HomeMy WebLinkAboutRes No 417PLANNING COMMISSION RESOLUTION NO. 417 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, SETTING FORTH ITS FINDINGS AND APPROVING A TENTATIVE PARCEL MAP TO DIVIDE A 1.2 ACRE PARCEL INTO TWO PARCELS, THE SITE BEING LOCATED ON THE EAST SIDE OF HIGH- WAY 74, SOUTH OF HIGHWAY 111. CASE NO. PM 13584 WHEREAS, the Planning Commission of the City of Palm Desert, California, did hold a duly noticed Public Hearing on October 31, 1978, to consider the request of HUGHES INVESTMENTS for approval of a Tenta- tive Parcel Map to divide one 1.2 acre parcel within the C-1, S.P. (General Commercial District, Scenic Overlay) zone, on the east side of Highway 74, south of Highway 111 into two parcels, the site being more particularly described as: APN 627-19-023 WHEREAS, at said Public Hearing, upon hearing and considering the testimony and arguments, if any, of all interested persons desiring to be heard, said Planning Commission did find the following facts and reasons to exist to justify approval of the Parcel Map: 1. The subject Tentative Parcel Map does substantially comply with Chapter 26 of the City of Palm Desert Municipal Code, and the State of California Subdivision Map Act, as amended. 2. The subject Tentative Parcel Map does comply with the adopted General Plan and the Palm Desert Zoning Ordinance. 3. The site is physically suitable for the type of develop- ment proposed. 4. The design of the subdivision and the proposed improve- ments are not likely to cause substantial environmental damage or serious health problems. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the Commission in this case; 2. That it does hereby approve the above described Tentative Parcel Map No. 13584 subject to fulfillment of the attached conditions. PASSED, APPROVED, and ADOPTED at a regular meeting of the Palm Desert Planning Commission, held on this 31st day of October, 1978, by the following vote, to wit: AYES: Berkey, Fleshman, Kelly, Kryder, Snyder NOES: None ABSENT: None ABSTAIN: None GLOIIA KELLY, ATTEST: PAUL A. The Tentative Parcel Map is granted for the land as described in the attachments, hereto, and as shown on the map -labeled, Exhibit A, and the requirements herein. 2. All requirements of any law, ordinance, or regulation of the State, City, and any other applicable government entity, shall be complied with as a part of this map. 3. Applicant shall comply with all of the Conditions of Approval for related Case Nos. CUP 09-78 and 91C as a part of the approval of this Tentative Parcel Map. 4. CC&R's that include a recorded easement, shall be approved as a part of the Final Map that would include all the parcels of CUP 09-78. 5. An easement shall be reserved in favor of the Southern California Gas Company for maintenance of existing 2" and 4" lines, or if re- location is to occur it shall be coordinated with said company.
