A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
PALM DESERT, CALIFORNIA, ANNOUNCING FINDINGS AND GRANTING
A CONDITIONAL USE PERMIT AND APPROVING THE RELATED DESIGN
REVIEW CASE TO ALLOW A NEIGHBORHOOD FIRE STATION AT THE
NORTHEASTERLY CORNER OR THE INTERSECTION OF MESA VIEW
DRIVE (EXTENDED) AND PORTOLA AVENUE.
CASE NOS. CUP -17-78 AND 1P
WHEREAS, pursuant to the provisions of the Palm Desert Zoning Ordinance,
the Planning Commission did on January 2, 1979, hold a duly noticed Public
Hearing to consider an application from the City of Palm Desert for a Con-
ditional Use Permit to allow a neighborhood Fire Station in the PR-7 Zone
District on property located at the northeasterly corner of the intersection
of Mesa View Drive (Extended) and Portola Avenue; and,
WHEREAS, said application has complied with the requirements of the
"City of Palm Desert Environmental Quality Procedure Resolution No. 78-32"
in that the Director of Environmental Services has determined that the project
would not have a significant impart on the environment and the appeal period
has expired; and,
WHEREAS, at said Public Hearing, upon hearing and considering all
testimony and arguments, if any, of all interested persons desiring to be
heard, said commission did find the following facts and reasons to exist to
justify the granting of said condition use permit and preliminary
Design Review:
1. That the proposed use is a valid community use which is permitted
in the PR Zone District subject to approval of a Development
Plan processed as a Conditional use Permit.
2. The proposed use as amended by conditions of approval will not
adversely effect the public health, safety, or general welface,
or be naturally injurious to properties or improvements in the
vicinity.
3. That the design and location of the proposed development is in
keeping with the character of the surrounding neighborhood and
is not detrimental to the harmonious, orderly, and attractive
development contemplated by the Zone Ordinance and the
General Plan of the City.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the
City of Palm Desert, as follows:
1. That the above recitations are true, correct and constitute the
findings of the commission in this case.
2. That the conditional use permit CUP-17-78 is hereby granted to the
City of Palm Desert for reasons subject to the attached conditions.
3. That it does hereby approve the Design Review Board action of
December 12, 1978 in connection with case no. 1P•

PASSED, APPROVED and ADOPTED at a regular meeting of the Palm
Desert Planning Commission held on this second day of January,1979
by the following vote, to wit:

CONDITIONS OF APPROVAL
CASE NO. CUP 17-78 AND 1P
Standard Conditions:
1. The development of this project shall conform substantially to all plans
submitted in behalf of these cases and as revised according to the Design
Review Board process and/or Planning Commission action. Any minor
changes require approval by the Director of Environmental Services. Any
substantial change requires approval by the Planning Commission.
2. All requirements of any law, ordinance, or regulation of the State,
City, and any other applicable government entity shall be complied
with as a part of the development process.
3. This approval is applicable, subject to the development of this
project, commencing within one year from approval date and being
promptly completed.
4. The conditions of the Design Review Board action of December 12, 1978,
shall apply.
5. All requirements of the City Fire Marshal shall be met as a part of the
development of this project per attached letter dated December 20, 1978.
6. Construction plans shall be submitted for approval to the City Fire
Marshal prior to issuance of building permits. All conditions shall
be made a part of construction and no certificate of occupancy shall
be issued until completed.
7. Traffic control provisions shall be provided as required by the Director of
Public Works.
8. Curb, gutter, sidewalk or approved pathways, and tie-in paving shall
be provided in conformance with City Standards and/or as required by
the Director of Public Works.
9. Prior to issuance of a building permit for construction of any use
contemplated by this approval, the applicant shall first obtain
permits and/or clearance from the following agencies:
Riverside County Department of Health
Palm Desert Design Review Board Process
City Fire Marshal
Coachella Valley County Water District
Evidence of said permit or clearance from the above agencies shall be
presented to the Dept. of Building and Safety at the Time of issuance
of a building permit for the use contemplated herewith.
Special Conditions:
1. The size of parking stalls shall be a minimum of 9 feet by 20 feet.
2. Unless installed by others, a 6 ft. high decorative masonry wall shall
be placed on the northerly and easterly boundaries of the subject
property.
3. The drainage on the proposed project shall be carefully considered to
provide for on -site retention subject to approval of the Director of
Public Works.

4. Elevations and grades shall be returned to the Planning Commission for re-
view after approval by the Design Review Board.
5. Necessary easements shall be obtained for drainage purposes.
AGREEMENT
I accept and agree, prior to use of this permit or approval, to comply with all
the conditions set forth, and understand that the Department of Building and
Safety will not issue a building permit or allow occupancy on the use permitted
until this signed confirmation has been received by the Department of Environ-
mental Services.
