A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF PALM DESERT, CALIFORNIA, ANNOUNCING FINDINGS AND
APPROVING THE DESIGN REVIEW BOARD ACTION OF JULY
25, 1978.
WHEREAS, the Planning Commission of the City of Palm Desert,
California, did review the Design Review Board action of July 25, 1978,
approving:

Revised preliminary site, floor and
elevations for a 100-unit condominium
project for Silver Spur Associates;
Sign program for a commercial complex
for John Outcault;

for a commercial structure for Harold
McCormick;
Preliminary and final working draw-
ings for a 5-unit apartment for
Robert Pursel;
Preliminary site, floor and elevations
for a 6-unit apartment for Robert
Ricciardi;
WHEREAS, at this time, upon considering and receiving all
testimony and arguments, if any, of all interested persons desiring to
be heard, said Commission did find sufficient facts and reasons to exist
to approve the Design Review Board action of July 25, 1978.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of
the City of Palm Desert, California, as follows:
1. That the above recitations are true and correct and
constitute the findings of the Commission in this case.
2. That it does hereby approve the Design Review Board actions of July
25, 1978, except Case No. 138MF which is deleted and continued indefinetly.
PASSED, APPROVED, and ADOPTED at a regular meeting of the Palm
Desert Planning Commission, held on this 1st day of August, 1978, by
the following vote, to wit:

I accept and agree, prior to use of this permit or approval, to comply
with all the conditions set forth, and understand that the Department
of Building and Safety will not issue a building permit or allow oc-
cupancy on the use permitted until this signed confirmation has been
received by the Department of Environmental Services.

CASE NO. 87 C
1. The development of this project shall conform substantially to all
development plans submitted in behalf of this case, and as revised
according to the Design Review Board process. Any minor changes
require approval by the Director of Environmental Services. Any
substantial changes requires the approval by the Planning CnmisL,ion.
2. All requirements of any law, ordinance or regulation of the State, City,
and any other applicable government entity shall be complied with as
part of the development process.
3. This approval is applicable, subject to the development of this project,
commencing within one year from approval date and being promptly completed.
4. All service and distribution lines for utilities shall be placed underground.
5. Any roof mounted, exhaust or air conditioning equipment shall be fully
concealed from view from any public rights -of -way & adjoining properties
by architecturally integrated means.
6. Construction plans shall be submitted for approval to the City Fire Mar-
shall prior to issuance of building permits. All conditions shall be made
a part of construction and no certificate of occupancy shall be issued
until completed.
7. Final landscaping (with irrigation system) plans indicating plant sizes
and heights shall be provided to the Design Review Board for approval
prior to issuance of a building permit.
8. Lighting of parking areas and premises shall be provided as approved by the
Director of Environmental Services.
9. Signage shall be provided in accordance with a signage plan to be sub-
mitted to the Design Review Board and Planning Commission for final
approval.
10. Traffic control provisions shall be provided as required by the City
Engineer.
11. The applicant shall agree to join any assessment district formed that
includes the subject property within its boundaries.
12. The applicant shall grant to the City of Palm Desert, easement rights
over the parking lot area of the project site in a form acceptable to
the City Attorney prior to issuance of a certificate of occupancy.
13. The basement shall not be accessible to the public.
14. Alley in th e rear shall be paved.
15. Handicap parking spaces shall be located in the center of the lot with a
4' wide sidewalk in between them.
16. The entrances to the structures shall be relocated to the center of the
building.
17. Additional trees shall be provided.

project, between the carport and adjacent to building B.
6. Applicant shall provide for drainage under walkway at the northwest
property corner.
7. The location of all AC units shall be shown and approved by Staff
prior to plan check.
8. Ground cover shall be included or shown for the rest of the project
and approved by Staff.
9. The fence on the east__property line may not remain if it is to be
used as a retaining wall.

6. The applicant shall provide a trash enclosure.
7. The applicant shall provide gates to enclose pool area.
8. Standard conditions regarding final construction drawings shall apply.
9. Final construction drawings including a final landscaping, grading,
lighting, amenities, trash storage, walkway layout, and irrigation
plan shall be submitted to the Design Review Board. No final inspection
or occupancy permit shall be given by the Department of Environmental
Services to this project until the aforementioned approved plans and
construction shall have been completed.
