HomeMy WebLinkAboutRes No 452PLANNING COMMISSION RESOLUTION NO. 452 Law A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, RECOMMENDING APPROVAL TO THE CITY COUNCIL OF A TENTATIVE TRACT MAP TO CREATE 48 LOTS FOR CONDOMINIUM PURPOSES AND 7 LOTS TO PROVIDE COMMON AND RECREATION AREAS. CASE NO. TT 14080 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 30th day of January, 1979, hold a duly noticed Public Hearing, to consider the request of PRO -CON DEVELOPMENT CORP. for approval of a Tentative Tract Map to create 48 lots for condominium purposes and 7 lots to provide common and recreation areas on approximately 10 acres within the PR-5 (Planned Residential, 5 d.u./ac. max.) zone, located on the north side of Hovely Lane, west of Portola Avenue, more particularly described as: APN 621-290-054 APN 621-290-055 WHEREAS, said application has complied with the requirements of the "City of Palm Desert Environmental Quality Procedure Resolution No. 78-32", in that the subject project has been previously assessed under DP 17-78, and no further evaluation is deemed necessary. WHEREAS, at said Public Hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, said Planning Commission did find the following facts and reasons to exist to recommend approval of the Tentative Tract Map: 1. The subject Tentative Map does substantially comply with Chapter 26 of the City of Palm Desert Municipal Code, and the State of California Subdivision Map Act, as amended. 2. The subject Tentative Map does comply with the adopted General Plan and the Palm Desert Zoning Ordinance. 3. The site is physically suitable for the type of development proposed. 4. The design of the subdivision and the proposed improvements are not likely to cause substantial environmental damage or serious health problems. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, as follows: 1. That the above recitations are true and correct and consti- tute the findings of the Commission in this case; 2. That it does hereby recommend conditional approval to the City Council of the City of Palm Desert of the above de- scribed Tentative Map No. 14080 for the reasons set forth in this Resolution and subject to the attached conditions. FURTHER, BE IT RESOLVED that the recommended conditions of approval do include a requirement that the applicant pay in -lieu fees to comply with the requirements of Article 26.48 of the City of Palm Desert Subdivision Ordinance. In return, it is recommended that the City Council agree to use said fees for park purposes in conformance with an adopted master plan, within five (5) years of the recordation of the Final Map. WILLIAMS, Secretary RESOLUTION NO. 452 CONDITIONS OF APPROVAL CASE NO. TT 14080 Standard Conditions: 1. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all the requirements, limitations, and restrictions of all municipal ordinances and State and Federal statutes now in force, or which hereafter may be in force. 2. Full public improvements including traffic safety lighting as re- quired by Ordinance and the City Engineer shall be installed in accordance with City standards. 3. Prior to submittal of the Final Map, the applicant shall provide the Department of Environmental Services with a list or proposed street names with at least three alternatives. The approval of the final street name shall be made by the Director of Environ- mental Services. 4. Access rights, except for the approved private street entrance on Hovely Lane, shall be offered to the City as a dedication on the Final Map. 5. The C.C.&R's for this development shall be submitted to the City Engineer for review and approval prior to the issuance of any building permits. Prior to recordation of the final subdivision map, the applicant shall submit to the City Engineer: a. The document to convey title. b. Covenants and restrictions to be recorded. c. Management and maintenance agreement to be entered into with the owners of the units of the project. 6. Improvement plans for water and sewer system shall meet the re- quirements of the respective service districts. 7. Area shall be annexed to appropriate Improvement Districts having jurisdiction over the subject area. 8. All dedicated land and/or easements required by this approval shall be granted to the City of Palm Desert, without cost to the City and free of all liens and encumbrances. D. All on -site utilities, including cable TV, shall be placed under- ground and shall be completely concealed from view except certain appurtenances as may be approved by the Director of Environmental Services. 10. Complete plans and specifications shall be submitted as required by Ordinance to the City Engineer for checking and approval before construction of any improvements is commenced. The subdivider shall submit "as -built" plans prior to acceptance of the subdivision im- provements by the City. 11. In order to maintain reasonable fire protection during the construc- tion period, the subdivider shall maintain passable vehicular access to all buildings. An adequate number of fire hydrants with required fire flows shall be installed as recommended by the Fire Marshal. 12. Prior to recordation of the Final Map, the developer shall furnish the original and three (3) copies of the water system plan to the Fire Marshal for review. 13. All requirements of the City Fire Marshal in letter dated 11/21/78 shall be met as a part of the development of this tract. 14. The water system shall be signed by a registered civil engineer and approved by the water company, with the following certification: "I certify that the design of the water system of Tract No.14080 is in accordance with the requirements prescribed by the City Fire Marshal." 15. Drainage shall be subject to approval of the City Engineer. Ap- plicant shall provide engineered data as requested. 16. All private streets shall be inspected by the Engineering Depart- ment and a Standard Inspection Fee shall be paid. 17. All requirements of the Planning Commission action on the Develop- ment Plan 17-78 shall be met as a part of the development of this tract. 18. The total number of lots shall be limited to 55 with a maximum of 48 dwelling units allowed. 19. The applicant shall have twelve (12) months from the date of the approval or conditional approval of the tentative map for filing of the final map unless an extension of time of up to eighteen (18) months is granted by a Resolution of the City Council. 20. Drainage and Signalization Fund contributions as required by City Ordinance shall be made prior to recordation of the Final Map. 21. Developer shall pay a fee in lieu of dedication, as a condition of the Final Map, for park and recreation purposes. The City shall commit the use of any such fees received within a five (5) year period. TT 14080 SPECIAL CONDITIONS 1. The area of the condominium lots shall be reduced to contain the building pad and designated private open space. 2. Lots 1, 4, 7, 12, 13, 18, 19, 24, 25, 30, 31, 36, 37, 42, 43, and 48 shall be increased in width to provide for a 20 foot driveway apron and garage structure, as required in DP 17-78. 3. The Tract Map shall be revised to reflect a turn -around area at the private street entrance to Hovely Lane if access/security control for the development is desired. 4. Provide wind/blowsand protection treatment along north and west boundaries. 5. Provide ornamental parkway landscaping along public street frontages. 6. Provide minimum six (6) foot high masonry wall (with emergency access gate) around the site. 7. A Final Tract Map for the subject property shall not be recorded until the City Design Review process has been completed; and any revision to lot locations and configuration or other plan features shall be incorporated into the final map. 8. This subdivision shall pay $2,400.00 to the Signalization Fund of the City of Palm Desert as its portion of the signal at Portola and Hovely Lane. 9. Minimum right-of-way for interior streets should be 38 feet, with a minimum of 32 feet paved between curbs. %no 10. This development shall provide for one safety street light at the intersection of the private drive and Hovely Lane. 11. It is recommended that this subdivision contribute $1,500.00 per acre (gross acreage) to the Drainage Fund of the City of Palm Desert.
