AND APPROVING A TENTATIVE PARCEL
INTO 4 LOTS A 118 ACRE PARCEL LO-
NORTH SIDE OF 42ND AVENUE EXTENDED,
STREET.

WHEREAS, the Planning Commission of the City of Palm Desert, California, did
on the 3rd cay of October, 1978, hold a duly noticed Public Hearing, and a continued
Public Hearing on October 18. 1978, October 31, 1978, November 15, 1978, and December
5, 1978,2and December 20, 1978, to consider a request by CHARLES GIBBS
for approval of a Tentative Parcel Man to divide into 4 lots an 118 acre
parcel within the S.I., S.P. (Service Industrial, Scenic Preservation
Overlay) and O.S. (Open Space) zone located on the north side of 42nd
Avenue extended, west of Cook Street, more particularly described as:

WHEREAS, said application has complied with the requirements of
the "City of Palm Desert Environmental Quality Procedure Resolution
No. 78-32," in that the Director of Environmental Services has deter-
mined that this project will not have a significant adverse effect on
the environment and no further environmental documentation will be
required; and,
WHEREAS, the Planning Commission did take into consideration the
Tentative Parcel Map as submitted, and the reports of the various re-
viewing agencies; and,
WHEREAS, the Planning Commission did find the following reasons
and facts to exist to justify approval of the proposed Tentative Parcel
Map:

CONDITIONS OF APPROVAL
CASE NO. PI'I 13653
1. The Tentative Parcel Map is granted for the land as described
in the application and any attachments thereto, and as shown
on the map, labeled Exhibit 'A' revised, on file in the Dept.
of Environmental Services, and the requirements herein.
2. All requirements of any law, ordinance, or regulation of the
State, City, and any other applicable government entity shall
be complied with.
3. As a part of any development along the Cook Street frontage, the
Applicant shall underground any and all existing overhead utility
distribution lines pursuant to the provisions of the Palm Desert
Municipal Code. Specifically, the applicant shall underground
those overhead utility lines along Cook Street.
4. All half street dedications (including 35' radius corner) and
street improvements shall be constructed along 42nd Avenue in ac-
cordance with the recommendations of the Director of Public Works.
5. Applicant shall pay $1,500 toward the signalization of Cook St.
and 44th Avenue.
6. Applicant shall dedicate to the City of Palm Desert, forty-four
(44) feet of right-of-way along the north line of parcel no. 4,
to provide for a future half street (Hovely Lane); with a thirty-
five (35) foot property line radius corner at Cook Street.
7. Applicant shall dedicate the full frontage along Cook Street to
form a fifty-five (55) foot half street and as a part of develop-
ment along the Cook Street frontage, install full improvements
in accordance with the recommendations of the Director of Public
Works.
8. The City Attorney shall submit a letter for the file stating that
the applicant's letter of an offer to donate land to the City is
acceptable.
AGREEMENT
I accept and agree, prior to use of this permit or approval, to comply
with all the conditions set forth, and understand the Department of
Building and Safety will not issue a building permit or allow occupancy
on the use permitted until this signed confirmation has been received
by the Department of Environmental Services.
