HomeMy WebLinkAboutRes No 486PLANNING COMMISSION RESOLUTION NO. 486 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, SETTING FORTH ITS FINDINGS AND APPROVING A TENTATIVE PARCEL MAP TO DIVIDE 77 NET ACRES INTO TWO PARCELS, LOCATED SOUTH AND EAST OF THE INTERSECTION OF COUNTRY CLUB DRIVE AND COOK ST., UPON ANNEXATION. CASE NO. PM 14625 WHEREAS, the Planning Commission of the City of Palm Desert, California, did hold a duly noticed Public Hearing on May 3, 1979, to consider a Tentative Parcel Map to divide 77 net acres into two parcels upon annexation; proposing one parcel to contain approximately 9 acres in the P.C.-2, S.P (U.A.) (Planned Commercial, District, Scenic Preservation Overlay, Upon Annexation) zone, and the other parcel to contain approximately 66.5 acres in the PR-4, S.P. (U.A.) (Planned Residential, max. 4 d.u./ac., Scenic Preservation Overlay, Upon Annexation) zone and approximately 1.5 acres in the P (U.A.) (Public/Institutional, Upon Annexation) zone, located south and east of the intersection of Country Club Drive and Cook Street, more particularly described as: APN 619-060-001 WHEREAS, at said Public Hearing, upon hearing and considering the testimony and arguments, if any, of all interested persons desiring to be heard, said Planning Commission did find the following facts and reasons to exist to justify approval of the Parcel Map: 1. The subject Tentative Parcel Map does substantially comply with Chapter 26 of the City of Palm Desert Municipal Code, and the State of California Subdivision Map Act, as amended. 2 The subject Tentative Parcel Map does comply with the adopted General Plan and the Palm Desert Zoning Ordinance. 3. The site is physically suitable for the type of development proposed. 4. The design of the subdivision and the proposed improvements are not likely to cause substantial environmental damage or serious health problems. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the Commission in this case; 2. That it does hereby approve the above described Tentative Parcel Map No. 14625 subject to fulfillment of the attached conditions. PASSED, APPROVED, and ADOPTED at a regular meeting of the Palm Desert Planning Commission, held on this 3rd day of May, 1979, by the following vote, to wit: AYES: BERKEY, FLESHMAN, KRYDER, SNYDER NOES: NONE ABSENT: NONE ABSTAIN: NONE ATTEST: /1r PLANNING COMMISSION RESOLUTION NO. 486 Page Two CONDITIONS OF APPROVAL CASE NO. PM 14625 1. The Tentative Parcel Map is granted for the land as described in the attachments hereto, and as shown on the map labeled Exhibit A, and the requirements herein, upon annexation of the City of Palm Desert, California. 2. All requirements of any law, ordinance, or regulation of the State, City, and other applicable government entity, shall be complied with as a part of this map. 3. Applicant shall comply with all of the Conditions of Approval for related Case No. DP 16-78 as a part of the approval of this Tentative Parcel Map. 4. Subdivider shall dedicate eleven (11) feet of right-of-way for Country Club Drive and Cook Street. 5. Public street improvements, as required by the Director of Public Works, shall be installed at the time of development of either parcel created by this map. 6. The requirements of the Fire Marshal in letter dated April 16, 1979, shall become applicable at the time of development. 7. Contributions to the City Drainage and Signalization Fund, as required by the Director of Public Works, shall be made at the time either parcel is developed. Install a water system capable of delivering 2500 GPM fire flow from any fire hydrant for a two hour duration in addition to domestic supply. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of measurement. 2. Install Riverside County super fire hydrants located at each street intersection (a) but not greater than 400 feet apart in any direction. A. Exterior surface of hydrant barrels and heads shall be painted chrome yellow, and the tops and nozzle caps shall be painted green. B. Curbs shall be painted red 15 feet in either direction from each hydrant. 3. Prior to recordation of the final map, the developer shall furnish the original and three (3) copies of the water system plan to the Fire Marshal for review. 4. The water system plan shall be signed by a registered civil engineer and approved by the water company, with the following certification: "I certify that the design of the water system in Tract No. 14625 is in accordance with the requirements prescribed by the Fire Marshal." Upon approval, the original plan will be returned to the developer. 5. Prior to delivery of combustible materials to the building site, the required water system shall be installed, operating and delivering the required flow. Very truly yours, David L.
