HomeMy WebLinkAboutRes No 467PLANNING COMMISSION RESOLUTION NO. 467 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, RECOMMENDING APPROVAL TO THE CITY COUNCIL OF A TENTATIVE TRACT MAP TO CREATE 157 LOTS ON APPROXIMATELY 40 ACRES, LOCATED SOUTH AND WEST OF THE INTER- SECTION OF MESA VIEW DRIVE (EXTENDED) AND PORTOLA AVENUE (EXTENDED) IN THE PR-7 ZONE. CASE NO. TT 14082 WHEREAS, the Planning Commission of the City of Palm Desert, ., California, did on the 27th day of February, 1979, hold a duly noticed Public Hearing, to consider the request of SILVER SPUR ASSOCIATES for approval of a Tentative Tract Map to create 157 lots providing for 150 residential condominium units on approximately 40 acres within the PR-7 (Planned Residential, max. 7 d.u./ac.) zone located south and west of the intersection of Mesa View Drive (extended) and Portola Avenue (extended), more particularly described as: APN 631-110-010 631-250-038 WHEREAS, said application has complied with the requirements of the "City of Palm Desert Environmental Quality Procedure Resolution No. 78-32", in that the subject request is a subsequent approval for an on- going project, and no further documentation for purposes of CEQA is deemed necessary. WHEREAS, at said Public Hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, said Planning Commission did find the following facts and reasons to exist to recommend approval of the Tentative Tract Map: 1. The subject Tentative Map does substantially comply with Chapter 26 of the City of Palm Desert Municipal Code, and the State of California Subdivision Map Act, as amended. 2. The subject Tentative Map does comply with the adopted General Plan and the Palm Desert Zoning Ordinance. 3. The site is physically suitable for the type of development proposed. 4. The design of the subdivision and the proposed improvements are not likely to cause substantial environmental damage or serious health problems, as conditioned. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, as follows: 1. That the above recitations are true and correct and consti- tute the findings of the Commission in this case; 2. That it does hereby recommend conditional approval to the City Council of the City of Palm Desert of the above described Tentative Map No. 14082 for the reasons set forth in this Resolution and subject to the attached conditions. FURTHER, BE IT RESOLVED that compliance with Article 26.48 of the City of Palm Desert Subdivision Ordinance is hereby acknowledged through prior agreements with the named subdivider. WILLIAMS, Secretary /ss hairmarl PLANNING COMMISSION RESOLUTION NO.467 STANDARD CONDITIONS OF APPROVAL CASE NO. TENTATIVE TRACT 14082 1. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all the requirements, limitations, and restrictions of all municipal ordinances and State and Federal statutes now in force, or which hereafter may be in force. 2. Full public improvements including traffic safety lighting as re- quired by Ordinance and the City Engineer shall be installed in accordance with City standards. 3. Prior to submittal of the Final Map, the applicant shall provide the Department of Environmental Services with a list or proposed street names with at least three alternatives. The approval of the final street name shall be made by the Director of Environ- mental Services. 4. Access rights to Mesa View Drive City as a dedication on the Final Map. 5. The C.C.&R's for this development shall be submitted to the City Engineer for review and approval prior to the issuance of any building permits. Prior to recordation of the final subdivision map, the applicant shall submit to the City Engineer: a. The document to convey title. b. Covenants and restrictions to be recorded. c. Management and maintenance agreement to be entered into with the owners of the units of the project. 6. Improvement plans for water and sewer system shall meet the re- quirements of the respective service districts. 7. Area shall be annexed to appropriate Improvement Districts having jurisdiction over the subject area. shall be offered to the 8. All dedicated land and/or easements required by this approval shall be granted to the City of Palm Desert, without cost to the City and free of all liens and encumbrances. 9. All on -site utilities, including cable TV, shall be placed under- ground and shall be completely concealed from view except certain appurtenances as may be approved by the Director of Environmental Services. 10. Complete plans and specifications shall be submitted as required by Ordinance to the City Engineer for checking and approval before _ construction of any improvements is commenced. The subdivider shall submit "as -built" plans prior to acceptance of the subdivision im- provements by the City. 11. In order to maintain reasonable fire protection during the construc- tion period, the subdivider shall maintain passable vehicular access to all buildings. An adequate number of fire hydrants with required fire flows shall be installed as recommended by the Fire Marshal. 12. Prior to recordation of the Final Map, the developer shall furnish the original and three (3) copies of the water system plan to the Fire Marshal for review. 13. All requirements of the City Fire Marshal in letter of February 16, 1979, shall be met as a part of the development of this tract. 14. The water system shall be signed by a registered civil engineer and approved by the water company, with the following certification: "I certify that the design of the water system of Tract No.14082 is in accordance with the requirements prescribed by the City Fire Marshal." 15. Drainage shall be subject to approval of the City Engineer. Ap- licant shall provide engineered data as requested. 16. All private streets shall be inspected by the Engineering Depart- ment and a Standard Inspection Fee shall be paid. 17. The total number of lots shall be limited to 150 condominium units, plus other lots for common use and open space. 18. The applicant shall have twelve (12) months from the date of the approval or conditional approval of the Tentative Map for filing of the Final Map unless an extension of time of up to eighteen (18) months is granted by a Resolution of the City Council. 19. Drainage and Signalization Fund contributions as required by City Ordinance shall be made prior to recordation of the Final Map. PLANNING COMMISSION RESOLUTION NO. 467 SPECIAL CONDITIONS CASE NO, TT 14082 1. Site development shall conform to Design Review Case No, 164 MF, as approval by Planning Commission Resolution No. 460, and the Final Tract Map design shall reflect pertinent conditions, Revise Mesa View Drive, street section, as directed by the City. 3. Design of the Tentative Tract shall accommodate normal storm water run-off and shall be in accordance with the Master Drainage Plan. The specific design features shall be reviewed and approved by the Director of Public Works. 4. The subdivider shall commit in writing to drainage system improve- ments to accommodate unusually large storm water volumes and/or mitigation of levy system breaching, as approved by the Coachella Valley County Water District and the City Director of Public Works, prior to approval of a Final Map. Install a water system capable of delivering 2500 GPM fire flow from any fire hydrant for a two hour duration in addition to domestic supply. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of measurement. 2. Install Riverside County super fire hydrants located at each street intersection (a) but not greater than 500 feet apart in any direction. A. Exterior surface of hydrant barrels and heads shall be painted chrome yellow, and the tops and nozzle caps shall be painted green. B. Curbs shall be painted red 15 feet in either direction from each hydrant. 3. Prior to recordation of the final map, the developer shall furnish the original and three (3) copies of the water system plan to the Fire Marshal for review. 4. The water system plan shall be signed by a registered civil engineer and approved by the water company, with the following certification: II I certify that the design of the water system in Tract No. 14082 is in accordance with the requirements prescribed by the Fire Marshal." Upon approval, the original plan will be returned to the developer. 5. Prior to delivery of combustible materials to the building site, the required water system shall be installed, operating and delivering the required flow. 6. This area may be considered safe from stormwater flows except in rare instances. The District will furnish domestic water and sanitation service to said area in accordance with the currently prevailing regulations of this District. This area shall be annexed to the Coachella Valley Stormwater Unit of the Coachella Valley County Water District. There may be conflicts with existing District facilities. We request the appropriate public agency to withhold the issuance of a building permit until arrangements have been made with the District for the relocation of these facilities.
