HomeMy WebLinkAboutRes No 396PLANNING COMMISSION RESOLUTION NO. 396 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, RECOMMENDING APPROVAL TO THE CITY COUNCIL OF A TENTATIVE TRACT MAP TO CREATE A 40-LOT INDUSTRIAL SUB- DIVISION. CASE NO. TT 13236 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 1st day of August, 1978, hold a duly noticed Public Hearing and a continued Public Hearing on September 5th, 1978, to consider an application filed by CLIFF SWANSON, et al, for approval of a Tentative Tract Map to create a 40-lot industrial subdivision from approximately 29 acres within the S.I. (U.A.) (Service Industrial, Upon Annexation) zone generally located on the east side of Cook Street northerly of the Whitewater Channel, and more particularly described as: APN 619-090-014 WHEREAS, said application has complied with the requirements of the "City of Palm Desert Environmental Quality Procedure Resolution No. 78-32", in that the Director of Environmental Services has deter- mined that this project will not have a significant effect on the environment and no further documentation will be required; and, WHEREAS, at said Public Hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, said Planning Commission did find the following facts and reasons to exist to recommend approval of the Tentative Tract Map: 1) The subject Tenetative Map does substantially comply with Chapter 26 of the City of Palm Desert Municipal Code, and the State of California Subdivision Map Act, as amended. 2 3 The subject Tentative Map does comply with the adopted General Plan and the Palm Desert Zoning Ordinance. The site is physically suitable for the type of develop- ment proposed. 4) The design of the subdivision and the proposed improve- ments are not likely to cause substantial environmental damage or serious health problems. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, as follows: 1) That the above recitations are true and correct and con- stitute the findings of the Commission in this case; 2) That it does hereby recommend approval to the City Council of the City of Palm Desert the above described Tentative Map No. 13236 for the reasons set forth in this Resolution and subject to the attached conditions. WILLIAMS, Secretary PLANNING COMMISSION RESOLUTION NO. 396 Page Two CONDITIONS OF APPROVAL CASE NO. TT 13236 Standard Conditions: 1. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all municipal ordinances and State and Federal statutes now in force, or which hereafter may be in force. 2. Full public improvements including traffic safety lighting as required by Ordinance and the Director of Public Works, shall be installed in accordance with City Standards. 3. Access rights on Cook Street shall be offered to the City as a dedication on the Final Map. 4. The C.C. & R's for this development shall be submitted to the Director of Public Works for review and approval prior to the issuance of any building permits. Prior to recordation of the final subdivision map, the applicant shall submit to the Director of Public Works: a. The document to convey title. b. Covenants and restrictions to be recorded. c. Management and maintenance agreement to be entered into with the owners of the units of the project. 5. Improvment plans for water and sewer system shall meet the require- ments of the respective service districts. 6. Area shall be annexed to appropriate Improvement Districts having jurisdiction over the subject area. 7. All dedicated land and/or easements required by this approval shall be granted to the City of Palm Desert, without cost to the City and free of all liens and encumbrances. 8. All on -site utilities, including cable TV, shall be placed under- ground and shall be completely concealed from view except certain appurtenances as may be approved by the Director of Environmental Services. 9. Complete plans and specifications shall be submitted as required by Ordinance to the Director of Public Works for checking and approval before construction of any improvements is commenced. The sub- divider shall sumit "as -built" plans prior to acceptance of the subdivision improvements by the City. 10. In order to maintain reasonable fire protection during the con- struction period, the subdivider shall maintain passable vehicular access to all buildings. An adequate number of fire hydrants withe required fire flows shall be installed as recommended by the Fire Marshal. 11. All requirements of the City Fire Marshal shall be met as a part of the development of this tract per attached memorandum. 12. Drainage shall be subject to approval of the Director of Public Works. Applicant shall provide engineered data as requested. 13. All requirements of the Planning Commission action on related case No. CUP 07-78 shall be met as a part of the development of this tract. 14. The total number of lots shall be limited to 40. 15. The applicant shall have twelve (12) months from the date of the approval or conditional approval of the tentative map for filing of the final map unless an extension of time of up to eighteen (18) months is granted by a Resolution of the City Council. An eleven foot dedication shall be made on the easterly side of Cook Street to enable a 110 foot right-of-way. 2. Full curb, gutter and pavement improvements shall be required on Cook Street. 3. Safety street lighting shall be provided at the entrance on Cook Street and within the tract as approved by the Director of Publi lri Works. 4. Applicant shall make a contribution in the amount of $5,000.00 toward the signalization of Country Club Drive at Cook Street and Avenue 44 and Cook Street to be administered by the County. Install a water system capable of delivering 4000 GPM fire flow from any fire hydrant for a four hour duration in addition to domestic supply. The computation shall be based upon a minimum of 20 psi residual operating pres- sure in the supply main from which the flow is measured at the time of measurement. 2. Install Riverside County super fire hydrants located at each street inter- section (a) but not greater than 300 feet apart in any direction. A. Exterior surface of hydrant barrels and heads shall be painted chrome Yellow, and the tops and nozzle caps shall be painted green. B. Curbs shall be painted red 15 feet in either direction from each hydrant. 3. Prior to recordation of the final map, the developer shall furnish the original and three (3) copies of the water system plan to the Fire Marshal for review. 4. The water system plan shall be signed by a registered civil engineer and approved by the water company, with the following certification: "I certify that the design of the water system in Tract No. 13236 is in accordance with the requirements prescribed by the Fire Marshal."
