A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF PALM DESERT, CALIFORNIA, APPROVING A
DEVELOPMENT PLAN FOR A PLANNED COMMERCIAL DEVELOP-
MENT ON APPROXIMATELY 7.9 ACRES WITHIN THE P.C.(3),
S.P. ZONE AT THE WESTERLY SIDE OF PALMS TO PINES
SHOPPING AREA, BETWEEN EL PASEO AND HIGHWAY 111.
CASE NO. DP 05-79
WHEREAS, the Planning Commission of the City of Palm Desert,
California, did on the 3rd day of May, 1979, hold a duly noticed Public
Hearing, and a continued Hearing on the 29th day of May, 1979, to
consider a request by ROBERT H. RICCIARDI, AIA & ASSOCIATES FOR
GERALD J. CHAZEN to approval of a Development Plan for a planned
commercial development on approximately 7.9 acres within the P.C.(3),
S.P. (Planned Commercial, Regional Center, Scenic Preservation Overlay)
zone at the westerly side of Palms to Pines shopping area, between
El Paseo and Highway 111, more particularly described as:

WHEREAS, said application has complied with the requirements
of the "City of Palm Desert Environmental Quality Procedure Resolution
No. 78-32" in that the Director of Environmental Services has
determined that the project has been previously assessed in connection
with Case Nos. DP 15-78 and VAR 05-78, and no further documentation
is deemed necessary.
WHEREAS, at said Public Hearings, upon hearing and considering
all testimony and arguments, if any, of all interested persons desiring
to be heard, said Planning Commission did find the following facts to
justify their actions, as described below:
a. The proposed project generally conforms to the intent
and purpose of the PC Zone District.
b. The proposed project is adequately suited for the
specific site and is compatible with existing and
proposed development in the area.
c. The proposed project will not be detrimental to the
health, safety and general welfare of the community.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of
the City of Palm Desert, California, as follows:
1. That the above recitations are true and correct and
constitute the findings of the Commission in this case.
2. That the Planning Commission does hereby approve conceptual
Development Plan No. DP 05-79 (Exhibit A) subject to those
conditions attached hereto.
PASSED, APPRQVED and ADOPTED at a regular meeting of the Palm
Desert Planning Commission, held on this 29th day of May, 1979, by the
following vote, to wit:

STANDARD CONDITIONS OF APPROVAL
CASE NO. DP 05-79
1. The development of this project shall conform substantially to
all plans submitted in behalf of thise case and as revised
according to the Design Review Board process and/or Planning
Commission action. Any minor changes requires approval by the
Director of Environmental Services. Any substantial change
requires approval by the Planning Commission.
2. All requirements of any law, ordinance, or regulation of the State,
City, and any other applicable government entity shall be complied
with as aprt of the development process.
3. This approval is applicable, subject to the development of this
project, commencing within one year from approval date and being
promptly completed.
4. Any roof mounted, exhaust, or air conditioning equipment shall be
fully concealed from view from any public rights -of -way and
adjoining properties by architecturally integrated means.
5. Construction plans shall be submitted for approval to the City
Fire Marshal prior to issuance of building permits. All conditions
shall be made a part of construction and no certificate of occupancy
shall be issued until completed.
7. All existing electrical distrubtion lines, telephone, cable antenna
television, and similar service wires or cables, which are adjacent
to the property being developed, shall be installed underground
as a part of development from the nearest existing pole not on the
property being developed.
8. Traffic control provisions shall be provided as required by the
Director of Public Works.
9. The Fire Protection Requirements as specified in the Fire Marshal's
memo dated April 11, 1979 and attached hereto, shall apply.
10. Prior to issuance of a building permit for construction of any use
contemplated by this approval, the applicant shall first obtain
permits and/or clearance from the following agencies:
Riverside County Department of Health
Palm Desert Design Review Board Process
City Fire Marshal
Coachella Valley County Water District
Evidence of said permit or clearance from the above agencies
shall be presented to the Dept. of Building & Safety at the time of
issuance of a building permit for the use contemplated herewith.
11. Applicant shall pay fees into the Palm Desert Planned Local
Drainage Facilities Fund in an amount to be determined by the
provisions of Ordinance No. 175.
12. Development shall pay the required Signalization fees to the City
of Palm Desert as specified by the Director of Public Works.

SPECIAL CONDITIONS OF APPROVAL

1. Install safety street lighting at entrance on El Paseo and
entrance on Highway 111 to the satisfaction of the Director of
Public Works.
2. This development shall provide cross access to the west at the
time of development of the westerly property.
3. The applicant shall agree to provide a common driveway with the
property to the west on Highway 111 if deemed desirable by the
City of Palm Desert, when a plan for said property is' submitted for
approval. Cost of redesign work to be borne by property owner of this development.
4. The applicant shall record a parcel map splitting the developed
property from the undeveloped westerly property; or provide
further documents acceptable to the City of Palm Desert.
5. The project shall be constructed in one phase unless otherwise
authorized through Design Review process.
6. Design Review of the project shall give attention to maximum
screening and buffering of the loading area for the supermarket.
7. There shall be "Right Turn Only" ingress and egress at Highway 111
entrance.
8. Final design of the drive -up window for the savings and loan,
if permitted, shall be subject to approval through the Design
Review process.
9. Parking lot lighting shall be the same as utilized in the commercial
development to the east.
10. A bond, for a raised median on Highway 111 along the frontage of
the property, to be filed with the City of Palm Desert prior to
occupancy; bond amount to be to satisfaction of the Director of
Public Works.
11. The elevations for the savings and loan building shall utilize
the same architectural style, materials and colors as the
market and shops.
12. The final design of the market loading area shall be subject to
approval through the Design Review process.
13. Provide landscaping areas in walkway in front of shops and market.
14. Truck unloading (deliveries) shall be limited to 8:00 a.m. to
9:00 p.m. daily.
15. The east -west alignment of the market shall be moved northerly
so that a minimum setback of 30 ft. shall be maintained.

Prior to construction of any of the proposed buildings, the following conditions

1. Install a water system capable of delivering 3000 GPM fire flow for a three (3)
hour duration in addition to domestic or other supply. The computation shall
be based upon a minimum of 20 psi residual operating pressure in the supply main
from which the flow is measured at the time of measurement.
2. Install Riverside County super fire hydrants so that no point of any building is
more than 200 feet from a fire hydrant measured along approved vehicular travel
ways.
A. Hydrants shall not be located closer than 25 feet to any building.
B. Exterior surfaces of hydrant barrels and heads shall be painted chrome yellow,
and the tops and nozzle caps shall be painted green.
C. Curbs (if installed), shall be painted red 15 feet in either direction from
each hydrant.
3. Prior to issuance of a building permit, the developer shall furnish the original
and three (3) copies of the water system plan to the Fire Marshal for review.
Upon approval, one copy will be sent to the Building Department, and the original
will be returned to the developer.
4. The water system plan shall be signed by a registered civil engineer, and approved
by the water company, with the following certification: "I certify that the design
of the water system in Case Number DP 05-79 is in accordance with the requirements
prescribed by the Fire Marshal."
5. Prior to delivery of combustible materials to the building site, the required
water system shall be installed, operating and delivering the required flow.
6. Market building shall be fully protected with an automatic fire sprinkler system.
7. Fire lanes may be required for access to buildings.
