HomeMy WebLinkAboutRes No 379PLANNING COMMISSION RESOLUTION NO. 379 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, ANNOUNCING FIND- INGS AND GRANTING APPROVAL OF AN AMENDMENT TO AN APPROVED CONDITIONAL USE PERMIT AND PRELIMINARY DESIGN REVIEW TO ALLOW THE ADDITION OF 11 LOTS WITHIN AN EXISTING MOBILEHOME SUBDIVISION. CUP 10-77 (AMENDMENT) WHEREAS, pursuant to the provisions of Sec. 25.36.070 of the Palm Desert, Municipal Code, the Planning Commission did on July 5, 1978, hold a duly noticed Public Hearing to consider the application of PALM DESERT 210 LTD. for approval of an Amendment to an approved Conditional Use Permit and preliminary Design Review to allow the ad- dition of 11 lots within the existing Portola Country Club mobilehome subdivision within the R-M (Mobilehome-Estates) zone generally located east of Portola Avenue extended, north of the Whitewater Storm Channel, and more particulary described as: APN 621-400-018 WHEREAS, said application has complied with the requirements of the "City of Palm Desert Environmental Quality Procedure Resolution No. 78-32," in that an environmental impact report was issued previously for the overall project so that the Director of Environmental Services has determined that this project is exempt from further environmental documentation; and, WHEREAS, at said Public Hearing, upon hearing and considering all testimony and argument, the Planning Commission did find the follow- ing facts and reasons to exist to justify the granting of said approval: 1. The proposed amendment is not likely to cause substantial environmental damage or have a serious adverse effect on the public health, safety, or general welfare. 2. The proposed amendment is compatible with existing land use on the subject site and in the general vicinity of the project. 3. The proposed amendment will not substantially alter the approved project in terms of land use or density. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, as follows: 1. That the above recitations are true and correct and consti- tute the findings of the Commission in this case; 2. That it does hereby approve the said amendment to the ap- proved Conditional Use Permit and preliminary Design Review to allow the additional 11 lots subject to the attached conditions. PASSED, APPROVED, and ADOPTED at a special meeting of the Palm Desert Planning Commission held on this 5th day of July, 1978, by the following vote, to wit: AYES: BERKEY, KELLY, KRYDER NOES: SNYDER, FLESHMAN ABSENT: NONE ABSTAIN: NONE Chairman /ks PLANNING COMMISSION RESOLUTION NO. 379 CONDITIONS OF APPROVAL CASE NO. CUP 10-77 (Amendment) 1. The development of the property shall conform substantially with that as shown on the plot plan on file with the Department of Environmental Services, unless otherwise amended by the follow- ing conditions. 2. The development and use of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all the requirements, limitations, and restrictions of all municipal ordinance and State and Federal statutes now in force, or which hereafter may be in force. 3. All proposed eleven lots shall be a minimum of 5,000 sq. ft. in area. 4. Applicant shall comply with all Conditions of Approval of Case No. CUP 10-77 as part of the approval of the subject case. AGREEMENT I accept and agree, prior to use of this permit or approval, to comply with all the conditions set forth, and understand the Department of Building and Safety will not issue a building permit or allow occupancy on the use permitted until this signed confirmation has been received by the Department of Environmental Services.
