A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF PALM DESERT, CALIFORNIA, ANNOUNCING FINDINGS AND
APPROVING THE DESIGN REVIEW BOARD ACTIONS OF OCTOBER
24, 1978.
WHEREAS, the Planning Commission of the City of Palm Desert,
California, did review the Design Review Board actions of October 24,
1978, approving:
Case No. 149MF - Request for approval of preliminary plans for
an apartment complex for R. RICCIARDI (L. H.
Maddy);
Case No. 150MF - Request for approval of preliminary plans for
an apartment complex for R. RICCIARDI (L. H.
Maddy);
Case No. 131MF - Request for final plans for Mobile Home Sub-
division for PALM DESERT 210 LTD.;
Case No. 123MF - Request for approval of tennis court resubmittal
for DEEP CANYON TENNIS CLUB HOMEOWNERS` ASSOC.;
WHEREAS, at this time, upon considering and receiving all testi-
mony and arguments, if any, of all interested persons desiring to be
heard, said Commission did find sufficient facts and reasons to exist
to approve the Design Review Board actions of October 24, 1978.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the
City of Palm Desert, California, as follows:
1. That the above recitations are true and correct and consti-
tute the findings of the Commission in this case.
2. That it does hereby approve the Design Review Board actions
of October 24, 1978, subject to the attached revisions as noted in the
minutes of that meeting.
PASSED, APPROVED, and ADOPTED at a regular meeting of the Palm
Desert Planning Commission, held on this 31st day of October, 1978, by
the following vote, to wit:

PALM DESERT DESIGN REVIEW BOARD MEETING
OCTOBER 24, 1978
CITY HALL COUNCIL CHAMBERS
I. The meeting was called to order at 6:25 p.m. in the Council Chambers of
the Palm Desert City Hall after an 1;2 hour study session.

It was moved by Urrutia, seconded by Barton, that the minutes of October
10, 1978, be approved as written; carried 4-0 (Urrutia, Barton, Jackson,
Johnson).
2. Case No. 149MF (Revised) - R. RICCIARDI, A.I.A. for H. L. MADDY - Preliminary
plan approval for a 13 unit apartment complex to be located on the north side
of Shadow Mountain, east of San Luis Rey. Applicant was present.
The alternative staff recommendations were discussed by Board members. Major
concerns of the Board were the project's parking areas and 2-story element.
The applicant agreed to the conditions as discussed by the Board and noted
in the the Staff report.
On a motion by Jackson, seconded by Barton, the Board approved the prelimi-
nary plans subject to the following revisions:
a. Relocate buildings 10, 11, 12, and 13, to the east to provide balance
of open areas off Shadow Mountain.
b. Delete three separate open parking spaces and relocate trash storage to
north side of easterly carports.
c. Delete 12 ft. wide driveway.
d. Limit Units 1 and 9 to single story.
e. Increase the front yard setback on Units 8, 10, 11, 12 and 13 to 18 ft.
f. Provide upgraded landscaping and extensive mounding in lieu of proposed
wall along street. Said upgrading shall include the street parkway area.
g. Provide street improvements as required by the Director of Public Works.
h. Underground existing utilities along north property line pursuant to
municipal requirements.
i. Provide property line elevations of proposed development.
j. Consider special pavement treatment in parking area.
k. Provide overcar storage in carports.
1. Provide dimensions on plans.
Carried 3-1 (AYES: Jackson, Barton, Johnson; NOES: Urrutia).

3. Case No. 15OMF (Revised) - R. RICCIARDI, A.I.A. for H. L. MADDY - Pre-
liminary plan approval for a 12 unit apartment complex to be located
west of Portola between Larrea and Shadow Mountain Drive. Applicant
was present.
The Board discussed the staff recommendations with -the applicant. The
applicant agreed to revise the plans submitted in accordance with the
recommendations.
On a motion by Barton, seconded by Jackson, the Board approved the
preliminary plans with the following revisions:
a. Site Plan (Sheet No. 1)
1. Provide correct lot dimensions.
2. Provide required 10 ft. separation between Units 4 and 5.
3. Provide street improvements as required by the Director of Public
Works.
4. Provide preliminary grading since may affect project design.
5. Designate underground ing of utilities along center property line
per Municipal Code.
6. Provide extensive landscaping and mounding along public streets
in addition to proposed wall system.
7. Provide wall along west property line.
8. Provide full dimensions.
9. Consider special pavement and landscape treatment in parking areas.
10. Provide over -car storage in carports.
b. Building Elevations (Sheet No. 2)
1. Provide exterior materials.
2. Provide elevations affecting grading concept.
3. Provide elevations which reflect proposed project at property lines. vosO
Carried 4-0 (Barton, Jackson, Urrutia, Johnson).
4. Case No. 100C - C. G. DUNHAM - Preliminary plan approval for a 32,000 sq. ft.
commercial complex to be located at the southwest corner of San Luis Rey and
El Paseo. Applicant was present.
The Board reviewed the staff recommendations with the applicant. The pur-
suant discussion resulted in the need for clarification of two issues.
First, the 2-story element and setback of the building located at the corner
of San Luis Rey and E1 Paseo, and second, the parking area configuration and
appropriate setbacks. The Board recommended that these issues be resolved
between the applicant and Department of Environmental Services before any
further action is taken on this case. fti
On a motion by Urrutia, seconded by Barton, the Board continued this case
to the next meeting or until said issues are resolved; carried 4-0 (Urrutia,
Barton, Jackson, Johnson).

5. Case No. 131MF - PALM DESERT 210 LTD. - Final approval of a landscape plan,
perimeter fencing, grading, and ancillary recreation facilities for a 220
space mobile home subdivision located easterly of Portola and northerly
of the Whitewater Channel. Applicant was present.
Major concerns discussed with respect to this case were the fencing and
landscaping materials to be used.
On a motion by Barton, seconded by Jackson, the Board approved the final
plans with the following revisions:
a. Provide landscaping along the pedestrian connections to the golf course.
b. Provide greater variation of landscape materials and additional materials
along the golf course to buffer and protect adjacent mobile homes. Such
landscape materials should include african sumac or olive trees or rhus
lancea -- spreading trees with a broad head that crown out fairly low.
c. 6' chain link fence shall be provided at the projects north property
line with the addition of:
1. Tamarisk every 10' and oleanders every 5' shall provide landscape
buffer.
2. Pyrocantha shall be provided on the outside of the fence at 10'
oc if slats are not used or on the inside of the fence if slats are
used.
3. The matter of barbs on the ton of the fencing shall be resolved be-
tween the applicant and the Director of Environmental Services.
d. Provide a street tree per lot in conformance with Municipal Code require-
ments (Subdivision Ordinance).
e. Tennis courts shall be unlighted and fenced with a 10' chain link fence.
f. Additional landscaping shall be provided along the north side of the tennis
courts. Oleanders would be a suitable landscape material for this location.
g. Provide a minimum of five off-street parking spaces approximately 25 feet
southeast of lot 220 to Ordinance Standards.
h. Irrigation plan with dimensions shall be provided.
i. Tree sizes shall be minimum 15 gal. on evergreen trees and 24" box on
olives.
j. A revised landscaping and site plan reflecting the noted revisions shall
be submitted to the Environmental Services Department for approval and
compliance with recommendations.
Carried 4-0 (Barton, Jackson, Urrutia, Johnson).
6. Case No. 87C - R. RICCIARDI, A.I.A. for HAROLD MCCORMICK - Final construction
drawings for a commercial structure to be located on the north side of High-
way 111 and east of San Marcos. Applicant was present.
The proposed project revisions were discussed with the applicant. The main
concerns expressed were the building height and landscape plans.
On a motion by Urrutia, seconded by Jackson, the Board approved the final
construction drawings with the following revisions:

6. Case No. 87C (Cont.)
a. Site Plan (Sheet 1)
1. Increase planters east and west end of parking lot to a minimum
of 4 ft. per Municipal Code.
2. Designate parking lot lighting and submit to staff.
3. Parking lot shall be fully installed as a part of Building No. 1.
4. Show alley improvements as required by original conditions.
5. Show undergrounding as originally required.
6. Landscape and irrigation plans shall be provided.
b. Building and Elevations (Sheet No. 2)
1. Provide sufficient parapet with wood trim to conceal air conditioner
units on north elevation.
2. Building elevation may be lowered to eliminate front ramp.
Carried 4-0 (Urrutia, Jackson, Barton, Johnson).
7. Case No. 123MF (Resubmittal) - DEEP CANYON TENNIS CLUB HOMEOWNERS' ASSOC. -
Determination of compliance to conditions of approval for two tennis court
additions to the Deep Canyon Tennis Club located easterly of Highway 74 r
and northerly of Haystack Road. Applicant was present.
The issue resolved regarding this case was the type of tree to be used for
screening. The Board recommended that pinus pinea in combination with pinus
halepensis be used.
On a motion by Urrutia, seconded by Barton, the Board determined that if the
landscaping alternative is implemented with the noted modifications and with
a combination of 15 gal. (50%) and 24" box (50%) trees, it would appear to
meet the intent of the Planning Commission approval on this request. Carried
4-0 (Urrutia, Barton, Hill, Johnson).

8. Case No. 28C - RICHARD HOLDEN, A.I.A. for HENRY TAGLE - Final construction
plans for a restaurant to be located at the northwest corner of San Carlos
and the north frontage road. Applicant was not present.
The issue considered on this case was the line of sight problem. In as
much as this issue still appeared to be unresolved the Board decided to
continue thiscase to the next meeting.
On a motion by Urrutia, seconded by Hill, the Board continued this case;
carried 4-0 (Urrutia, Hill, Barton, Johnson).

9. Case No. 101C (Resubmittal) - JAMES C. SMITH - Preliminary plan approval
for a racquet ball facility to be located at the northwest corner of Painters,
Path and Highway 111. Applicant was present.
The Board's concern regarding this case was the need for a more detailed
landscaping plan.
On a motion by Urrutia, seconded by Hill, the Board approved the preliminary `O
plan with the following addition to the existing Special Conditions:
a. A more detailed landscaping plan shall be provided depicting rock group-
ings, ground cover, parkway and setback treatments.
Carried 4-0 (Urrutia, Hill, Barton, Johnson).

10. Case No. 92MF - AFFILIATED CONSTRUCTION - Final construction drawings for
a condo/hotel and landscape plan for total condo/hotel and condominium pro-
ject to be located on the southside of Highway 111 at City easterly limits.
Applicant was present.
The designation of tree varieties to be used throughout the project was the
major issue resolved on this case.
On a motion by Barton, seconded by Urrutia, the Board approved the final
construction drawings with the following revisions:
a. Building Elevations (Exhibits E, G, K, M)
1. Use parapet to hide compressors.
b. Landscape Plan (Exhibit N)
(Hotel)
1. All trees shall be a minimum 15 gal. size. At least 40% of all trees
along Highway 111 and the entrance streets shall be a minimum 24"
box in size. All shrubs shall be a minimum of 5 gal. in size.
2. Additional trees such as palms and olives shall be provided along the
south property line.
c. Landscape Plan (Sheets 102 & 103)
(Condos)
1. All shrubs shall be a minimum of 5 gal. in size.
2. Delete tree varieties shown on plan as numbers 14, 16, and 21 as
they do not do well in desert. Replace with Chamus Superious Londi
and Acacia Tongafolia.
3. Tree sizes shall be in accordance with the following: varieties
numbered 1, 2, 3, 4, 9, & 10 shal.l be 24" box size and remaining
varieties in 15 gal. size.
Carried 4-0 (Barton, Urrutia, Hill, Johnson).
11. The following comments were received regarding the preliminary projects known
as TT 13003 and DP 16-78:
a. TT 13008 - Reduce length of cul-de-sacs to provide for better lot configu-
ration.
b. DP 16-78 - Cul-de-sacs too long; restudy entrances; relocate maintenance
building; restudy drainage; alleviate monotonous street scape
by staggering buildings, varying setbacks, and/or providing
side drives.
12. The meeting was adjourned by Chairman Johnson at 9:00 p.m.
