A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
PALM DESERT, CALIFORNIA, APPROVING A CONDITIONAL USE
PERMIT TO CREATE AN INDUSTRIAL PLANNED UNIT DEVELOPMENT
AT THE SOUTHEAST CORNER OF COOK STREET AND HOVELY LANE
EXTENDED.
CASE NO. CUP 15-78
WHEREAS, pursuant to the provisions of the Palm Desert Zoning Ordinance,
the Planning Commission of the City of Palm Desert, California, did on the 5th
day of December, 1978, hold a duly noticed Public Hearing to consider the
application of GEORGETOWN PARK LTD./E. GEORGE MARZICOLA for approval of a
Conditional Use Permit to create a 42 lot Industrial Planned Unit Development
on approximately 34.7 acres within the SI, SP (UA) (Service Industrial, Scenic
Preservation Overlay, Upon Annexation) zone at the Southeast corner of Cook
Street and Hovely Lane extended, more particularly described as:

WHEREAS, said applicant has complied with the requirements of the City
of Palm Desert Environmental Quality Procedure Resolution No. 78-32 in that the
subject project has been previously assessed under C/Z 11-78 and DP 14-78,
and no further evaluation is deemed necessary; and,
WHEREAS, at said Public Hearing, upon hearing and considering all
testimony and arguments, if any, of all interested persons desiring to be
heard, said Commission did find the following facts and reasons to exist to
justify the granting of said Conditional Use Permit:
1. The proposed use is a valid conditional use permitted within the
zoning district in which it is being sought.
2. The proposed use as amended by the conditions of approval will
not adversely effect the public health, safety, or general welfare
or be materially injurious to properties or improvements in the
vicinity.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City
of Palm Desert as follows:
1. That the above recitations are true and correct and constitute the
findings of the Commission in these cases.
2. That approval of Conditional Use Permit CUP 15-78 is hereby granted
to Georgetown Park, Ltd/E. George Marzicola for reasons subject to the
attached conditions.
PASSED, APPROVED, and ADOPTED at a meeting of the Palm Desert Planning
Commission held on this 5th day of December, 1978, by the following vote,
to wit:
AYES: Berkey, Fleshman, Kryder, Snyder

CONDITIONS OF APPROVAL
CASE NO. CUP 15-78
Standard Conditions:
1. The development of this project shall conform sub-
stantially to all plans submitted in behalf of these
cases and as revised according to the Design Review
Board process and/or Planning Commission Action. Any
minor changes require approval by the Director of En-
vironmental Services. Any substantial change requires
approval by the Planning Commission.
2. All requirements of any law, ordinance, or regulation
of the State, City, and any other applicable government
entity shall be complied with as a part of the develop-
ment process.
3. This approval is applicable, subject to the development
of this project, commencing within one year from approval
date and being promptly completed.
4. Any and all overhead utility distribution lines shall
be undergrounded pursuant to the provisions of the
Palm Desert Municipal Code.
5. A single unified architectural treatment shall be
utilized throughout the project for all proposed
structures and approved through the Design Review
Board Process along with landscaping, lighting, fencing,.
walkways, trash enclosures and any other proposed
improvements.
6. The number of industrial lots shall be`limited to 40, as
illustrated in exhibit 'A' revised.
7. Industrial buildings shall be permitted to develop in a zero
lot line configuration, with no side yard setback being re-
quired between buildings along interior side lot lines, as
approved through the Design Review process.
AGREEMENT
I accept and agree, prior to use of this permit or approval,to
comply with all the conditions set forth and understand the Depart-
ment of Building and Safety will not issue a building permit or allow
occupancy on the use permitted until this signed confirmation has
been received by the Department of Environmental Services.
