HomeMy WebLinkAboutRes No 395PLANNING COMMISSION RESOLUTION NO. 395 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA APPROVING A CONDITIONAL USE PERMIT TO ALLOW AN INDUSTRIAL PARK DEVELOPMENT ON THE EAST SIDE OF COOK STREET NORTHERLY OF THE WHITEWATER CHANNEL. CASE NO. CUP 08-78 WHEREAS, pursuant to the provisions of the Palm Desert Zoning Ordinance, the Planning Commission of the City of Palm Desert, Cali- fornia, did on the 1st day of August, 1978, hold a duly noticed Public Hearing and a continued Public Hearing on September 5, 1978 to consider an application from CLIFF SWANSON, et al for approval of a Conditional use Permit to allow an Industrial Park Develop- ment on approximately 29 acres within the S.I. (U.A.) (Service Industrial, Upon Annexation) zone generally located on the east side of Cook Street northerly of the Whitewater Channel, more particularly described as: APN 619-090-014 WHEREAS, said applicant has complied with the requirements of the "City of Palm Desert Environmental Quality Procedure Resolution No. 78-32", in that the Director of Environmental Services has deter- mined that the project will not have a significant adverse effect on the environment and the appeal period has expired; and, WHEREAS, at said Public Hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said Commission did find the following facts and reasons to exist to justify the granting of said Conditional Use Permit: 1. The proposed use is a valid conditional use permitted within the zoning district in which it is being sought. 2. The proposed use as amended by the conditions of approval will not adversely effect the public health, safety, or general welfare or be materially injurious to properties or improvements in the vicinity. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert as follows: 1. That the above recitations are true and correct and consti- tute the findings of the Commission in these cases. 2. That approval of Conditional Use Permit CUP 08-78 is hereby granted to Cliff Swanson, et al for reasons subject to the attached conditions. PASSED, APPROVED, and ADOPTED at a meeting of the Palm Desert Planning Commission held on this 5th day of Sept. 1978, by the following vote, to wit: AYES: BERKEY, KELLY, SNYDER NOES: NONE ABSENT: KRYDER ABSTAIN: FLESHMAN a GLOR�A KELLY, ATTEST: c--("? ),\\V PAUL A. WILLIAMS, Secretary Chairman 4, /tb Planning Commission Resolution No. 395 Case Nos. CUP 08-78 CONDITIONS OF APPROVAL CASE NO. CUP 08-78 Standard Conditions: Page Two 1. The development of this project shall conform sub- stantially to all plans submitted in behalf of these cases and as revised according to the Design Review Board process and/or Planning Commission Action. Any minor changes require approval by the Director of En- vironmental Services. Any substantial change requires approval by the Planning Commission. 2. All requirements of any law, ordinance, or regulation of the State, City, and any other applicable government entity shall be complied with as a part of the develop- ment process. 3. This approval is applicable, subject to the development of this project, commencing within one year from approval date and being promptly completed. 4. Any and all overhead utility distribution lines shall be undergrounded pursuant to the provisions of the Palm Desert Municipal Code. 5. A single unified architectural treatment shall be utilized throughout the project for all proposed structures and approved through the Design Review Board Process along with landscaping, lighting, fencing, walkways, trash enclosures and any other proposed improvements. AGREEMENT I accept and agree, prior to use of this permit or approval, to comply with all the conditions set forth and understand the Depart- ment of Building and Safety will not issue a building permit or allow occupancy on the use permitted until this signed confirmation has been received by the Department of Environmental Services.
