HomeMy WebLinkAboutRes No 433PLANNING COMMISSION RESOLUTION NO. 433 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, RECOMMENDING CONDITIONAL APPROVAL TO THE CITY COUNCIL OF A TENTATIVE TRACT MAP TO CREATE A 40 LOT INDUSTRIAL SUBDIVISION. CASE NO. TT13915 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 5th day of December, 1978, hold a duly noticed Public Hearing, to consider a request by Georgetown Park, Ltd/E. George Marzicola,for approval of a tentative Tract Map to create 42 industrial lots on 34.7 acres (to be developed under Conditional Use Permit) within the SI, SP (UA) (Service Industrial, Scenic Preservation Overlay, Upon Annexation) zone at the southeast corner of Cook Street and Hovely Lane extended, and more particularly described as: APN 619-060-016-3 WHEREAS, said application has complied with the requirements of the City of Palm Desert Environmental Quality Procedure Resolution 78-32, in that the subject project has been previously assessed under C/Z 11-78 and DP 14-78, and no further evaluation is deemed necessary; and, WHEREAS, at said Public Hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, said Planning Commission did find the following facts and reasons to exists to recommend approval of the Tentative Tract Map: 1) The subject Tentative Map does substantially comply with Chapter 26 of the City of Palm Desert Municipal Code, and the State of California Subdivision Map Act, as amended. 2) The subject Tentative Map does comply with the adopted General Plan and the Palm Desert zoning ordinance. 3) The site is physically suitable for the type of development proposed. 4) The design of the subdivision and the proposed improvements are not likely to cause substantial environmental damage or serious health problems. NOW, THEREFORE,BE IT RESOLVED by the Planning Commission of the City of Palm Desert, as follows: 1) That the above recitations are true and correct and constitute the findings of the Commission in this case; 2) That it does hereby recommend conditional approval to the City Council of the City of Palm Desert the above described Tentative Map No. 13915 for the reasons set forth in this Resolution and subject to the attached conditions PASSED, APPROVED, and ADOPTED at a regular meeting of the Palm Desert Planning Commission, held on this 5th day of December, 1978, by the following vote, to wit; AYES: NOES: ABSENT: Berkey, Fleshman, Kryder, Snyder None None ABSTAIN: Kelly GLORIA KELLY, Chairman PAUL A. WILLIAMS, Secretary PLANNING COMMISSION RESOLUTION NO. 433 Page Two CONDITIONS OF APPROVAL TRACT NO. 13915 Standard Conditions: 1. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all municipal ordinances and State and Federal statutes now in force, or which hereafter may be in force. 2. Full public improvements including traffic safety lighting as required by Ordinance and the Director of Public Works, shall be installed in accordance with City Standards. 3. Access rights on Cook Street *rid Hovely Lane shalt hc offered to the City as a dedication on the Final Map. 4. The C.C. & R's for this development shall be submitted to the Director of Public Works for review and approval prior to the issuance of any building permits. Prior to recordation of the final subdivision map, the applicant shall submit to the Director of Public Works: a. b. c. The document to convey title. Covenants and restrictions to be recorded. Management and maintenance agreement to be entered into with the owners of the units of the project. 5. Improvment plans for water and sewer system shall meet the ments of the respective service districts. 6. Area shall be annexed to appropriate Improvement Districts jurisdiction over the subject area. 7. All dedicated land and/or easements required by this approval shall be granted to the City of Palm Desert, without cost to the City and free of all liens and encumbrances. require - having 8. All on -site utilities, including cable TV, shall be placed under- ground and shall be completely concealed from view except certain appurtenances as may be approved by the Director=of Environmental Services. 9. Complete plans and specifications shall be submitted as required by Ordinance to the Director of Public Works for checking and approval before construction of any improvements is commenced. The sub- divider shall sumit "as -built" plans prior to acceptance of the subdivision improvements by the_City. 10. In order to maintain reasonable fire protection during ,the con- struction period, the subdivider shall maintain passable vehicular access to all buildings. An adequate number of fire hydrants withe required fire flows shall be installed as.recommended by the Fire Marshal. 11. All requirements of the City Fire Marshal shall be met as a part of the development of this tract per attached memorandum. 12. Drainage shall be subject to approval of the Director of Public Works. Applicant shall provide engineered data as requested. 13. All requirements of the Planning Commission action on related case No. CUP 15-78 shall be met as a part of the development of this tract. 14. The total number of lots shall be limited to 40. 15. The applicant shall have twelve (12) months from the date of the approval or conditional approval of the tentative map for filing of the final map unless an extension of time of up to eighteen (18) months is granted by a Resolution of the City Council. That individual access to lots from Cook Street and Hovely Lane shall be prohibited and such restriction shall be noted in the final map. 2. That perimeter treatment in accordance with the following guide- lines shall be reviewed in the Design Review process for detailed approval and installed as a part of this tract: a. Cook Street - Blowsand/windscreen protection consisting of Tamarisk trees, oleanders, and a wall (30" setback area), with decorative landscaping carried into the parkway, b. Hovely Lane - Installation of a minimum 5' to 7' wall, in- stalled ten feet back from property line with decorative landscaping installed between the wall and curb line. 3. That median islands shall be installed on Cook Street and Hovely Lane and improved to the specifications of the Director of Public Works. 4. That the alley easement illustrated to the rear corner of proposed lots 15 and 20 of the Tentative Tract Map shall be lengthened to 100 ft. along the common property line between proposed lots 15 and 20. Install a water system capable of delivering 3000 GPM fire flow from any fire hydrant for a three hour duration in addition to domestic supply. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of measurement. 2. Install Riverside County super fire hydrants located at each street intersection (a) but not greater than 300 feet apart in any direction. A. Exterior surface of hydrant barrels and heads shall be painted chrome yellow, and the tops and nozzle caps shall be painted green. B. Curbs shall be painted red 15 feet in either direction from each hydrant. 3. Prior to recordation of the final map, the developer shall furnish the original and three (3) copies of the water system plan to the Fire Marshal for review. 4. The water system plan shall be signed by a registered civil engineer and approved by the water company, with the following certification: "I certify that the design of the water system in Tract No. 13,915 is in accordance with the requirements prescribed by the Fire Marshal." Upon approval, the original_plan will be returned to the developer. 5. Prior to delivery of combustible materials to the building site, the required water system shall be installed, operating and delivering the required flow. Very truly yours, DAVID L.
