A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
PALM DESERT, CALIFORNIA, SETTING FORTH ITS FINDINGS AND
RECOMMENDING TO THE CITY COUNCIL DENIAL OF A TENTATIVE
MAP WHICH WOULD CREATE A 2-LOT SUBDIVISION TO PROVIDE
FOR 100 AIR -SPACE CONDOMINIUMS AND RECREATIONAL AMENITIES
ON APPROXIMATELY 10 ACRES WITHIN THE PR-7 ZONE LOCATED
NORTH OF IRONTREE DRIVE, WEST OF MARIPOSA DRIVE AND
SOUTH OF FOXTAIL LANE.
CASE NO. TT 12784
WHEREAS, the Planning Commission of the City of Palm Desert,
California, did hold a duly noticed Public Hearing on July 5th, 1978
to consider the application of SILVER SPUR ASSOCIATES requesting
approval of a Tentative Map to create a 2-lot subdivision to provide
for 100 air -space condominiums and recreational amenities on approx-
imately 10 acres within the PR-7 (Planned Residential maximum 7 du/
acre) zone located north of Irontree Drive, west of Mariposa Drive
and south of Foxtail Lane, more particularly described as:
APN 631-250-007 and a portion
of APN 631-270-018 and
APN 631-270-022
WHEREAS, said application has complied with the requirements
of the "City of Palm Desert Environmental Quality Procedure Resolu-
tion No. 78-32", in that the Director of Environmental Services has
determined that the project is exempt from further documentation as
a Negative Declaration was issued for a related project: and,
WHEREAS, the Planning Commission did take into consideration
the Tentative Map as submitted, and the reports of the various
reviewing agencies; and,
WHEREAS, the Planning Commission did find that the subject
Tentative Map does substantially comply with Chapter 26 of the City
of Palm Desert Municipal Code, and the State of California Subdivision
Map Act, as amended; and,
WHEREAS, the Planning Commission did find that the subject
Tentative Map does comply with the adopted General Plan and the Palm
Desert Zoning Ordinance; and,
WHEREAS, the Planning Commission did find that the site is not
physcially suitable for the type of development proposed; and,
WHEREAS, the Planning Commission did find that the site is not
physically suited for the proposed density of the development; and,
WHEREAS, the Planning Commission did find that the design of
the subdivision and the proposed improvements are likely to cause traffic
congestion in the vicinity; and,
WHEREAS, the Planning Commission did find that the proposed
project contains insufficient recreational amenities for the number
of units proposed.
NOW THEREFORE, BE IT RESOLVED by the Planning Commission of
the City of Palm Desert, as follows:
1. That the above recitations are true and correct and consti-
tute the findings of the Commission in this case;
2. That it does hereby recommend denial to the City Council
of the City of Palm Desert of the above described Tentative Map No.
12784 for the reasons set forth in this Resolution.

PASSED, APPROVED, and ADOPTED at a special meeting of the
Palm Desert Planning Commission, held on this 5th day of July, 1978,
by the following vote, to wit:
AYES: BERKEY, KELLY, KRYDER, SNYDER
NOES: NONE
ABSENT: NONE
ABSTAIN: FLESHMAN
