HomeMy WebLinkAboutRes No 501PLANNING COMMISSION RESOLUTION NO. 501 Nkfiew A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, SETTING FORTH ITS FINDINGS AND APPROVING A TENTATIVE PARCEL MAP TO DIVIDE 78.975 ACRES INTO FOUR PARCELS, LOCATED ON THE EAST SIDE OF SAN PABLO AVENUE, NORTH OF 44TH AVENUE. Case No. PM 14768 WHEREAS, the Planning Commission of the City of Palm Desert, California, did hold a duly noticed Public Hearing on July 3, 1979, to consider a request by LEWIS HOMES OF CALIFORNIA to divide 78.975 acres into four parcels: proposing one parcel containing 26.980 acres, one parcel containing 37.3 acres, and one parcel containing 6.0 acres (park site), all within the PR-4, S.P. (Planned Residential, max. 4 du/ac) zone; and, one parcel containing 8.695 acres (Civic Center Site) in the 'P' (Public/Institutional) zone, on property generally located on the east side of San Pablo Avenue, north of 44th Avenue, more particularly described as: APN 621-360-001 APN 621-360-005 WHEREAS, at said Public Hearing, upon hearing and considering the testimony and arguments, if any, of all interested persons desiring to be heard, said Planning Commission did find the following facts and reasons to exist to justify approval of the Parcel Map: 1. The subject Tentative Parcel Map does substantially comply with Chapter 26 of the City of Palm Desert Municipal Code, and the State of California Subdivision Map Act, as amended. 2. The subject Tentative Parcel Map does comply with the adopted General Plan and the Palm Desert Zoning Ordinance. 3. The design of the subdivision and the proposed improvements are not likely to cause substantial environmental damage or serious health problems. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and consti- tute the findings of the Commission in this case; 2. That it does hereby approve the above described Tentative Parcel Map No. 14768, subject to fulfillment of the attached conditions. PASSED, APPROVED, and ADOPTED at a regular meeting of the Palm Desert Planning Commission, held on this 3rd day of July, 1979, by the following vote, to wit: AYES: Berkey, Fleshman, Kryder, Miller, Snyder NOES: None ABSENT: None ABSTAIN: None WA SNYDER, Ch j rman ifiew ATTEST: PAUL A. WILLIAMS, Secretary PLANNING COMMISSION RESOLUTION NO. 501 Page Two CONDITIONS OF APPROVAL CASE NO. PM 14768 1. The Tentative Parcel Map is granted for the land as described in the attachments, hereto, and as shown on the map labeled, Exhibit A, and the requirements herein, upon annexation to the City of Palm Desert, California. 2. All requirements of any law, ordinance, or regulation of the State, City, and other applicable government entity, shall be complied with as a part of this map. 3. No development shall take place on proposed parcel Nos. 1 and 4 un- til the related Final Tract Map Nos. 14004, and 14003 are recorded; and, development of this Tentative Parcel Map shall be subject to compliance with the conditions of approval of Case No. DP 13-79. 4. Public right-of-way of dedication and street sections shall be revised on the Final Map as directed and approved by the Director of Public Works; and shall include the following changes: a) Parcel No. 1 shall delineate the San Pasqual dedication re- quired for Tract No. 1218, and the boundary of the Tentative Map shall be adjusted for that delineation. b) The cross-section of 44th Avenue shall be revised to reflect a 12 ft. wide parkway on the south side, 25 ft. center median island between two 32 ft. wide traveled ways, with a 25 ft. wide parkway on the north side. c) Eliminate street dedication shown for Parcel Nos. 2 and 3.
