HomeMy WebLinkAboutRes No 399PLANNING COMMISSION RESOLUTION NO. 399 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, SETTING FORTH ITS FINDINGS AND RECOMMENDING TO THE CITY COUNCIL, APPROVAL OF A TENTATIVE MAP AND APPROVING PRELIMI- NARY DESIGN REVIEW TO CREATE A 73. SINGLE-FAMILY LOT SUBDIVISION ON 18.5 ACRES OF LAND, GENERALLY LOCATED AT THE SOUTHWEST CORNER OF THE INTERSEC- TION OF PORTOLA AVENUE AND RUTLEDGE WAY (EXTENDED). CASE NO. TT 12181-2 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 5th day of September, 1978, hold a duly noticed Public Hearing, to review an application from LEWIS HOMES OF CALIFORNIA requesting approval of a Tentative Tract and Preliminary Design Review for a 73 lot single-family subdivision on 18.5 acres of land, located in the R-2(5), S.P. & R-1 zones and situated at the southwest corner of the intersection of Portola Avenue and Rutledge Way extended, more particularly described as: The southern portion of APN 621-360-004 WHEREAS, said application has complied with the requirements of the "City of Palm Desert Environmental Quality Procedure Resolution No. 78-32," in that the Director of Environmental Services has deter- mined that the project would not have a significant impact on the environment and the appeal period did expire; and, WHEREAS, the Planning Commission did take into consideration the Tentative Map as submitted, and the reports of the various reviewing agencies; and, WHEREAS, the Planning Commission did find that the subject Tenta- tive Map with 73 lots does substantially comply with Chapter 26 of the City of Palm Desert Municipal Code, and the State of California Subdivision Map Act, as amended; WHEREAS, the Planning Commission did find that the subject Tenta- tive Map does comply with the adopted General Plan and the Palm Desert Zoning Ordinance; and, WHEREAS, the City's Design Review Board did review the design as- pects of the request and did recommend approval. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and consti- tute the findings of the Commission in this case; 2. That it does hereby recommend approval to the City Council of the City of Palm Desert of the above described Tentative Map No. TT 12181-2, subject to fulfillment of the attached conditions. 3. That it does hereby approve the Preliminary Design Review Case No. 147MF subject to the attached conditions. WILLIAMS, 11_ ecretary 32 PLANNING COMMISSION RESOLUTION NO. 399 Page Two CONDITIONS OF APPROVAL CASE NO. TT 12181-2 & 147MF Standard Conditions: 1. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all municipal ordinances and State and Federal statutes now in force, or which hereafter may be in force. 2. Full public improvements including traffic safety lighting as required by Ordinance and the Director of Public Works, shall be installed in accordance with City standards. 3. The C.C.&R's for this development shall be submitted to the Director of Public Works for review and approval prior to the issuance of any building permits. Prior to recordation of the final subdivision map, the applicant shall submit to the Director of Public Works: a. The document to convey title. b. Covenants and restrictions to be recorded. 4. Improvement plans for water. and sewer system shall meet the require- ments of the respective service districts. 5. Area shall be annexed to approprLate Improvement Districts having jurisdiction over the subject area. 6. All dedicated land and/or easements required by this approval shall be granted to the City of Palm Desert, without cost to the City and free of all liens and encumbrances. 7. All on -site utilities, including cable TV, shall be placed under- ground and shall be completely concealed from view except certain appurtenances as may be approved by the Director of Environmental Services. 8. Complete plans and specifications shall be submitted as required by Ordinance to the Director of Public Works for checking and approval before construction of any improvements is commenced. The sub- divider shall submit "as -built" plans prior to acceptance of the subdivision improvements by the City. 9. In order to maintain reasonable fire protection during the construc- tion period, the subdivider shall maintain passable vehicular access to all buildings. An adequate number of fire hydrants with the re- quired fire flows shall be installed as recommended by the Fire Mar- shal. 10. All requirements of the City Fire Marshal shall be met as a part of the development of this tract per attached memorandum. 11. Drainage shall be subject to approval of the Director of Public Works. Applicant shall provide engineered data as requested. 12. The total number of lots shall be limited to a maximum of 73 - 8, 000 sq. ft. lots. 33 PLANNING COMMISSION RESOLUTION NO. 399 Page Three Special Conditions: 1. Sidewalks shall be provided on all public streets to City Standards. 2. A concrete block wall, 6 feet in height shall be required along the Portola Frontage. • 3. No ingress or egress to any of the lots shall be provided from Portola Avenue. 4. Traffic safety lighting shall be installed in accordance with the approval of the Director of Public Works. 5. Applicant shall make a $50 per unit .contribution towards the City' s Signalization Fund. 6. The proposed grading shall be revised to reflect the City minimum of 0.4%. 7. All lots abutting Portola Avenue shall have a minimum depth of 110 ft. 8. A block wall 6 ft. in height shall be provided on the south and west boundary lines of the subdivision. 9. All lots shall have a minimum depth of 100 feet. 10. Length of Street "I" shall be shortened to provide for Lots 8 & 9 to back up to the south property line in conformance with City Standards. 11. San Pascual Avenue shall be improved and fully dedicated as a part of this subdivision up to 44th Avenue. Design Review Conditions: 1. Prior to entering Plan Check, the applicant shall submit detailed construction drawings to the Design Review Board for consideration and approval. Said drawings shall comply to the Conditions of Approval herein, to the Conditions of all related City approvals and all Municipal Codes. Said drawings shall be comprehensive as to their compliance with the submittal requirements as speci- fied in the Boards application form. The building permit, when issued, shall include all elements reviewed and approved by the Design Review Board. No certificate of use and/or final clearance shall be given by the Department of Environmental Services until construction is in total compliance with the approved plans, shall have been completed. 2. The proposed asphalt roof material is not approved. The applicant should consider a variety in tile colors and rock. 3. The applicant shall restudy elevation 2-D. 4. All lots shall be fenced in accordance with City Standards. 5. The developer is responsible for the installation of landscaping and irrigation along all street frontages. Construction drawings shall include alternative plans for each approved elevation. 34 PLANNING COMMISSION RESOLUTION NO. 399 Page Four August 17, 1978 Paul A. Williams Director of Environmental Services City of Palm Desert 45-275 Prickly Pear Lane Palm Desert, Ca. 92260 Reference: Tentative Tract No. 12181-2 Provide the following fire protection: 1. Install a water system capable of delivering 1500 GPM fire flow from any fire hydrant for a two hour duration in addition to domestic supply. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of measurement. 2. Install Riverside County super fire hydrants located at each street inter- section (a) but not greater than 500 feet apart in any direction. A. Exterior surface of hydrant barrels and heads shall be painted chrome yellow, and the tops and nozzle caps shall be painted green. B. Curbs shall be painted red 15 feet in either direction from each hydrant. 3. Prior to recordation of the final map, the developer shall furnish the origi- nal and three (3) copies of the water system plan to the Fire Marshal for review. 4. The water system plan shall be signed by a registered civil engineer and approved by the water company, with the following certification: "I certify that the design of the water system in Tract No. 12181-2 is in accordance with the requirements prescribed by the Fire Marshal."
