HomeMy WebLinkAboutRes No 502PLANNING COMMISSION RESOLUTION NO. 502 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, APPROVING AN AMENDMENT TO AN APPROVED RESIDENTIAL DEVELOPMENT PLAN CONCERN- ING THE AMOUNT OF COMMON OPEN SPACE TO BE MAINTAINED. CASE NO. DP 06-79 (Amended) WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 3rd day of July, 1979, consider a request by MC LAIN DEVELOPMENT CO. for approval of an Amendment to an Approved Residential Development Plan to allow a 2.4% reduction of required common open space on approximately 80 acres within the PR-4 (Planned Residential, max 4 du/ac.) and O.S. (Open Space) zones located at the southeast corner of Portola Ave. and Country Club Dr., more particularly described as: APN 621-230-001 WHEREAS, said request has complied with the requirements of the "City of Palm Desert Environmental Quality Procedure Resolution No. 78-32" in that the Director of Environmental Services has declared that the activity is not a project for purposes of the California Environmental Quality Act, and no further documentation is deemed necessary. WHEREAS, on said date, said Planning Commission did find the following facts to justify their actions, as described below: a. A Public Hearing was held on May 29, 1979, at which time the Planning Commission approved a Residential Development Plan (Case No. DP 06-79) for the subject site; b. The Commission is authorized by Section 25.24.080, of the Municipal Code to approve a minor change in a Development Plan which does not involve a reduction of more than ten percent of the area shown as open space, without need to hold further Public Hearings; c. A minor change in the common open space, consisting of a 2.4% reduction, for Case No. DP 06-79, is deemed necessary to implement the design concept; d. The public open space dedication by this development is far in excess of the minimum area required; e. Recreational/Open Space needs of the development occupants will be compensated by the public open space dedication; f. The proposed project as amended generally conforms to the intent and purpose of the PR Zone District; g. The proposed project as amended is adequately suited for the specific site and is compatible with existing and proposed development in the area; and, h. The proposed project as amended will not be detrimental to the health, safety, and general welfare of the com- munity. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the Commission in this case. 2. That the Planning Commission does hereby approve an Amendment (minor change) to Case No. DP 06-79, to provide for maintenance of 47.6% of the net site area in PLANNING COMMISSION RESOLUTION N0.502 Page Two common open space, representing a 2.4% reduction from the PR zone standard. PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert Planning Commission, held on this 3rd day of July, 1979, by the following vote, to wit: AYES: Berkey, Fleshman, Kryder, Miller, Snyder NOES: None ABSENT: None ABSTAIN: None ATTEST:
