A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF PALM DESERT, CALIFORNIA, ANNOUNCING FINDINGS AND
DENYING A VARIANCE FROM THE REQUIREMENTS OF THE PALM
DESERT MUNICIPAL CODE REGARDING THE NUMBER AND SIZE
OF IDENTIFICATION SIGNS IN COMMERCIAL AND INDUSTRIAL
ZONES.
CASE NO. VAR 04-79
WHEREAS, the Planning Commission of the City of Palm Desert,
California, did on July 3, 1979, hold a duly noticed Public Hearing to
consider the application of HEATH AND CO. for R.B. FURNITURE, requesting
approval of a Variance from the Palm Desert Municipal Code (Sign Ordin-
ance) to allow two wall mounted signs oriented to the street frontage and
rear parking area, pursuant to Municipal Code Section 25.68.730, for
building generally located on the west side of Hwy. 111, at the common
city limit boundary between Palm Desert and Rancho Mirage, more partic-
ularly described as:

WHEREAS, at said Public Hearing, upon hearing and considering
all testimony and arguments, the Planning Commission did find the follow-
ing facts and reasons to exist to justify the denial of said Variance:
1. The strict or literal interpretation and enforcement
of the adopted Sign Ordinance will not result in prac-
tical difficulty or unnecessary physical hardship in-
consistent with the objectives of the ordinance.
2. There are no recognizable exceptional or extraordinary
circumstances or conditions involved that do not gen-
erally apply to other commercial buildings with similar
orientations.
3. The Sign Ordinance provides for signing beyond the main
identification sign; thererfore, the strict or literal
interpretation and enforcement of the Ordinance would
not deny the applicant a privilege enjoyed by others in
a similar circumstance.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the
City of Palm Desert, as follows:
1. That the above recitations are true and correct and
constitute the findings of the Commission in this case;
2. That Case No. VAR 04-79 is hereby denied.
PASSED, APPROVED and ADOPTED at a regular meeting of the Palm
Desert Planning Commission held on this 3rd day of July, 1979, by the
following vote, to wit:
