HomeMy WebLinkAboutRes No 491PLANNING COMMISSION RESOLUTION NO. 491 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, SETTING FORTH ITS FINDINGS AND APPROVING A TENTATIVE PARCEL MAP TO DIVIDE APPROXIMATELY 3.538 ACRES INTO FIVE (5) PARCELS WITHIN THE P.C.(3), S.P. ZONE LOCATED ON THE SOUTHWEST CORNER OF HIGHWAY 111 AND HIGHWAY 74. CASE NO. PM 14710 WHEREAS, the Planning Commission of the City of Palm Desert, California, did hold a duly noticed Public Hearing on May 29, 1979, to consider a Tentative Parcel Map to divide 3.538 acres into five (5) parcels within the P.C.(3), S.P. (Planned Commercial, Regional Shopping Center, Scenic Preservation Overlay) zone located on the southwest corner of Highway 111 and Highway 74, more particularly described as: APN's 629-720-013 629-720-014 WHEREAS, at said Public Hearing, upon hearing and considering the testimony and arguments, if any, of all interested persons desiring to be heard, said Planning Commission did find the following facts and reasons to exist to justify approval of the Parcel Map: 1. The subject Tentative Parcel Map does substantially comply with Chapter 26 of the City of Palm Desert Municipal Code and the State of California Subdi- vision Map Act, as amended. 2. The subject Tentative Parcel Map does comply with the adopted General Plan, the Palm Desert Zoning Ordinance, and approved Development Plan for the site. 3. The site is physically suitable for the type of development proposed. 4. The design of the subdivsiion and the proposed improvements are not likely to cause substantial environmental damage or serious health problems. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the Commission in this case. 2. That it does hereby approve the above described Tentative Parcel Map No. 14710, subject to fulfillment of the attached conditions. PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert Planning Commission, held on this 29th day of May, 1979, by the following vote, to wit: AYES: NOES: ABSENT: ABSTAIN: BERKEY, KRYDER, MILLER, SNYDER NONE FLESHMAN NONE WALTER SNYDER, Chai an ATTEST: PAUL A. WILLIAMS, Secretary PLANNING COMMISSION RESOLUTION NO. 491 CONDITIONS OF APPROVAL CASE NO. PM 14710 1. The Tentative Parcel Map is granted for the land as described in the attachments hereto, and as shown on the map labeled Exhibit A, and the requirements herein. 2. All requirements of any law, ordinance, or regulation of the State, City, and other applicable government entity, shall be complied with as a part of this map. 3. Applicant shall comply with all of the Conditions of Approval for related Case No. DP 02-78 as a part of the approval of this Tentative Parcel Map. 4. Public street improvements, as required by the Director of Public Works, shall be installed at the time of development of the parcels created by this map. 5. The requirements of the Fire Marshal in letter dated May 11, 1979, shall become applicable at the time of development. 6. Contributions to the City Drainage and Signalization Fund, as required by the Director of Public Works, shall be made at the time parcels are developed. 7. Reciprocal access and parking easements shall be granted to all parcels hereby created. 8. Reciprocal access easements shall be granted to the adjacent property to the west. 9. C C & R's shall include provisions for common site maintenance of parking and landscape areas, and submitted to City for approval prior to recordation of a final map.
