A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF PALM DESERT, CALIFORNIA, SETTING FORTH ITS FIND-
INGS AND RECOMMENDING TO THE CITY COUNCIL, APPROVAL
OF A TENTATIVE MAP TO CREATE 101 SINGLE-FAMILY RE-
SIDENTIAL LOTS AND 3 LOTS TO PROVIDE FOR A DISTRICT
COMMERCIAL CENTER, A COMMON RECREATION AREA AND OPEN
SPACE FROM A 40 ACRE PARCEL LOCATED AT THE SOUTHEAST
CORNER OF COUNTRY CLUB DRIVE AND MONTEREY AVENUE.

WHEREAS, the Planning Commission of the City of Palm Desert,
California, did receive a verified application from the MCBAIL COMPANY,
requesting approval of a Tentative Tract Map to create 101 single-
family residential lots and 3 lots to provide for a District Commercial
Center, a common recreation area and open space from a 40 acre parcel
located within the P.C.(2) (Planned Commercial, District) and R-2 8,000
(Single-family residential, 8,000 sq.ft. of site area/du) zones, Upon
Annexation, at the southeast corner of Country Club Drive and Monterey
Avenue, more particularly described as:

WHEREAS, said application has complied with the requirements of
the "City of Palm Desert Environmental Quality Procedure Resolution No.
78-32 in that the Director of Environmental Services has developed an
expanded initial study on the Prezoning Case No. C/Z 01-78 which includes
the subject property and weighs the environmental impacts of said project,
and this consideration has been determined to be an on -going project; and,
WHEREAS, the Planning Commission did take into consideration the Tentative
Map as submitted, and the reports of the various reviewing agencies; and,
WHEREAS, the Planning Commission did find that the subject Tenta-
tive Map does substantially comply with Chapter 26 of the City of Palm
Desert Municipal Code, and the State of California Subdivision Map Act,
as amended; and,
WHEREAS, the Planning Commission did find that the subject Tenta-
tive Map does comply with the adopted General Plan and the Palm Desert
Zoning Ordinance; and,
WHEREAS, the Planning Commission did find that the site is
physically suitable for the type of development proposed; and,
WHEREAS, the Planning Commission did find that the site is
physically suited for the proposed density of the development; and,
WHEREAS, the Planning Commission did find that the design of the
subdivision and the proposed improvements are not likely to cause sub-
stantial environmental damage or serious health problems.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the
City of Palm Desert, as follows:
1. That the above recitations are true and correct and consti-
tute the findings of the Commission in this case;
2. That it does hereby recommend that the applicant pay a fee
in an amount determined under the Ordinance provisions in order to com-
ply with Article 26.15 of the City's Subdivision Ordinance regarding
the public facilities requirement;

3. That it does hereby recommend approval to the City Council
of the City of Palm Desert of the above described Tentative Map No.
11791, subject to fulfillment of the attached conditions.
PASSED, APPROVED, and ADOPTED at a regular meeting of the
Palm Desert Planning Commission held on this 14th day of June, 1978
by the following vote, to wit:

CONDITIONS OF APPROVAL
CASE NO. TT 11791
Standard Conditions:
1. The development of the property described herein shall be subject
to the restrictions and limitations set forth herein which are in
addition to all municipal ordinances and State and Federal statutes
now in force, or which hereafter may be in force.
2. Full public improvements including traffic safety lighting as
required by Ordinance and the Director of Public Works, shall be
installed in accordance with City standards.
3. The C.C.&R's for this development shall be submitted to the Director
of Public Works for review and approval prior to the issuance of any
building permits. Prior to recordation of the final subdivision map,
the applicant shall submit to the Director of Public Works:
a. The document to convey title.
b. Covenants and restrictions to be recorded including a single
story limitation for buildings.
c. Management and maintenance agreement to be entered into with
the owners of the units of the project.
4. Improvement plans for water and sewer system shall meet the require-
ments of the respective service districts.
5. Area shall be annexed to appropriate Improvement Districts having
jurisdiction over the subject area.
6. All dedicated land and/or easements required by this approval shall
be granted to the City of Palm Desert, without cost to the City
and free of all liens and encumbrances.
7. All on -site utilities, including cable TV, shall be placed under-
ground and shall be completely concealed from view except certain
appurtenances as may be approved by the Director of Environmental
Services.
8. Complete plans and specifications shall be submitted as required by
Ordinance to the Director of Public Works for checking and approval
before construction of any improvements is commenced. The sub-
divider shall submit "as -built" plans prior to acceptance of the
subdivision improvements by the City.
9. In order to maintain reasonable fire protection during the construc-
tion period, the subdivider shall maintain passable vehicular access
to all buildings. An adequate number of fire hydrants with the re-
quired fire flows shall be installed as recommended by the Fire Mar-
shal.
10. All requirements of the City Fire Marshal shall be met as a part of
the development of this tract per attached memorandum.
11. Drainage shall be subject to approval of the Director of Public
Works. Applicant shall provide engineered data as requested.
12. All requirements of the Planning Commission action on related Case
No. DP 03-78 shall be met as a part of the development of this tract.
13. The total number of lots shall be limited to 104.
14. The applicant shall have twelve (12) months from the date of the
approval or conditional approval of the tentative map for filing
of the final map unless an extension of time of up to eighteen (18)
months is granted by a Resolution of the City Council.

15. The applicant shall pay fees pursuant to Article 26.25 of the
City's Subdivision Ordinance regarding the public facilities
requirement.
Special Conditions:
1. Blow -sand protection shall be provided on all sides of the project.
2. The necessary right-of-way dedication shall be deeded at recordation
3. All improvements shall be constructed in accordance with the Palm
Desert Subdivision Standards.
4. Sidewalks shall be provided on Monterey and Country Club Drive.
Sidewalks adjacent to the commercial area shall be 10 foot in width.
5. A decorative block wall, 6 feet in height, as shown on Sheet 4 of the plans, shall
be required adjacent to Lots 13 to 20, Lot 102, and Lots 36 to 41.
6. No ingress or egress to any of the lots shall be provided from
Monterey Avenue excepting at "A" Street.
7. Traffic safety lighting shall be provided at "A" Street at both
ends thereof.
8. Applicant shall make a $15,000 contribution towards the signalization
of the intersection at Country Club Drive and Monterey.
9. All drainage shall be engineered and approved by the Director of
Public Works.
10. Applicant shall dedicate sufficient land along Monterey Avenue to
provide for a 34 foot half width and a 16 foot parkway which shall
include an 8' slightly meandering bike path and intensive landscap-
ing.
11. Cul-de-sac at the end of "H" Street shall be shortened to provide
at least 35 feet of frontage for Lots 47 & 48. Lots 46 - 50 shall
be adjusted to incorporate the additional land area so that none
of the lots shall be less than 8,000 sq. ft.
12. All residential lots shall be a minimum of 8,000 sq. ft. and all
development shall conform to all requirements of said Zone District.
13. Subject to approval of the Director of Public Works, adequate traffic
safety provisions shall be made and methods of improving traffic cir-
culation in the vicinity shall be provided at the intersection of
Monterey and Country Club.
14. Plan 2116 shall be deleted.

Reference: Tentative Tract No. 11791 (Residential area only)
Provide the following fire protection:
1. Install a water system capable of delivering 1500 GPM fire flow from any
fire hydrant for a two hour duration in addition to domestic supply. The
computation shall be based upon a minimum of 20 psi residual operating pressure
in the supply main from which the flow is measured at the time of measurement.
2. Install Riverside County super fire hydrants located at each street intersection
(a) but not greater than 500 feet apart in any direction.
A. Exterior surface of hydrant barrels and heads shall be painted chrome yellow,
and the tops and nozzle caps shall be painted green.
B. Curbs shall be painted red 15 feet in either direction from each hydrant.
3. Prior to recordation of the final map, the developer shall furnish the original
and three (3) copies of the water system plan to the Fire Marshal for review.
4. The water system plan shall be signed by a registered civil engineer and approved
by the water company, with the following certification: "I certify that the
design of the water system in Tract No. 11791 is in accordance with the
requirements prescribed by the Fire Marshal." Upon approval, the original plan
will be returned to the developer.
