HomeMy WebLinkAboutRes No 444PLANNING COMMISSION RESOLUTION NO. 444 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, SETTING FORTH ITS FINDINGS AND RECOMMENDING TO THE CITY COUNCIL APPROVAL OF A REVISED TENTATIVE MAP TO CREATE A 227 SINGLE FAMILY LOT SUBDIVISION ON 80.7 ACRES LOCATED AT THE SOUTHEAST CORNER OF THE INTERSECTION OF PORTOLA AVENUE(EXTENDED) AND COUNTRY CLUB DRIVE. Case No. TT 14032 WHEREAS, the Planning Committee of the City of Palm Desert, California, did on the second day of January, 1979 hold a duly noticed Public Hearing, to review an application from Ridgewood Development, Incorporated requesting approval of a 240 lot subdivision on approximately 80.7 acres of land, located in the R-2, 8,000 (8) and 0.S. Zone Districts and situated at the southeast corner of the intersection of Portola Avenue (Extended) and Country Club Drive, more particularly described as: APN 621-230-001 WHEREAS, said application has complied with the requirements of the "City of Palm Desert Environmental Quality Procedure Resolution No. 78-32," in that the Director of environmental Services has determined that the project would not have a significant impact on the environment and the appeal period did expire; and, WHEREAS, the Planning Commission did take into consideration the Tentative Map as submitted, and the reports of the various reviewing agencies; and, WHEREAS. the Planning Commission did find that the subject Tentative Map limited to 233 lots does substantially comply with Chapter 26 of the City of Palm Desert Municipal Code, and the State of California Subdivision Map Act, as amended; WHEREAS, the Planning Commission did find that the subject Tentative Map does comply with the adopted General Plan and the Palm Desert Zoning Ordinance. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the Commission in this case; 2. That it does hereby recommend approval to the City Council of the City of Palm Desert of the above described Tentative Map No. 14032, subject to fulfillment of the attached conditions: 3. The Planning Commission hereby recommends compliance to Article 26(8 of the municipal code by the dedication of lot 226 as a part of the final map. PASSED, APPROVED, and ADOPTED at a regular meeting of the Palm Desert Planning Commission held on this second day of January, 1979, by the following vote, to wit: AYES: Berkey, Fleshman, Kelly, Kryder, Snyder NOES: None ABSENT: None ABSTAIN: None GLORIA KELLY, Chairman ATTEST: PAUL A. WILLIAMS, Secretary PLANNING COMMISSION RESOLUTION NO. 444 CONDITIONS OF APPROVAL CASE NO. TT 14032 Page Two STANDARD CONDITIONS: 1. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all municipal ordinances and State and Federal statutes now in force, or which hereafter may be in force. 2. Full public improvements including traffic safety lighting as required by Ordinance and the Director of Public Works, shall be installed in accordance with City standards. 3. The C.C.&R's for this development shall be submitted to the Director of Public Works for review and approval prior to the issuance of any building permits. Prior to recordation of the final subdivision map, the applicant shall submit to the Director of Public Works: a. The document to convey title. b. Covenants and restrictions to be recorded. c. Homeowners management plan for maintenance of the private streets and common areas. 4. Improvement plans for water and sewer system shall meet the require- ments of the respective service districts. 5. Area shall be annexed to appropriate Improvement Districts having jurisdiction over the subject area. 6. All dedicated land and/or easements required by this approval shall be granted to the City of Palm Desert, without cost to the City and free of all liens and encumbrances. 7. All on -site utilities, including any existing overhead facilities, shall be placed underground and shall be completely concealed from view except certain appurtenances as may be approved by the Director of Environmental Services. 8. Complete plans and specifications shall be submitted as required by Ordinance to the Director of Public Works for checking and approval before construction of any improvements is commenced. The sub- divider shall submit "as -built" plans prior to acceptance of the subdivision improvements by the City. 9. In order to maintain reasonable fire protection during the construc- tion period, the subdivider shall maintain passable vehicular access to all buildings. An adequate number of fire hydrants with the required fire flows shall be installed as recommended by the Fire Marshal. 10. All requirements of the City Fire Marshal shall be met as a part of the development of this tract per attached memorandum. 11. Drainage shall be subject to approval of the Director of Public Works. Applicant shall provide engineered data as requested. 12. The total number of residential lots shall be limited to 227-8,000 square feet lots or larger. 13. The applicant shall have twelve (12) months from the date of the approval or conditional approval of the tentative map for filing of the final map unless an extension of time of up to eighteen (18) months is granted by a Resolution of the City Council. 14. As a part of the first final map, the applicant shall deed lot 233 to the City of Palm Desert to fulfill the requirements of Article 26.48 of the Municipal Code for this subdivision. PLANNING COMMISSION RESOLUTION NO. 444 Page Three Case No. TT 14032 SPECIAL CONDITIONS: 1. Applicant shall pay $50 per unit toward the City's Signalization Fund. 2. The proposed block wall along Country Club Drive and Portola Avenue(Extended) shall be decorative in design as approved through the Design Review Board process. Said wall shall also be provided along the Hovely Lane frontage and the easterly boundary of the subject property. 3. All cul-de-sacs northerly of "h" street shall be shortened so that all lots abutting the proposed green belt shall back up to said area. Further, pedestrian connections from the cul-de-sacs to the proposed green belt shall be maintained5 except for street F & Q. 4. All fencing and/or walls abutting the proposed green belt shall be limited to a maximum height of four feet of solid wall. 5. Access to Hovely Lane shall be limited to a 20 feet wide pedestrian access. 6. All streets, including private streets, shall be built to City Standards as approved by the Director of Public Works. 7. Lot improvements shall include front yard landscaping and irrigation and total lot fencing as approved through the City's Design Review Process. 8. All street names shall be subject to the approval of the Director of Environmental Services. 9. All landscaping installed within the required parkway area along all public streets shall thereafter be maintained by the owners and/or occupants of the total development through an approved homeowner's association. 10. Public street dedication and improvements shall be as follows: a. The full frontage of Country Club Drive shall be dedicated and improved with curb, gutter, tie-1n paving, 8 feet wide meandering bicycle/pedestrian system, center median, and landscaping on the basis of a 55 ft. wide half -street im- provement width plus a 23 feet wide pedestrian easement. b. The full frontage of Portola Avenue shall be dedicated and improved with curb, gutter, tie-in paving, 8 feet wide meandering bicycle/pedestrian system, center median, and landscaping on the basis of a 50 feet wide half -street, plus a 20 ft'. wide pedestrian easement. c. The full frontage of Hovely Lane shall be dedicated and improved with curb, gutter, tie-in paving, center median, and landscaping on the basis of a 88 feet street right-of-way width. d. The above described street improvement requirements do not apply to the proposed street frontage abutting the proposed public park. Along said frontage, the applicant's responsibility shall be limited to the installation of curb, gutter, center median, and pavement. e. All street improvements shall include full-lengh cross gutters at all street intersections for the full width without regard to the applicant's responsibility for street dedications. 11. PLANNING COMMISSION RESOLUTION NO.444 Page Four As a part of the Design Review Board submittal the applicant shall provide a comprehensive Blowsand protection landscape plan for consideration and approval. 12. The proposed subdivision may be constructed in phases but the first phase shall include: a. Irrevocable offer to dedicate the park site subject to the approval of the City Attorney. b. Construction of a minimum of two entrances to the project. c. Complete street improvements including blowsand protection abutting the phase including interim blowsand improvements if deemed necessary by the City. 13. The applicant shall provide an additional pool in the northern portion of the subdivision. Install a water system capable of delivering 1500 GPM fire flow from any fire hydrant for a two hour duration in addition to domestic supply. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of measurement. 2. Install Riverside County super fire hydrants located at each street intersection (a) but not greater than 500 feet apart in any direction. A. Exterior surface of hydrant barrels and heads shall be painted chrome yel- low, and the tops and nozzle caps shall be painted green. B. Curbs shall be painted red 15 feet in either direction from each hydrant. 3. Prior to recordation of the final map, the developer shall furnish the original and three (3) copies of the water system plan to the Fire Marshal for review. 4. The water system plan shall be signed by a registered civil engineer and approved by the water company, with the following certification: "I certify that the design of the water system in Tract No. 14032 is in accordance with the require- ments prescribed by the Fire Marshal." Upon approval, the original plan will be returned to the developer. 5. Prior to delivery of combustible materials to the building site, the required water system shall be installed, operating and delivering the required flow. vla RECEIVED DEC 2217?
