HomeMy WebLinkAboutRes No 420PLANNING COMMISSION RESOLUTION NO. 420 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, ANNOUNCING FIND- INGS AND GRANTING A CONDITIONAL USE PERMIT AND PRELIMINARY DESIGN REVIEW TO ALLOW A RACQUET BALL AND HEALTH CLUB ON PROPERTY GENERALLY LOCATED AT THE NORTHWESTERLY CORNER OF THE INTERSECTION OF PAINTERS PATH AND HIGHWAY 111. CASE NO. CUP 12-78 and 101C WHEREAS, the Planning Commission of the City of Palm Desert, California, did hold a duly noticed Public Hearing on October 31, 1978, to consider an application from PALM DESERT RACQUET BALL AND HEALTH CLUB, INC. , for a Conditional Use Permit and Preliminary Design Review to allow a racquet ball and health club facility on property located in the C-1, S.P. (General Com- mercial, Scenic Preservation Overlay) zone and situated at the north- westerly corner of the intersection of Painters Path and Highway 111, and more particularly described as: APN 621-301-012 WHEREAS, said application has complied with the requirements of the "City of Palm Desert Environmental Quality Procedure Resolution No. 78-32," in that the Director of Environmental Services has determined on June 27, 1977, that the project would not have a significant impact on the environment; and, WHEREAS, at said Public Hearing, upon hearing and considering all testimony and arguments, the Planning Commission did find the proposed development to be in conformance with the City's adopted Redevelopment Plan; and, WHEREAS, at said Public Hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said Commission did find the following facts and reasons to exist to justify the granting of said Conditional Use Permit: 1. The proposed location of the conditional use and the conditions under which it will be operated and maintained will not be detrimental to the public health, safety, or general welfare, or be materially injurious to the properties or improvements in the vicinity. 2. The proposed location of the conditional use is in accord with the objectives of the Zoning Ordinance and the purpose of the district in which the site is located. 3. The proposed conditional use complies with the goals, objec- tives, and policies of the City's adopted General Plan. 4. The proposed conditional use complies with the goals, objec- tives, and policies of the City's adopted Redevelopment Plan. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the Commission in this case; 2. That the Conditional Use Permit (CUP 12-78) and Preliminary Design Review (101C) is hereby granted subject to the attached conditions. WILLIAMS, Secretary PLANNING COMMISSION RESOLUTION NO. 420 Page Two CONDITIONS OF APPROVAL CASE NOS. CUP 12-78 and 101C Standard Conditions: 1. The development of the property shall conform substantially with that as shown on plans marked Exhibit A on file with the Depart- ment of Environmental Services, Case No. CUP 12-78, unless other- wise amended by the following conditions. 2. The development and use of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all requirements, limitations, and restrictions of all municipal ordinances and State and Federal statutes now in force, or which hereafter may be in force. 3. All conditions required as a part of future review shall have equal force and effect on those approved at time of original approval. 4. All roof vents shall be recessed. 5. All on -site utilities, including cable TV, shall be placed under- ground and shall be completely concealed from view except certain appurtenances as may be approved by the Director of Environmental Services. 6. The applicant shall conform to all requirements and improvements deemed necessary by the City Fire Marshal as indicated in the attached letter dated October 23, 1978. 7. A landscaping, grading, lighting, amenities, sign, trash storage, and irrigation plan shall be submitted for the Design Review Process for approval. Final construction plans shall be submitted to the Design Review Board for approval prior to submittal of plans to the Department of Building and Safety for plan check. No final inspec- tion or occupancy certificate shall be given by the Department of Environmental Services until the aforementioned approved plans and construction shall have been completed. 8. Install City standard curb, gutter, sidewalk and tie-in paving as required by City Engineer along full frontage of Highway 111 and Painters Path. 9. Grant City a 25 foot property line radius corner cut-off at inter- section of Highway 111 and Painters Path. 10. Install two street lights on Painters Path, as required by the City Engineer. PLANNING COMMISSION RESOLUTION NO. 420 Page Three Special Conditions: 1. The parking lot/driveway design shall be amended to connect spaces numbered 36 and 37 to space no. 35, moving the driveway/isle and 4010 spaces numbered 38-40 south, as indicated on Exhibit A revised. 2. That brick -in -sand tree wells be placed in the parking area every four (4) spaces, between parking stalls. 3. Developer shall grant to the City a ten (10) ft. easement parallel to Highway 111, and shall improve and maintain said easement and twelve (12) foot public parkway for pedestrian, bicycle and land- scape purposes. Described easement and public parkway, shall con- tain a meandering bicycle path. Install a water system capable of delivering 2500 GPM fire flow for a (2) hour duration in addition to domestic or other supply. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of measurement. 2. Install Riverside County super fire hydrants so that no point of any building is more than 250 feet from a fire hydrant measured along approved vehicular travel ways. A. Hydrants shall not be located closer than 25 feet to any building. B. Exterior surfaces of hydrant barrels and heads shall be painted chrome yellow, and the tops and nozzle caps shall be painted green. C. Curbs (if installed), shall be painted red 15 feet in either direction from each hydrant. 3. Prior to issuance of a building permit, the developer shall furnish the original and three (3) copies of the water system plan to the Fire Marshal for review. Upon approval, one copy will be sent to the Building Department, and the original will be returned to the developer. 4. The water system plan shall be signed by a registered civil engineer, and ap- proved by the water company, with the following certification: "I certify that the design of the water system in Case Number CUP 12-78 is in accordance with the requirements prescribed by the Fire Marshal." vld 7.7"RT Sincerely, DAVID L.
