cook Street and 44th Avenue shall be offered to the City as a dedication on the Final Map. 4. The C.C.&R's for this development shall be submitted to the Director of Public Works for review and approval prior to the issuance of any building permits. Prior to recordation of the final subdivision map the applicant shall submit to the Director of Public Works: a. The document to convey title. b. Covenants and restrictions to be recorded. c. Management and maintenance agreement to be entered into with the owners of the units of the project. 5. Improvement plans for water and sewer system shall meet the re- quirements of the respective service districts. 6. Area shall be annexed to appropriate Improvement Districts having jurisdiction over the subject area. 7. All dedicated land and/or easements required by this approval shall be granted to the City of Palm Desert, without cost to the City and free of all liens and encumbrances. 8. All on -site utilities, including cable TV, shall be placed under- ground and shall be completely concealed from view except certain appurtenances as may be approved by the Director of Environmental Services. 9. Complete plans and specifications shall be submitted as required by Ordinance to the Director of Public Works for checking and ap- proval before construction of any improvements is commenced. The subdivider shall submit "as -built" plans prior to acceptance of the subdivision improvements by the City. 10. In order to maintain reasonable fire protection during the construc- tion period, the subdivider shall maintain passable vehicular ac- cess to all buildings. An adequate number of fire hydrants with required fire flows shall be installed as recommended by the Fire Marshal. 11. All requirements of the City Fire Marshal shall be met as a part of the development of this tract per attached memorandum. 12. Drainage shall be subject to approval of the Director of Public Works. Applicant shall provide engineered data as requested. 13. All requirements of the Planning Commission action on related case No. DP 06-78 shall be met as a part of the development of this tract. 14. The total number of residential lots shall be limited to 80. PLANNING COMMISSION RESOLUTION NO. 363 Page Four 15. The applicant shall have twelve (12) months from the date of the apporval or conditional approval of the tentative map for filing of the final map unless an extension of time of up to eighteen (18) months is granted by a Resolution of the City Council. 16. Applicant shall pay fees into the Palm Desert Planned Local Drainage Facilities Fund in an amount to be determined by the provisions of Ordinance No. 175. 17. Applicant shall pay a fee in an amount determined under the Ordinance provisions in order to comply with Article 26.15 of the City's Subdivision Ordinance regarding the public facilities requirement. Special Conditions: 1. Applicant shall contribute $9,000.00 to the signalization fund of Palm Desert. 2. Applicant shall provide for drainage at the corner of the subject site adjacent to Lot 58. 3. Traffic safety lighting shall be provided at both entrances to this subdivision. 4. All improvements shall conform to the standard drawings and specific cations of the City of Palm Desert. 5. Rights -of -way shall be dedicated along 44th and Cook Streets to enable a 55 foot right-of-way for one half street section. 6. The street widths as indicated are acceptable provided a 5 foot easement is shown on each side of the street. 7. A right-of-way dedication of 25 feet shall be provided on the westerly boundary of this tract to enable the Master Storm Drainage plan to be implemented; namely, the Toro Peak No. One Outlet into the Whitewater Wash. 8. Applicant shall provide a revised map showing street improvement cross sections for 44th Avenue and Cook Street prior to submittal of the map to the City Council. • PLANNING COMMISSION RESOLUTION NO. 363 Page Five Sloe Paul A. Williams Director of Environmental Services City of Palm Desert 45-275 Prickly Pear Lane Palm Desert, Ca. 92260 May 10 1978 Reference: Tentative Tract No. 12556 Provide the following fire protection: 1. Install a water system capable of delivering 2500 GPM fire flow from any fire hydrant for a two hour duration in addition to domestic supply. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of measurement. 2. Install Riverside County super fire hydrants located at each street intersection (a) but not greater than 400 feet apart in any direction. A. Exterior surface of hydrant barrels and heads shall be painted chrome yellow, and the tops and nozzle caps shall be painted green. B. Curbs shall be painted red 15 feet in either direction from each hydrant. 3. Prior to recordation of the final map, the developer shall furnish the original and three (3) copies of the water system plan to the Fire Marshal for review. 4. The water system plan shall be signed by a registered civil engineer and approved by the water company, with the following certification: "I certify that the design of the water system in Tract No. 12556 is in accordance with the requirements prescribed by the Fire Marshal."
