HomeMy WebLinkAboutRes No 380PLANNING COMMISSION RESOLUTION N0. 380 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, RECOMMENDING APPROVAL TO THE CITY COUNCIL OF A CHANGE OF ZONE ON PROPERTY LOCATED ON THE EAST SIDE OF PORTOLA, BETWEEN SAN MARINO CIRCLE AND ALESSANDRO STREET. CASE NO. C/Z 06-78 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 5th day of July, 1978, hold a duly noticed Public Hearing to consider an application filed by HAROLD KAPP for approval of a Change of Zone from R-1 (Single-family Residential) and R-3(4) (Multi -family Residential, min. 4,000 sq. ft. lot area/du) to R-3(9) (Multi -family Residential, min. 9,000 sq. ft. lot area/du) on approximately .24 acres located on the east side of Portola, between San Marino Circle and Alessandro Street, and more particularly des- cribed as: APN 625-082-006 APN 625-082-007 WHEREAS, said application has complied with the requirements of the "City of Palm Desert Environmental Quality Procedure Resolution No. 78-32," in that the Director of Environmental Services has deter- mined that this project will not have a significant adverse effect on the environment and no further documentaion will be required; and, WHEREAS, at said Public Hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, said Planning Commission did find the following facts and rea- sons to exist to approve the Change of Zone request: 1. The proposed Change of Zone will result in a density and land use compatible with adjacent densities and land use. 2. The proposed Change of Zone will not adversely effect the health, safety or general welfare of the community. 3. The proposed Change of Zone does conform to the Palm Desert General Plan. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and consti- tute the findings of the Commission in this case; 2. That it does hereby recommend approval to the City Council of a Change of Zone from R-1 and R-3(4) to R-3(9) as indicated on Exhibit A, for reasons set out in this resolution. PASSED, APPROVED, and ADOPTED at a special meeting of the Palm Desert Planning Commission, held on this 5th day of July, 1978, by the following vote, to wit: AYES: BERKEY, KELLY, KRYDER, SNYDER, FLESHMAN NOES: NONE ABSENT: NONE ABSTAIN: NONE PAUL A.
