A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF PALM DESERT, CALIFORNIA, ANNOUNCING
FINDINGS, APPROVING CASE NOS. 152MF and 94C AND
REFERRING CASE NOS. 95C, 96C, and146MF BACK TO
THE DESIGN REVIEW BOARD FOR RECONSIDERATION.
WHEREAS, the Planning Commission of the City of Palm Desert,
California, did review the Design Review Board actions of September
26, 1978, approving:
Case No. 152MF - Preliminary site, floor, and elevation
plans for 5 duplex structures for ROBERT
PITCHFORD;
Case No. 94C - Preliminary plans for a storefront re-
modelling for WENDELL VEITH;
Case No. 95C - Preliminary plans for exterior remodel-
ling of an existing commercial structure
for ROBERT RICCIARDI;
Case No. 96C - Preliminary site, floor and elevation
plans for a commercial structure for
ROBERT RICCIARDI;
WHEREAS, the Planning Commission of the City of Palm Desert,
California, did review the Design Review Board action of September
12, 1978, regarding Case No. 146MF, approving the following:
Case No. 146MF - Preliminary site, floor and elevation
plans for a tri-plex for MICHAEL KAY;
WHEREAS, at this time, upon considering and receiving all testi-
mony and arguments, if any, of all interested persons desiring to be
heard, said Commission did find sufficient facts and reasons to exist
to approve the Design Review Board actions of September 26, 1978, regard-
ing Case No. 94C and 152MF subject to a new Condition No. 8 and referring
Case Nos. 95C, 96C, and 146MF ack to the DRB for reconsideration.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of
the City of Palm Desert, California, as follows:
1. That the above recitations are true and correct and consti-
tute the findings of the Commission in this case.
2. Case No. 95C is referred back to the Design Review Board to
consider: a) The expansion of the exterior modification all around
the building including Sprouse Reitz, jewelers, restaurant, appliance
store on the front, side and rear; b) The upgrading of landscaping
in the parking lot between the mobil station and the area to be re-
modeled.
3. Case No. 96C is referred back to the Design Review Board to
consider full cross sections (2 minimum) north to south through the pro-
posed building from El Paseo to the existing building to be supplied
by the applicant.
4. Case No. 146MF is referred back to the Design Review Board
to consider: a) The development of a decorative block wall along
44th Avenue and Adonis at the propertyline; b) The development of a
water element such as jacuzzi or wading pool westerly of the proposed
garage area; and, c) The requirement of tile roof.
5. Case No. 152MF is hereby approved subject to the conditions
suggested by the Design Review Board and the addition of Condition
No. 8 as shown on the attached conditions.

PASSED, APPROVED, and ADOPTED at a regular meeting of the
Palm Desert Planning Commission, held on this 3rd day of October,
1978, by the following vote, to wit:

CASE `;0. 152MF
1. Construction plans shall be submitted for approval to the
City Fire Marshal prior to issuance of building permits. All
conditions shall be made a part of construction and no certifi-
cate of occupancy shall be issued until completed.
2. Any/all utility service and distribution lines on or abutting
the subject property, shall be placed underground prior to oc-
cupancy clearance pursuant to Section 25.56.110 of the Municipal
Code.
3. Curbs, gutter and tie-in paving shall be provided in conformance
with City Standards and/or as required by the City Engineer.

Prior to entering Plan. Check. the applicant shall submit detail-
ed construction drawings to the Design. Review Beard for consid-
eration and approval. Said drawings shall comply to the Condi-
tions of Approval herein, to the Conditions of all related City
approvals and all Municipal Codes. Said drawings shall be com-
prehensive as to their compliance with the submittal require-
ments as specified in •the Boards application form. The building
permit, when issued, shall include all elements reviewed and
approved by the Design Review Board. No certificate of use
and/or final clearance shall be given by the Department of
Environmental Services until construction is in total compliance
with the approved plans, shall have been completed.
5. In addition, the applicant shall submit particular detailed
plans, as a part of the, construction drawings, for the follow-
ing items which the Board feels are of major concern:
a. Wall materials.
b. Mechnical equipment locations, such as A/C units and pool
equipment.
c. Design of pool enclosures.
d. Proposed landscaping.
6. The proposed drainage easement shall be extended to Burroweed.
7. A crossgutter shall be installed at the intersection of Ryway
and Grapevine as approved by the Director of Public Works.
8. The proposed mezzanine/two story element shall be deleted and
said development shall be limited to single story in conformance
with the S.P. overlay. -
AGREEMENT
I accept and agree, prior to use of this permit or approval, to comply
with all the conditions set forth, and understand that the Department
of Building and Safety will not issue a building permit or allow oc-
cupancy on the use permitted until this signed confirmation has been
received by the Department of Environmental Services.

SPECIAL CONDITIONS
CASE NO. 94C
1. The development of this project shall conform substantially to
all development plans submitted in behalf of this case and as
revised according to the Design Review Board process. Any minor
change requires approval by the Director of Environmental Services.
Any substantial change requires approval by the Design Review Board.
2. All requirements of any law, ordinance, or regulation of the State,
City, and any other applicable government entity shall be complied
with as apart of the development process.
3. This approval is applicable, subject to the development of this
project, commencing within one year from approval date and being
promptly completed.
4. Construction plans shall be submitted for approval to the City
Fire Marshal prior to issuance of building permits. All condi-
tions shall be made a part of construction and no certificate of
occupancy shall be issued until completed.
