A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF PALM DESERT, CALIFORNIA, ANNOUNCING FIND-
INGS AND GRANTING A 12-MONTH TIME EXTENSION FOR A
CONDITIONAL USE PERMIT AND PRELIMINARY DESIGN
REVIEW TO ALLOW CONSTRUCTION OF 12 CONDOMINIUM UNITS
ON A PARCEL APPROXIMATELY ONE AND ONE-HALF ACRES IN
SIZE ON PROPERTY GENERALLY LOCATED ON THE EAST SIDE
OF OCOTILLO, SOUTH OF TUMBLEWEED WITHIN THE R-3
20,000(3), S.P. ZONE.
CASE NO. CUP 16-77 AND 104 MF
WHEREAS, pursuant to the provisions of the Palm Desert Zoning
Ordinance, the Planning Commission did on January 30, 1979, hold a
duly noticed Public Hearing to consider the request of RONALD STEWART
for approval of a Conditional Use Permit time extension to allow con-
struction of 12 condominium units on a parcel generally located on the
east side of Ocotillo, south of Tumbleweed within the R-3 20,000(3),
S.P. (Multi -family residential, 20,000 sq. ft. minimum lot size,
minimum 3,000 sq. ft. of lot area/unit, Scenic Preservation Overlay)
zone, more particularly described as:
Lots 10, 11, 12, Block F-3,
Palm Desert Unit 3
WHEREAS, at said Public Hearing, upon hearing and considering
all testimony and argument, the Planning Commission did find the
following facts and reasons to exist to justify the granting of approval
of said Conditional Use Permit time extension:
1. The location of the project is in accord with the objectives
of the Zoning Ordinance and the purpose of the district in
which the site is located.
2. The location of the proposed use and the conditions under
which it would be operated or maintained will not be detri-
mental to the public health, safety, or welfare, or be
materially injurious to properties or improvements in the
vicinity.
3. The proposed use will comply with each of the applicable
provisions of the Zoning Ordinance.
4. The proposed use complies with the goals, objectives, and
policies of the City's General Plan.
5. Considerations relating to the original approval have not
substantially changed.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the
City of Palm Desert, as follows:
1. That the above recitations are true and correct and consti-
tute the findings of the Commission in this case.
2. Approval of the time extension for Conditional Use Permit
and Preliminary Design Review is granted to RONALD STEWART
for a twelve-month period, subject to the attached conditions.
PASSED, APPROVED, and ADOPTED at a regular meeting of the City
of Palm Desert Planning Commission held on the 30th day of January, 1979,
by the following vote, to wit:
AYES: BERKEY, FLESHMAN, KELLY, KRYDER, SNYDER

ABSENT: NONE

CASE NO. CUP 16-77, TIME EXTENSION
CONDITIONS OF APPROVAL
1. The conditions contained in Planning Commission Resolution No. 320
shall remain in full force for the term of this extension.
2. Implementation of CUP 16-77 and Case 104 MF, pursuant to
Section 25.72.110 of the Municipal Code of the City of Palm Desert,
California, shall occur on, or before, January 18, 1980, or this
approval shall lapse and become void.
