A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF PALM DESERT, CALIFORNIA, ANNOUCING FIND-
INGS AND APPROVING THE DESIGN REVIEW BOARD ACTIONS
OF SEPTEMBER 12, 1978.
WHEREAS, the Planning Commission of the City of Palm Desert,
California, did review the Design Review Board actions of September
12, 1978, approving:
Case No. 151MF - Preliminary site, floor and elevation
plans for a 7-unit apartment complex
for TOM TROLLOPE;
Case No. 141MF - Preliminary site, floor and elevation
plans for a 4-unit apartment complex for
ROBERT SHELDON;
Case No. 146MF - Preliminary site, floor and elevation
plans for a 3-unit apartment complex for
MICHAEL KAY.
WHEREAS, at this time, upon considering and receiving all testi-
mony and arguments, if any, of all interested persons desiring to be
heard, said Commission did find sufficient facts and reasons to exist
to approve the Design Review Board actions of September 12, 1978.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of
the City of Palm Desert, California, as follows:
1. That the above recitations are true and correct and consti-
tute the findings of the Commission in this case.
2. That it does hereby approve the Design Review Board actions
of September 12, 1978, except that a new Condition No. 14 is added to
Case No. 141MF and Case No. 146MF is hereby continued to the Planning
Commission meeting of Ocotber 3, 1978.
PASSED, APPROVED, and ADOPTED at a regular meeting of the Palm
Desert Planning Commission, held on this 20th day of September, 1978,
by the following vote, to wit:

1. Construction plans shall be submitted for approval to the
City Fire Marshal prior to issuance of building permits. All
conditions shall be made a part of construction and no certifi-
cate of occupancy shall be issued until completed.
2. Any/all utility service and distribution lines on -or abutting
the subject property, shall be placed underground prior to oc-
cupancy clearance pursuant to Section 25.56.110 of the Municipal
Code.
3. Curbs, gutter and tie-in paving shall be provided in conformance
with City Standards and/or as required by the City Engineer.

Prior to entering P1an.Check. the applicant shall submit detail-
ed cons cruc : _on drawings to Des.ig Review Board for consid-
eration and approval. Said drawings shall comply to the Condi-
tions of Approval herein, to the Conditions of all related City
approvals and all Municipal Codes. Said drawings shall be com-
prehensive as to their compliance with the submittal require-
ments as specified in •the Boards application form. 'The building
permit, when issued, shall include all elements reviewed and
approved by the Design Review Board. No certificate of use
and/or final clearance shall be given by the Department of
Environmental Services until construction is in total compliance
with the approved plans, shall have been completed.
5 In addition, the applicant shall submit particular detailed
plans, as a part of the, construction drawings, for the follow-
ing items which the Board feels are of major concern:
a. Wall materials.
b. Mechnical equipment locations, such as A/C units and pool
equipment.
c. Design of pool enclosures.
d. Proposed landscaping.
6. First proposed uncovered parking space shall be eliminated.
7. Driveway entrance shall be 26' in width.
8. Walkway to Tumbleweed Lane to be relocated west of the inter-
section.
AGREEMENT
I accept and agree, prior to use of this permit or approval, to comply
with all the conditions set forth, and understand that the Department
of Building and Safety will not issue a building permit or allow oc-
cupancy on the use permitted until this signed confirmation has been
received by the Department of Environmental Services.

CASE `:G. 141MF
1. Construction plans shall be submitted for approval to the City
Fire Marshal prior to issuance of building permits. All condi-
tions shall be made a part of construction and no certificate
of occupancy shall be issued until completed.
2. Final construction drawings, including a final landscaping, grading,
lighting, amenities, trash storage,;walkway layout, irrigation plans
and sign program shall be submitted to the Design Review Board. No
final inspection or occupancy permit shall be given by the Depart-
ment of Environmental Services to this project until the aforemen-
tioned approved plans and construction shall have been completed.
3. Any/all overhead utility distribution lines shall be undergrounded
pursuant to the provisions of Sec. 25.56.110 of the Municipal Code.
4. Sidewalks shall -be installed along all street frontages as approved
by the Director of Public Works. _
5. The exterior stucco color shall be changed to reflect more off-
white tones.
6. A more detailed landscaping plan shall be provided.
7.. Landscaping shall include materials to the edge of the sidewalk
along the full frontage of the project.
8. Fencing material throughout the project shall be shown.
9. The jacuzzi shall be relocated to center on the common area of
the project. Appropriate landscaping and screening shall be
provided.
10. Reverse the parking area and provide a 3 ft. setback between car-
ports and the adjacent units.
11. The parking area should terminate on the north at the proposed
walkway with an uncovered parking space.
12. The applicant shall provide an 18" planting strip along the west
property line.
13. Substitute ficus nitida or similar plant for pinus halepensis.
14. Provide a 4' to 5' decorative masonry wall to screen the parking
area from the street.

CASE :;O. 146MF
1. Final construction drawings including a final landscaping, grading,
and irrigation plan shall be submitted to the Design Review Board.
No final inspection or occupancy permit shall be given by the
Department of Environmental Services to this project until the
aforementioned approved plans and construction shall have been
completed.
2. Construction plans shall be submitted for approval to the City Fire
Marshal prior to issuance of building permits. All conditions shall
be made a part of construction and no certificate of occupancy shall
be issued until completed.
3. Curbs, gutters, and tie-in paving shall be installed along Avenue
44 and Adonis Drive as approved by the Director of Public Works.
4. Landscaping shall be provided along the north and east property
lines.
5. Proposed elevations shall be reconsidered as a response to the
Scenic Preservation Overlay Zone in which the site is located.
6. The main building shall have a tile roof.
7. The color of the stucco shall be lightened.
8. The landscaping plan shall be upgraded in accordance with the
plan on file in the office of Environmental Services.
9. Sidewalk shall be relocated as shown on the revised landscaping
plan.
