HomeMy WebLinkAboutRes No 482PLANNING COMMISSION RESOLUTION NO. 482 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, ANNOUNCING FINDINGS AND APPROVING A VARIANCE FROM THE REQUIREMENTS OF THE PALM DESERT MUNICIPAL CODE REGARDING THE NUMBER OF IDENTIFICATION SIGNS IN COMMERCIAL AND INDUSTRIAL ZONES. CASE NO. VAR 03-79 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on May 3, 1979, hold a duly noticed Public Hearing to consider the application of DANIEL L. DWORSKY, FAIA, ARCHITECT & ASSOC. (REPRESENTING COLUMBIA SAVINGS & LOAN), requesting approval of a Variance from Section 25.68.290 of the Palm Desert Municipal Code to allow an additional parking area identification sign, pursuant to the procedures established for the granting of exceptions in Section 25.68.730, for the Columbia Savings and Loan building generally located at the southwest corner of Highway 111 and Highway 74, more particularly described as: APN's 629-720-013 629-720-014 WHEREAS, at said Public Hearing, upon hearing and considering all testimony and arguments, the Planning Commission did find the following facts and reasons to exist to justify the approval of said Variance: 1. The strict or literal interpretation and enforcement of the adopted Sign Ordinance will result in practical difficulty or unnecessary physical hardship inconsistent with the objectives of the Ordinance. 2. There are recognizable exceptional or extraordinary circumstances or conditions involved that do not generally apply to other commercial buildings with similar orientations. 3. The Sign Ordinance does not provide for signing when the main identification cannot be seen by traffic, and, therefore, the strict or literal interpretation and enforcement of the Ordinance would deny the applicant a privilege enjoyed by others in a similar circumstance. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, as follows: 1. That the above recitations are true and correct and constitute the findings of the Commission in this case; 2. That Case No. VAR 03-79 is hereby approved, subject to a maximum of 12" high letters and said sign shall not be illuminated. PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert Planning Commission, held on this 3rd day of May, 1979, by the following vote, to wit: AYES: BERKEY, FLESHMAN, KRYDER, SNYDER NOES: NONE ABSENT: NONE ABSTAIN: NONE ATTEST: PAUL A.
